CERTIFICATE FOR ORDINANCE THE STATE OF TEXAS COUNTY OF GUADALUPE CITY OF SCHERTZ x X X We, the undersigned Mayor and City Secretary of the City of Schertz, Texas, DO HEREBY CERTIFY as follows: 1. On this, the 19th day of February, 1974, at 7:30 o'clock P.M., the City Council of the City of Schertz, Texas, convened for a regular meeting in the City Hall within said City, which meeting was at all times open to the public, and the roll was called of the duly constituted officers and members of said City Council, namely: ROBERT C. BUEKER MRS. NELL G. FUNK ROBERT E. SCHWARTZ HUGH G. SANDIFER MRS. BOBBIE L. KOCH TOM KOOLE MAYOR ALDERWOMAN ALDERMAN ALDERMAN ALDERWOMAN ALDERMAN AND MRS. JUNE G. KRAUSE DENNY ARNOLD CITY SECRETARY CITY MANAGER and all of said persons were present with the exception of the following: lj/tJlJ/F , thus constituting a quorum. Whereupon, among other business, the fol- lowing was transacted at said meeting: A written ordinance CALLING AN ELECTION ON THE PROPOSED HOME RULE CHARTER OF SAID CITY was introduced for the consideration of the Council and read in full. It was then duly moved and seconded that said ordinance be adopted; and, after due discussion, said motion, carrying with it the adoption of said ordinance, prevailed and carried by the following vote: AYES: All members of said City Council shown present above voted !'AYE" NOES: None. 2. That a true, full and correct copy of the aforesaid ordinance adopted at the meeting described in the above and fore- going paragraph is attached to and follows this certificate, that said ordinance has been duly recorded in said Council's minutes of said meeting; that the above and foregoing paragraph is a true, full and correct excerpt from said Council's minutes of said meeting pertaining to the adoption of said ordinance; that the persons named in the above and foregoing paragraph are the duly chosen, qualified and acting officers and members of said City Council as indicated therein; that each of the officers and members of said City Council was duly and sufficiently notified, officially and personally, in advance, of the time, place and purpose of said meeting and that said ordinance would be considered for adoption at said meeting, that each of said officers and members consented, in advance, to the holding of said meeting for such purpose, that said meeting was open to the public as required by law, and that public notice of the time, place and purpose of said meeting was given as required by law. AN ORDINANCE 711 -E -/0 BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, CALLING AND PROVIDING FOR THE HOLDING OF AN ELECTION ON APRIL 6, 1974, FOR THE PUR- POSE OF SUBMITTING TO THE RESIDENT QUALIFIED VOTERS OF THE CITY OF SCHERTZ A PROPOSITION CONCERNING AND RELATING TO THE ADOPTION OR REJECTION OF THE PROPOSED HOME RULE CHARTER FOR SAID CITY. **************************************************************** BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: I That an election be held in and throughout the City of Schertz, Texas, for the purpose of submitting to the resident qualified voters of said City the following proposition, to-wit: PROPOSITION "SHALL THE PROPOSED HOME RULE CHARTER FOR THE CITY OF SCHERTZ, TEXAS, BE ADOPTED?" II That for the purpose of holding said election, the entire City of Schertz shall constitute one (1) election precinct, and the Fire Station at 604 Live Oak Road, Schertz, Texas, is hereby designated as the polling place for holding said election. The polls shall remain open on the day of the election from 7:00 A.M. to 7:00 P.M. III The following persons are hereby designated and appointed election officers for the holding of said election: .. PRESIDING JUDGE (lj~i~, c JJ~,- (J 0// tJ/vvl./7M.Pjt?f / the Alternate Presiding Judge above named, in the ALTERNATE PRESIDING JUDGE That absence of the Presiding Judge, shall perform the duties of the Presiding Judge in said election. The Presiding Judge shall ap- point three (3) qualified voters who are residents of the City of Schertz, Texas, to serve as Clerks in said election, the appoint- ment of such clerks to include the Alternate Presiding Judge, who if present shall be appointed and counted as one of the election clerks. IV That absentee voting in said election shall be conducted at the City Hall of said City in Schertz, Texas, and the City Sec- retary is hereby charged with the duty of conducting absentee voting in said election as required by law. V That it is hereby determined that paper ballots shall be used in conducting said election, and that said ballots shall be prepared in conformity with the Election Code of Texas, as amended, and in such manner that the voters may vote either "YES" or "NO" on the proposition, which proposition shall be printed on the ballot in the same form as contained in Paragraph I hereof. VI That notice of said election shall be given by posting copies of a notice containing a substantial copy of this ordinance at the City Hall and at the aforesaid polling place at least twenty (20) days before the election, and by publishing said No- tice of Election at least one time not more than twenty-five (25) days nor less than ten (10) days prior to said election in a news- paper published in the City of Schertz. A copy of said Notice of Election shall be filed with the County Clerk of Guadalupe County, and another copy of said Notice shall be posted in the County Clerk's office at least twenty (20) days prior to said election. The City Secretary shall mail a copy of the proposed Charter to each qualified voter in said City as the same appear from the Tax Collector's rolls at least thirty (30) days prior to said election.
