74-D-40 THE STATE OF TEXAS . l COUNTY OF GUADALUPE l CITY OF SCHERTZ l On this, the lst day of October, 1974, at 7:00 o'clock P.M., the City Council of the City of Schertz, Texas, convened at a regular meeting at the regular meeting place in the Muni- cipal Building in the City of Schertz, Texas, pursuant to due call and notice to all of the members of said City Council, which meeting was at all times open to the public, and at which meeting the following members were present, to-wit: ROBERT C. BUEKER MRS. NELL G. FUNK DONALD J. SEEBA TOM KOOLE ROBERT E. SCHWARTZ MRS. BOBBIE L. KOCH MRS. JUNE G. KRAUSE DENNY L. ARNOLD and l"lAYOR ALDERWOl"lAN ALDERMAN ALDERMAN ALDEilllAN ALDERWOMAN CITY SECRETARY CITY MANAGER There being a quorum present, the meeting was called to order by the Mayor, and, among other proceedings had were the following: The Mayor introduced the hereinafter set forth ordin- ance, which has been read and considered at the last regular meeting of the City Council on the 17th day of September, 1974, It was determined that the City Secretary had caused a short synopsis of said proposed ordinance to be published in the offi- cial City newspaper after its consideration at the last regular meeting of the City Council and prior to this meeting. Whereupon said ordinance was discussed and further considered by the Council. Thereupon it was moved by Councilmember J~ K~ . and seconded by Councilmember that said ordinance be finally passed and adopted. The Mayor put the motion to a vote of the members of the City Council and the ord- inance was finally passed and adopted by the following vote: AYES: All Councilmembers present voted "AYE". NAYS: None ORDINANCE NO. 71f -cO-/!O ~ AN ORDINANCE MAKING IT UNLAWFUL FOR ANY DRIVER OF A MOTOR VEHICLE TO CAUSE THE vmEELS OF SAID VEHICLE TO SPIN AGAINST THE STREETS OR OTHER PUBLIC PLACE OF THE CITY OF SCHERTZ, TEXAS; DECLARING A VIOLATION OF THE PROVISIONS OF THIS ORDINANCE A MISDEMEANOR AND PROVIDING FOR PUNISHMENT UPON CONVICTION OF A FINE NOT TO EXCEED $200; PRO- VIDING FOR THE PUBLICATION OF THIS ORDINANCE; AND ENACTING OTHER PROVISIONS INCIDENT AND RE- LATING TO THE SUBJECT * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * WHEREAS, in order to protect the residents of the City of Schertz, Texas, from injuries caused by reckless drivers of motor vehicles, the City Council of the City of Schertz, Texas, finds that it is necessary to enact the following ordinance re- gulating the driving of motor vehicles in said City; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITi OF SCHERTZ, TEXAS: SECTION I This ordinance shall be known as and may be cited as the "Spinning Wheels Ordinance of the City of Schertz." SECTION II It shall be unlawful for the driver of any motor vehicle being driven upon a public street or other public place in the City of Schertz, Texas, to accelerate said vehicle in such a fashion as to cause one or more of the wheels of said vehicle to spin against the surface of the street or other driving surface, if not a pub- licstreet, and thereby leave markings or other physical evidence of spinning wheels thereon. SECTION III Police officer, ambulance drivers, drivers of fire trucks and other emergency vehicles, and drivers acting under a sudden emergency are exempt from the operation of this ordinance. SECTION IV Any person who shall violate any of the provisions of this ordinance shall be deemed to be guilty of a misdemeanor and shall, upon conviction, be punished by a fine not to exceed $200. Each separate violation of this ordinance shall constitute a separate offense.'
