On this, the 5th day of November, 1974, at 7:00 o'clock
P.M., the City Council of the City of Schertz, Texas, convened
at a regular meeting at the regular meeting place in the Munici-
pal Building in the City of Schertz, Texas, pursuant to due call
and notice to all of the members of said City Council, which
meeting was at all times open to the public, and at which meeting
the following members were present, to-wit:

There being a quorum present, the meeting was called to
order by the Mayor, and, among other proceedings had were the
following:
The Mayor introduced the hereinafter set forth ordinance,
which has been read and considered at the regular meeting of the
City Council on the 17th day of September, 1974. It was deter-
mined that the City Secretary had caused a short synopsis of said
proposed ordinance to be published in the official City newspaper
after its consideration at the regular meeting of the City Council
of September 17, 1974 and prior to this meeting.

ORDINANCE NO. 7/1- 6-~
AN ORDINANCE
CREATING AND ESTABLISHING A PERSONNEL BOARD OF
THE CITY OF SCHERTZ, TEXAS; PROVIDING FOR THE
APPO INTMENT OF THE MEMBERS OF SAID BOARD AND
LENGTH OF TERM OF THE MEMBERS; PROVIDING FOR
THE SELECTION OF A CHAIRPERSON; AND PRESCRIBING
THE POWERS AND DUTIES OF SAID BOARD.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS:
SECTION I. ESTABLISHMENT OF A PERSONNEL BOARD
There is hereby created and established within the
City of Schertz, Texas, a Personnel Board, consisting of three
(3) members Unanimously appointed by the City Council upon the
recommendation of the City Manager. All candidates names that
come before the City Manager will be presented to the Council.
The City Manager shall also be a member ex officio of said
Board but shall not have a vote. His function will be that of
an advisor only and he shall attend all meetings.
SECTION II. MEETINGS.
Meetings of the Personnel Board will not be on a regu-
larly scheduled basis but instead said Board shall meet: (1)
when the Board deems necessary, or (2) when a meeting is re-
quested by the City Council or the City Manager. All meetings
shall be open to the public and notice thereof shall be given
in compliance with the provisions of Article 6252-17, Texas
Revised Civil Statutes.
SECTION III. TERMS OF OFFICE
The members of the Board, shall be appointed for a term
of three (3) years but shall serve at the pleasure of the City
Council and may be removed with or without cause by majority
vote of the Council. Appointments shall be overlapped so as
to create an opening on the Board every year.
SECTION IV. CHAIRPERSON OF THE BOARD
The Board shall elect one of its members as Chairperson,
serving such term as may be decided by the Board.
SECTION V. POWERS AND DUTIES
The Board's function shall be an advisory power only,
reporting to the City Council through the City Manager. The
Board's duties shall be:
A. To make any investigations which the Board
may consider desirable concerning the ad-
ministration of personnel in the Government;
B. To approve personnel rules, such rules includ-
ing provisions governing appointments, promotions,
transfers, separations, appeals, employee evalu-
ations and development, and other personnel matters;

C. To hear appeals, receive evidence and determine
facts, and affirm, modify or revise the admin-
istrative action appealed from and recommend
the proper action to be taken.
D. To make recommendations to the City Council
concerning employment benefits such as sick
and vacation leave, hours of work, holidays,
retirement, etc.;
E. To make recommendations to the City Council
on the establishment and maintenance of a pay
plan and wage and position scale;
F. To study any other personnel matters as
deemed necessary by the City Councilor City
Manager.
The Board shall make a recommendation to the City Council
no more than fifteen (15) days after a complaint or review of a
personnel case is presented before the Board. An extension may
be granted by the City Council if the Board feels it has not had
enough time or information on which to base its recommendation.
Requests for extension on time shall be in the form of a letter
from the Board as a whole to the City Council.
