THE STATE OF TEXAS I COUNTY OF GUADALUPE I CITY OF SCHERTZ I On this, the 17th day of September, 1974, at 7:00 o'clock P.M., the City Council of the City of Schertz, Texas, convened at a regular meeting at the regular meeting place in the Municiapl Building in the City of Schertz, Texas, pursuant to due call and notice to all of the members of said City Council, which meeting was at all times open to the public, and at which meeting the following members were present, to-wit: ROBERT C. BUEKER MRS. NELL G. FUNK DONALD J. SEEBA TOM KOOLE ROBERT E. SCHWARTZ MRS. BOBBIE L. KOCH MAYOR ALDERWOMAN ALDERMAN ALDERMAN ALDERMAN ALDERWOMAN and MRS. JUNE G. KRAUSE DENNY L. ARNOLD CITY SECRETARY CITY MANAGER There being a quorum present, the meeting was called to order by the Mayor, and, among other proceedings had were the following: The Mayor introduced the hereinafter set forth ord- inance, which has been read and considered at the last regular meeting of the City Council on the 3rd day of September, 1974. It was determined that the City Secretary had caused a short synopsis of said proposed ordinance to be published in the offi- cial City newspaper after its consideration at the last regular meeting of the City Council and prior to this meeting. Whereupon said ordinance was discussed and further considered by the Council. K4 Thereupon it was moved by Councilmember and seconded by Councilmember ~ .n ~ _ that said ordinance be finally passed and adopted. The Mayor put the motion to a vote of the members of the City Council and the ordinance was finally passed and adopted by the following vote: AYES: All Councilmembers present voted "AYE" NAYS: None ORDINANCE NO. '71-tJ-jo- AN ORDINANCE ACCEPTING DEED OF DEDICATION FROM URBAN RENEWAL AGENCY OF THE CITY OF SCHERTZ, TEXAS OF DISPOSITION PARCEL NOS. 17-5, 43-2, 44-5 and 54-6 LOCATED WITHIN BUFFALO VALLEY NORTH PROJECT, TEX. R-112 FOR PAille AND OPENSPACE USE. * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * WHEREAS, The Urban Renewal Plan for Buffalo Valley North Project, Tex. R-112 and the Fourth Amended Cooperation Agreement by and between the Agency and City of Schertz, Texas, calls for the dedication of Disposition Parcel Nos. 17-5, 43-2, 44-5 and 54-6 located within the Project area to the City upon construction of certain improvements by the Agency in accord- ance with said Fourth Amended Cooperation Agreement; and WHEREAS, the project improvements for said parcels have been completed by Agency; and WHEREAS, a copy of said Deed of Dedication is attached hereto; NOW, THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: I 'That the Deed of Dedication from the Urban Renewal Agency of the City of Schertz, Texas, dedicating Disposition Parcels 17-5, 43-2, 44-5.and 54-6 within the project boundaries of Buffalo Valley North Urban Renewal Project, Tex. DEED OF DEDICATION STATE OF TEXAS X COUNTY OF GUADALUPE X KNOW ALL MEN BY THESE PRESENTS: WHEREAS, the Urban Project, Tex. R-112, as the City Council of the Renewal Plan for the Buffalo Valley North amended, has been approved and adopted by City of Schertz; and WHEREAS, said approved Urban Renewal Plan provides for Park and Openspace use as defined in said Plan applicable to certain portions of the project area to be maintained as such as set forth in said Plan; and WHEREAS, the Fourth Amended Cooperation Agreement by and between the Urban Renewal Agency of the City of Schertz (hereinafter called Agency) and the City of Schertz (hereinafter called City) dated the 22nd day of May , 1974 provides that Agency will construct certain improvements on the disposition parcels described herein, and further that Agency will dedicate and City will accept dedication of said disposition parcels referred to herein for Park and Openspace use as set forth in said approved Plan; and WHEREAS, the construction of said improvements having been completed by Agency; now, therefore The Urban Renewal Agency of the City of Schertz, Guadalupe County, Texas has dedicated and by these presents does hereby dedicate unto the City of Schertz the following described real property and improvements located thereon located in the County of Guadalupe, City of Schertz, Texas and more particularly described as follows, to-wit: Disposition Parcel: 17-5, 43-2, 44-5 and 54-6, being more fully described by metes and bounds in Exhibit "An attached hereto and made a part hereof. . TO FAVE AND TO HOLD the above-described premises, together with all and singular the rights and appurtenances thereto in anywise belonging, unto the said Grantee City, its successors and assigns forever. This Deed of Dedication is made and executed upon and is subject to certain express conditions and covenants, said conditions and Covenants being a part of the consideration of the property hereby conveyed in order to be taken and construed as running with the land without limit as to time and upon the continued observance of which and each of which, the continued existence of the estate hereby granted shall depend, and the Grantee City hereby binds itself and its successors, assigns, grantees and lessees forever to these covenants and conditions, which covenants and conditions are as follows: " First: The Grantee City shall devote the property hereby conveyed to Park and Openspace use only as defined in the approved Urban Renewal Plan, as amended. Second: Grantee City agrees for itself and any successor in interest not to discriminate upon the basis of race, sex, color, religion or national origin in the sale, lease, or rental or in the use or occupancy of the properties hereby conveyed or any part thereof or of any improvements erected or to be erected thereon or any part thereof. Grantor Agency does hereby bind itself, its successors and assigns to WARRANT AND FOREVER DEFEND, all and singular the said premises under the said Grantee City, its successors and assigns against every person lawfully claiming or to claim the same or any part thereof. .
