02-12-2013 MinutesMINUTES REGULAR MEETING February 12, 2013 A Regular Meeting was held by the Schertz City Council of the City of Schertz, Texas, on February 12, 2013, at 4:00 p.m., in the Hal Baldwin Municipal Complex Council Chambers, 1400 Schertz Parkway, Building #4, Schertz, Texas. The following members present to-wit: Mayor Michael R. Carpentex ~ Mayor Pro-Tem George Antuna Councilmember Jim Fowler Councilmember David Scagliola Councilmember Cedric Edwards Staff Present: Executive Director David Harris City Attorney Michael Spain City Secretary Brenda Deiuzis City Manager John C. Kesel Executive Director Brian James Chief of Staff Bob Cantu CALL TO ORDER: Mayor Carpenter called the Regular Meeting to order at 4:00 p.m. INVOCATION AND PLEDGES OF ALLEGIANCE TO THE FLAGS OF THE TJNITED STATES AND THE STATE OF TEXAS. Councilmember Scagliola gave the invocation followed by the Pledges of Allegiance to the Flags of the United States and the State of Texas. Mayor Carpenter stated that while the City Attorney is briefmg the candidates on a few items, he would like to take up the consent agenda items. Consent Agenda Items The Consent Agenda is considered to be self-explanatory and will be enacted by the Council with one motion. There will be no separate discussion of these items-unless they are removed from the Consent Agenda upon the request by the Mayor or a Councilmember. _~ 2. Minutes -Consideration andlor action regarding the approval of the minutes of the Regular Meeting of February S, 2013. (J. Kessel/B. Dennis) 3.'' Resolution No. 13-R-11 -Consideration andlor action approving a Resolution authorizing the pursuit of a "Power Up" grant from the Guadalupe Valley Electric Cooperative, Inc. to fund the completion of Phase I of the Veterans Memorial Plaza in Schertz, Texas and other matters in connection therewith. Douglas) The following was read into. record: 2-12-2013 Mizxutes RESOLUTION NO. 13-R-11 A RESOLUTION SY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS AUTHORIZING THE PURSUIT OF A "POWER UP" GRANT FROM THE GUADALUPE VALLEY ELECTRIC COOPERATIVE, INC. TO FUND THE COMPLETION OF PHASE I OF THE VETERANS MEMORIAL PLAZA IN SCHERTZ, TEXAS AND OTHER MATTERS IN CONNECTION THEREWITH Mayor Carpenter recognized Councilmember Scagliola who moved, seconded by Mayor Pro- Tem Edwards to approve the consent agenda items 2 and 3. The vote was unanimous with Mayor Pro-Tem Edwards, Councilmembers Fowler, Scagtiola, and Antuna voting yes and no one voting no. Motion carried. Mayor Carpenter stated that before Council gets started with the 13 interviews, if the Council takes between five {5) to seven {7) minutes each, it would keep us to about two {2) hours. He stated that if it is amendable to Council, this should take them to about 6:00 p.m., at which time they would then suspend the interviews, proceed to the Hearing of Residents portion of the agenda, and then move on to the rest of the agenda including time this evening for Executive Session. Members of Council concurred. 1. Consideration, discussion and/or action regarding filling the Vacant Place 5 Council Position - Candidate Interviews - {Mayor and Council) - Mayor and Council conducted interviews far the following candidates; • Mr. Earl BaIlou, Jr. • Mr. Robert Gibson • Mr. Sydney Verinder • Mr. Guy Scott Mr. Michael Dahle • Mr. Richard Dziewit • Mr. Bertram "Bert" Crawford, Jr. • Mrs. Yolanda Suarez • Mr. Frank McElroy • Mrs. Shelly Sposari • Mr. David Britton Mayor Pro-Tem Edwards left the meeting at 6:25 p.m. • Mr. Timothy "Jake" Jacobs • Mrs. Bridgett Patterson f~ Mayor Carpenter and Council thanked all the candidates for their time and coming out this evening to interview with them. Mayor Carpenter stated that for the first in a long time, the Council has interviewed a lot people who are willing to serve on the City Council. He stated there were a number of years where the City cancelled elections because either everyone was perfectly happy with what the 2-12-2013 Minutes Cauncil was doing or there was a lack of interest. To same degree, he was concerned what would happen if those of us who were serving now wouldn't be able to serve. Would there be individuals out there that would step up and be capable of serving on the Council and taking the City forward? Mayor Carpenter said he is convinced that should something happen to all the members on the dais today, there is na doubt that individuals would step forward from within this City` and make the City move forward. It is a very comfortable feeling to know that we could be replaced and the City would go on, Truly that is the case. There are a lot of talented individuals. Mayor Carpenter further commented thanking everyone here this evening that submitted their application and volunteered to serve. It's exciting and comforting to know there are. folks out there that could take over this City Government and this