04-02-2013 MinutesMINUTES REGULAR MEETING April 2, 2013 A Regular Meeting was held by the Schertz City Council of the City of Schertz, Texas, on April 2, 2013, at 6 :00 p.m., in the Hal. Baldwin Municipal Complex Council Chambers, 1400 Schertz Parkway, Building #4, Schertz, Texas. The following members present to -wit: Mayor Michael R. Carpenter Councilmember David Scagliola Staff Present: Executive Director John Bierschwale Executive Director Brian James City Attorney Michael Spain Mayor Pro -Tem Cedric Edwards, Sr. Councilmember George Antuna; Jr. City Manager John C. Kessel Executive Director David Harris Chief of Staff Bob Cantu City Secretary Brenda Dennis Councilmembers Jim Fowler and Sydney Yerinder were absent. CALL TO ORDER: Mayor Carpenter called the Regular Meeting to order at 6:02 p.m. INVOCATION AND PLEDGES OF ALLEGIANCE TO THE FLAGS OF THE UNITED STATES AND THE STATE OF TEXAS. Pastor Linda Montgomery with Schertz United Methodist Church gave the invocation followed by the Pledges of Allegiance to the Flags of the United States and the State.of Texas. Recognition • Special presentation and unveiling of Mayor Hal Baldwin's portrait. (Mayor /Council/M. Spence) Mayor Carpenter recognized Susan and Brian Beek who came forward unveiling the portrait of Mayor -Hal Baldwin. City Events and Announcements • Announcements of upcoming City Events (D. Kessel) City Manager John Kessel recognized and thanked the Parks Department and Mary Spence for the arrangements regarding the Animal Adoption Center groundbreaking. Mr. Kessel stated that recently they have held meetings with citizens of the Savannah Square Subdivision regarding the prohibiting of operating vehicles in drainage easements. He stated that in the next few weeks he would be scheduling a workshop discussion on this item. Proclamations + Proclamation "Child Abuse Prevention Month" — Guadalupe County Children's Advocacy Center. (Mayor /Christy Williams) ` Mayor Carpenter read and presented the Proclamation to Ms. Christy Williams with the Guadalupe County Children's Advocacy Center. • Proclamation "National Sexual Assault Awareness Month" — Guadalupe Valley Violence Shelter, Inc. (Mayor /Jennifer Fernandez) Mayor Carpenter. read and presented the Proclamation to Ms. Jennifer Fernandez with the Guadalupe Valley Violence Shelter, Inc. Presentation • Presentation and/discussion regarding the Annual Tax Increment Reinvestment Zone Number 2 (TIRZ) — (Sedona/Crossvine) (B. James/M. Spain) Mayor Carpenter recognized City Attorney Michael Spain who stated Section 311.016 of the Texas Tax Code requires municipalities with Tax Increment Reinvestment Zones (TIRZ) to submit an annual repoil to the taxing entity. This report is then sent to the State Comptroller. He stated the report must contain the following information: (1) the amount and source of revenue in the tax increment fiord established for the zone ($144,513.63 balance for FY 2012; 04 -02 -2013 Minutes (2) the amount and purpose of expenditures from the fund ($0 for FY 2012); (3) the amount of principal and interest due on outstanding bonded indebtedness (None — no bonds issued); (4) the tax increment base and current captured appraised value retained by the zone ($450,879 City tax increment base and $24,946,759 captured appraised value for FY 2012); and (5) the captured appraised value shared by the municipality (same as (4) above. No action taken. Hearing of Residents This time is. set aside for any person who wishes to address the City Council. Each person should fill out the speaker's register prior to the meeting. Presentations should be limited to no more than 3 minutes. All remarks shall be addressed to the Council as a body, and not to any individual member thereof. Any person making personal, impertinent, or slanderous remarks while addressing the Council may be requested to leave the meeting. Discussion by the Council of any item not on the agenda shall be limited to statements of specific factual information given in response to any inquiry, a recitation of existing policy in response to an inquiry, andlor a proposal to place the item on a future agenda. The presiding officer, during the Hearing of Residents portion of the agenda, will call on those persons who have signed up to speak in the order they have registered. River Street, Seguin, who spoke regarding the Advocacy Center & Child abuse upcoming fundraisers: • Saturday, April 6, 2013, Steak Dinner, KC Hall in Seguin at 6:00 p.m. • Thursday, May 9, 2013, Designer Purse Bingo — Schertz Civic Center 7:00 p.m. to 9:00 P.M. • Mrs. Maggie Titterington, Schertz Chamber President, who provided photos of the recent Chamber Events. • Mrs. Linda Jarrell, 4909 Crestwood Drive, who addressed Council with concerns of waterline and street repairs needed in the Northcliffe Subdivision. Consent Agenda Items The Consent Agenda is considered to be self- explanatory and will be enacted by the Council with one motion. There will be no separate discussion of these items unless they are removed from the Consent Agenda upon the request by the Mayor or a Councilmember. 04 -02 -2013 Minutes 1, Minutes - Consideration and/or action regarding the approval of the minutes of the Regular Meeting of March 26, 2013. Resolution No. 13-R-26 — Consideration and/or action approving a Resolution authorizing a Small Government Enterprise License Agreement (SGELA) with Environmental Systems Research Institute, Inc., (ESRI) and other matters in connection therewith. McFalls) The following was read into record: RESOLUTION NO. 13 -R -26 A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS AUTHORIZING A SMALL GOVERNMENT ENTERPRISE LICENSE AGREEMENT (SGELA) WITH ENVIRONMENTAL SYSTEMS RESEARCH INSTITUTE, INC. (ESRI), AND OTHER MATTERS IN CONNECTION THEREWITH Mayor Carpenter recognized Mayor Pro -Tern Edwards who moved, seconded by Councilmember Seagliola to approve the consent agenda items 1, and 2. The vote was unanimous with Mayor Pro- Tem Edwards, Councilmemhers Seagliola, and Antuna voting yes, and no one voting no. Councilmemhers Fowler and Verinder were ahsent. Mayor Carpenter stated that Saturday, April 6, 2013, at 9:00 a.m. Buffalo Valley Youth Association (BVYA) will host their Spring Season Opening Ceremony at the Schertz Ballpark. Mayor Carpenter commented on the recent work with Animal Control, specifically creating a "No Kill" facility. He stated he is looking forward to the new Animal Adoption Center being built.
