Sec.21.11.3Administration A.General TheCityManageror his/herdesigneeisherebyauthorizedand directedtoenforce theprovisionsofthisArticleandotherlaws,ordinances,codesandregulations applicablethereto.TheCityManagerorhis/herdesigneeshallhavetheauthority torenderinterpretations ofthisArticleandotherlaws,ordinances,codesand regulationsapplicablethereto,andtoadoptpoliciesandproceduresinorderto clarifytheapplicationofitsprovisions.Suchinterpretations, policiesand proceduresshallbeincompliance withtheintentandpurposeofthisArticleand shallnothavetheeffectofwaivingrequirementsspecificallyprovidedforherein. 11-1 50307818.3 Article11?SignsandAdvertisingDevices SchertzUnifiedDevelopmentCode B.Applications The CityManagerorhis/herdesigneeshallreceiveapplications,reviewplans and documentation andissuepermitsfortheerection,installation,enlargement, alteration,andrepairofallsignswithintheCityanditsETJ. C.Inspection TheCityManagerorhis/herdesigneeshallmakeallinspectionsnecessaryto ensurecompliancewithallstateandlocalrequirementsgoverningsignage. D.NoticesandOrders TheCityManageror his/herdesigneeshallissueallnecessarycitations,noticesor orderstoensurecompliancewiththisArticle. E.RightofEntry Whereitisnecessarytomakeaninspectiontoenforcetheprovisionsofthis Article,orwheretheCityManagerorhis/herdesignee hasreasonablecauseto believethatthereexistsinastructureoruponapremisesaconditionwhichis contrarytoorinviolationofthisArticle,the CityManagerorhis/her designeeis authorizedtoenterthe premisesatreasonabletimestoinspectorto performthe dutiesimposedbythisArticle,providedthatifsuchpremisesare occupiedthatcredentials bepresentedtotheoccupantandentryrequested.Ifsuch premisesare unoccupied,theCityManagerorhis/herdesigneeshallfirstmake areasonableefforttolocatetheowneror otherpersonhavingchargeorcontrolof thepremisesandrequestentry.Ifentryisrefused,theCityManagerorhis/her designee shall haverecoursetotheremediesprovidedbylawtosecureentry. F.DepartmentRecords TheCityManager orhis/herdesignee shallkeepofficialrecordsofapplications received,permitsissued,feescollected,reportsofinspections, andcitations, noticesandordersissued.Suchrecordsshallberetainedintheofficialrecordsfor theperiodrequiredbytheStateofTexasfortheretentionofpublicrecords. G.Liability TheCityManagerorhis/herdesignee,members oftheBOA,orotherCity employeeschargedwiththeenforcementofthisArticle,whileactingfortheCity ingoodfaithandwithoutmaliceinthedischargeofthedutiesrequiredbythis Articleorotherpertinentlaws,ordinances, codesorregulations shallnotbe renderedliablepersonallyandareherebyrelievedofpersonalliabilityforany damageoccurring accruingtopersonsorpropertyasaresultofanyactorby reasonofanactoromissioninthedischargeofofficialduties.Anysuitinstituted againstan officeroremployeebecauseofanactperformedbythatofficeror employeeinthelawfuldischargeofdutiesandundertheprovisionsofthis Articleshallbe 11-2 50307818.3 Article11?SignsandAdvertisingDevices SchertzUnifiedDevelopmentCode defendedbyalegalrepresentativeoftheCityuntilthefinalterminationofthe proceedings.