City to its next chapter without any difficulty or hesitation. Mayor Carpenter stated that he doesn't know what the Council will do, whether we will go into Executive Session later and have a discussion and come back into Regular Session and make a selection? We may do that today. We may take a little time. We may look at a group of finalists and conduct fiirther interviews, This is uncharted territory; we have left all these possibilities open so that we can be a flexible as possible to find the right candidate. Kessel) None provider Mayor Pro-Tem Edwards returned to the meeting at 7;l Q p.m. Presentations Schertz Historical Preservation Committee Annual Report {B. James/D. Weirtz) Mayor Carpenter recognized Committee Chair Dean Weirtz who provided the Schertz Historical Preservation Committees Annual report answering questions from Council. Mayor and Council thanked Mr. Weirtz and the Committee for their continued work. Hearing of Residents 2-12-2013 Minutes This time is set aside far any person who wishes to address the City Council. Each person should fill out the speaker's register prior to the meeting. Presentations should be limited to no mare than 3 minutes. All remarks shall be addressed to the Council as a body, and not to any individual member thereof. Any person making personal, impertinent, ar slanderous remarks while addressing the Council may be requested to leave the meeting. Discussion by the Council of any item not on the agenda shall be limited to statements of specifrc factual information given in response to any inquiry, a recitation of existing policy in response to an inquiry, andlor a proposal to place the item on a future agenda, The presiding off cer, during the Hearing of Residents portion of the agenda, will call on those persons who have signed up to speak in the order they have registered. Mayor Carpenter recognized the following people who spoke: Mr. Govan Dusbabek, Boy Scout with Troop 462, spoke regarding working on his Citizenship in the Community Merit Badge. Mrs. Clare Layton, 12231 Lost Meadows Drive, who stated she made a request through the City's Website 311 portal. She has not received a response. She stated this was regarding a recent call to 911. The confusion still exists on the location of Crescent Bend Nature Park and which emergency services should respond. Roll Call Vote Confirmation Mayor Carpenter recognized City Secretary Brenda Dennis who recapped the votes for agenda items 2 and 3. Executive Session Mayor Carpenter recessed the regular meeting into executive session at 7:30 p.m. Called under: Section 551.071 Texas Government Code Deliberation regarding litigation, pending or contemplated litigation; Section 551.072 Texas Government Code -Deliberation regarding the purchase, exchange, sale, lease, or value of real property, or real estate; Section 551.074 Texas Government Code - Deliberation regarding personnel matters, policies, duties, employment, and evaluation of certain public officials and employees; including possible appointment to fill vacancy in Councilmember Place 5 position. Reconvene into Resular Session 2-12-2013 Minutes Mayor Carpenter reconvened into regular session at 8:37p.rr~ 4. Take any action deemed necessary as a result of the Executive Session. Mayor Carpenter stated Council's goal is to make an appointment at the next meeting on February 19, 2013, providing that there is a unanimous vote. He stated that next week Councilmember Antuna will not be in attendance. If there is not a unanimous vote, the Council would take up the item again at the following meeting. Mayor and Council asked all of the candidates not to lobby any individual Councilmember, and if feasible not to contact the individual members of Council about the appointment. Mayor Carpenter continued stating once Council has anode an appointment, he would encourage those not appointed to pursue the possibility of serving on one of the City's boards, commissions, or committees. Mayor pro-Tem Edwards asked for an update on the flooding situation as it relates to those areas that flooded in 1998, particularly the. downtown area. Staff will provide an update within the next few weeks at a future Council meeting. 8. Announcements by Mayor and Councilmembers • City and community events attended and to be attended • City Council Committee and Liaison Assignments • Continuing education events attended and to be attended • Recognition of actions by City employees • Recognition of actions by community volunteers • Upcoming City Council agenda items Mayor Pro-Tem Edwards apologized for having to leave earlier this evening, stating that it was his son's last basketball game, as he is a senior this year at Clemens. 2-12-2013 Minutes Mayor Carpenter recognized Councilmember Scagliala who stated on Wednesday, February 6, 2013, he attended the Merritt Lakeside Senior Village ribbon cutting ceremony.
