AN ORDINANCE ADOPTING THE SOUTHERN STANDARD BUILDING
CODE, 1973 EDITION WITH 1974 REVISION, AS A BUILDING
CODE OF THE CITY OF SCHERTZ, TEXAS, AS HEREIN MODI-
FIED; PROVIDING A PENALTY FOR VIOLATION OF THIS ORD-
INANCE; REPEALING ALL PRESENT ORDINANCES IN DIRECT
CONFLICT WITH THIS ORDINANCE; AND CONTAINING OTHER
MATTERS PERTINENT TO THE SUBJECT.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS, THAT:
SECTION 1. This ordinance is and shall be known and may be
cited as the Building Code of the City of Schertz.
SECTION 2. Southern Standard Building Code-adopted; penalties.
(a) The Southern Standard Building Code, 1973 Euition,
as heretofore amended, revised and corrected, published by the
Southern Building Congress, two (2) copies of which are now and
have been for the next preceeding thirty (30) days on file with
the City Secretary, except for penalties, contained therein, is
hereby adopted and incorporated by reference as the Building
Code of the City subject to and including by reference such
amendments, corrections and additions as shall appear herein.
(b) Any violation of this ordinance or the provisions
of the Southern Standard Building Code, 1973 Edition, as herein
modified, shall be deemed a misdemeanor and shall be punished
by a fine not exceeding $200.00. Each day any violation of
this ordinance or of this building code shall continue shall
constitute a separate offense.
SECTION 3. Amendments to the Provisions of the Southern Stan-
dard Building Code.
Ihe building code of the said City of Schertz shall
herewith be amended to read as follows:
(a) Section 10?4. The schedule of permit fees of the
building code adopted and incorporated herein is hereby amended
to read as follows:
"On all buildings, structures or alterations requiring
a building permit, as set forth in Section 105, fee
shall be paid as required at the time of filing
application, in accordance with the following schedule:
(1) PERMIT FEES
a. Where the valuation does not exceed $500.00
no fee shall be required, unless an inspection is nec-
essary, in which case there shall be a $5.00 fee.

b. For a valuation
including $100,000

(2) MOVING OF BUILDING OR STRUCTURES
For the moving of any building or structure, the
fee shall be $50.00
(3) DEMOLITION OF BUILDING OR STRUCTURES
For the demolition of any building or structure,
the fee shall be $25.00
(4) Appendix "M" (e) of the 1974 Revision of the 1973
Edition of the Southern Standard Building Code is
deleted as part OI the official Building Code of the
City of Schertz, Texas.
(b) Control of trash, rubbish, and building materials:
(1) On lots or in sub-divisions where either new homes
or building improvements are being undertaken, adequate controls
and procedures shall be instituted to insure that trash, rubbish
and building materials are properly stored and/or disposed of in
a manner consistent with adequate health, safety, and sanitation
practices.
(2) The minimum requirements to be performed by holders
of permits in regard to said storage and waste materials are
as follows:
a. The builder or contractor or owner shall cause a
metal recepticle to be erected on the lots, or
premises where building, construction, or improve-
ments are undertaken. The recepticle shall be
constructed in such a manner as to provide adequate
storage or disposal of accumulated trash, rubbish,
building materials, or waste products resulting
from the work being performed.
b. The builder or contractor or owner holding the
building permit shall be responsible for insuring
that the provisions of this subsection are complied
with.
SECTION 4. This ordinance and the Southern Standard Building
Code, 1973 Edition, with 1974 Revision, adopted herein by
reference are cumulative of any other ordinance on this sub-
ject dealt with herein and does not repeal any present ordin-
ance unless this ordinance and said Southern Standard Building
Code, 1973 Edition, are in direct conflict therewith, in which
connection this ordinance and the Southern Standard Building
Code, 1973 Edition, shall govern.
SECTION 5. Nothing in this ordinance or the Southern Standard
Building Code, 1973 Edition, shall be held or deemed to amend,
alter, abolish or in any manner change the fire limits as here-
tofore established by the ordinances of this City.
