13-R-47 - Sweetheart Advisory By-LawsRESOLUTION NO. 13-R-47 A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS AUTHORIZING THE REVISED BY-LAWS OF THE SCHERTZ SWEETHEART ADVISORY GROUP, AND OTHER MATTERS IN CONNECTION THEREWITH WHEREAS, the City staff of the City of Schertz (the "City"} has recommended that the City approve the revised By-Laws of the Schertz Sweetheart Advisory Group; and WHEREAS, the City Council has determined that it is in the best interest of the City to approve the revised By-Laws of the Schei•tz Sweetheart Advisory Group. THAT: BE 1T RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS Sectian 1. The City Council hereby authorizes the revised By-Laws of the Schertz Sweetheart Advisory Group. Section 2. The recitals contained in the preamble hereof are hereby found to be true, and such recitals are hereby made a part of this Resolution far all puzposes and are adopted as a part of the judgment and findings of the City Council. Sectian 3. All resolutions, or parts thereof, which are in conflict or inconsistent with any provision of this Resolution are hereby repealed to the extent of such conflict, and the provisions of this Resolution shall be and remain controlling as to the matters resolved herei~~. Section 4. This Resolution shall be construed and enforced in accordance with the laws of the State of Texas and the United States of America. Section 5. If any provision of this Resolution or the application thereof to any person or circumstance shall be held to be invalid, the z•emainder of this Resolution and the application of such provision to other persons and circumstances shall nevertheless be valid, and the City Council hereby declares that this Resolution would have been enacted without such invalid provision. Sectian 6. It is officially found, determined, and declared that the meeting at which this Resolution is adopted was open to the public and public notice of the time, place, and subject matter of the public business to be considered at such meeting, including this Resolution, was given, all as required by Chapter 551, Texas Government Code, as amended. Section 7. This Resolution shall be in force and effect from and after its final passage, and it is sa resolved. ,~ _ ,,. - _.~ ~ ~ i ~~ ~_ `~' ~ ~~' BY-LAWS OF THE CITY OF SCHERTZ SWEETHEART ADVISORY GROUP WHEREAS, the City of Scller•tz, Taws (the "City") and Schertz City Co€Incil ("Councll") recognize the City of Schertz Sweetheart Advisory Group of the City as a valuable segment ofthe City; WHEREAS, the ideas and perspectives of the City of Schertz Sweetheart Advisory Group will provide uniq€xe insight into fixture leaders faI• our cornrnunity; and WHEREAS, the Council created an Advisory Group to provide leadership to the City of Schertz Sweetheart Court and to make recolnmendations to City Managerlleut and City Council regarding activities ofthe Co€u•t; NOW, THEREFORE, the City of Schertz Sweetheart Advisory Group heI•eby adopts the followingBy-1_,aws: ARTICLE I: Purpose The purpose of the City of Schertz Sweetheart Advisory Group is to: I. Plan and oversee all events and activities ofthe City of Schertz S~veetheal-t Court; 2. Provide a proposed detailed budget for the Council to review foI• the events to be held or attended in the €xpcoming hscal year. ARTICLE II: Membership Section 1: Membership Requirements: The City of Schertz Sweetheal-k Advisory Group will act as an advisory group to the City Manager and City Council. It shall consist of the following members ~viro at the time of tlreir• appointment, and thereafter during their teI•In shall: 1. Desire to contribute to accolnplishrnents of the goals and objectives of the City of Schertz Sweethea€-t Advisory Group; and 2. Arc available and agree to participate in the City of Schel•tz Sweetheart Court events. Section 2: Terms The initial appointees shall serve a 1-year appointment. Advisory Group members' term shall run June 1 through May 31. Members of the City of Schertz Sweetheart Advisory Group may be removed at any tilne, witll ar without cause, by the City Co€urcil with a simple majority vote. All vacancies shall be filled by a nomination and recommendation from the reanaining trlenlbers of the City of Schertz Sweetheart Advisory Group to the City Council for final approval. Section 3: Duties City of Schertz Sweetheart Cat~rt Advisory Committee By-Laws 2©r3 At least rivo (2) City of Schertz Sweetheart Advisory Group members shall oversee all events and activities attended by the Schertz Sweetheart Court. At ]east rivo (2) Citiy of Schertz Sweetheart Advisory Group members shall oversee the ScholarshiplComrnunity Service (3) process for the Sclrer-tz Sweetheart Co1rr•t: At least two (2j City ernployees One Staff member and Clair shall oversee the budget for the Sclrer•tz Sweetheart Cou1•t. ARTICLE III: IVleetings Meetings/Workshop Sessions Regular meetings/workshop sessions will be held once a quarter as called by the ChairlStaff Support. Special meetings may be held at the request of two (2) members of the Advisory Gror.rp. Notification will be not less tllatr seventy-two (72) hours to eaclf meruber of the City of Schertz Sweetheart Advisory Group. Since the Advisory Group's role is purely advisory in nature, with its actions regarding the commitment or utilization of City resources, money, or property being subject in all events to approval by the City Coerncil, the Advisory Group's meetings shall not be subject to the Texas Open Meetings Act. ARTICLE 1V: Amendments These By-Laws may be altered, arnended, or repealed, and new By-Laws may 6e adopted on the recomrnerrdation of tl~e City of Schertz Sweetheart Advisory Group with prior writ#en or ernailed notice to the members, and provided that such alterations, amendments or repeals must be approved by the Schertz City Council.
