13-R-88 - East Dietz Creek Construction Ford EngineeringRESOLUTION NO. 13-R-SS A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS AUTHORIZING A PROFESSIONAL SERVICES AGREEMENT WITH FORD ENGINEERING, INC., RELATING TO ENGINEERING AND DESIGN FOR THE EAST DIETZ CREEK CONSTRUCTION PROJECT IN THE ARROYO VERDE SUBDIVISION, AND OTHER MATTERS IN CONNECTION THEREWITH WHEREAS, the City staff of the City of Schertz (the "City") has determined that the City requires professional services relating to engineering and design for the Dietz Creek Construction Project in the Arroyo Verde Subdivision; and WHEREAS, City staff has determined that Ford Engineering, Inc. is uniquely qualified to provide such services for the City; and WHEREAS, pursuant to Section 252.022(a}(4), the City is not required to seek bids or proposals with respect to a procurement for personal, professional, ar planning purposes; and WHEREAS, the City Council has determined that it is in the best interest of the City to contract with Ford Engineering, Inc. pursuant to the Engineering Services Agreement attached hereto as Exhibit A (the "Agreement") relating to engineering and design for the Dietz Creek Construction Project in the Arroyo Verde Subdivision far $14,240 with a not to exceed amount of $15,b64. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS THAT: Section 1. The City Council hereby authorizes the City Manager to execute and deliver the Agreement with Ford Engineering, Inc. in substantially the form set forth on Exhibit A. Section 2. The recitals contained in the preamble hereof are hereby found to be true, and such recitals are hereby made a part of this Resolution for all purposes and are adopted as a part of the judgment and findings of the City Council. Section 3. All resolutions, or parts thereof, which are in conflict ar inconsistent with any provision of this Resolution are hereby repealed to the extent of such conflict, and the provisions of this Resolution shall be and remain controlling as to the matters resolved herein. Section 4. This Resolution shall be construed and enforced in accordance with the laws of the State of Texas and the United States of America. Section 5. If any provision of this Resolution or the application thereof to any person or circumstance shall be held to be invalid, the remainder of this Resolution and the application of such provision to other persons and circumstances shall nevertheless be valid, and the City Council hereby declares that this Resolution would have been enacted without such invalid provision. Section 6. It is officially found, determined, and declared that the meeting at which this Resolution is adopted was open to the public and public notice of the time, place, and subject matter of the public business to be considered at such meeting, including this Resolution, was given, all as required by Chapter 551, Texas Government Code, as amended. October 10, 20 i 3 City of Schertz 10 Commercial Place Schertz, Texas 78154 Attn: Mr. Sam Willoughby, Director of Public Works Re: City of Schertz -Dietz Creek -Arroyo Verde Channel Improvements Ford Engineering, Inc, is pleased to provide this proposal far professional engineering services to the City of Schertz for the design of the Dietz Creek -Arroyo Verde Channel Improvements. Our understanding of the scope of work is generally as follows: The City desires to widen the existing Dietz Creek channel, beginning at Arroyo Verde and extending north (upstream) for approximately b00 feet, to a design bottom width of 90 feet in order to mitigate erosion of the existing channel The widened channel will tie to the recent channel excavations of TXDOT and may require a concrete drop structure. The City also wishes to widen the existing Dietz Creek, beginning at Green Valley Road and extending north (upstream) approximately 200 feet, to a design bottom width of approximately ti5 feet. Additionally, the project will include removal of excess deposits of sediments downstream of the .ArTOyo Verde culvert and the Green Valley Road culvert. It is not anticipated that the channel improvements will contain the 1% annual chance flood event within the channel banks, but the overall effect of the channel improvements will not cause a rise in the surface water elevation for the 1% annual chance flood event. Proiect Scope Ford Engineering, Inc. and its design team will provide the engineering services required in the Agreement for Engineering Services between the City of Schertz and Ford Engineering, Inc. and subsequent agreements and per the scope of wark as described below. Design Phase: In order to facilitate the delivery of said project, Ford Engineering, Inc, will provide the topographical survey of the existing and proposed right of way to determine locations of existing utilities, trees, and pertinent topographic features. No additional easements ar right-of--way acquisitions are anticipated to be required for the construction of this project. Ford Engineering will prepare a set of construction plans for the project. Plans will be in conformance with City of Schertz standards of construction. Submittals to the City for review will occur at the 90% design phase for review and approval, and final design. The submittal will include three sets of hard copy plans for review (2 sets of 22"x34" size plans, and 1 set of 1 i"xl 7" size plans} and an engineer's opinion of probable construction cast. Bid Phase: It is understood that there will be no bid phase, and the project construction will be performed by the City of Schertz. Construction Phase: Ford Engineering, Inc. will provide aone-time construction staking to consist of establishing two benchmarks and a single line of stakes with guard stakes showing the stationing, and offset of horizontal PI, PC and PT of the channel alignment. The setting of the stakes will be performed once, and the preservation of such stakes as to position, elevation and marking shall become the responsibility of the contractor selected by the City to perform the work outlined above. Engineering Fee Compensation for these services will be in the amount of $14,240.00 which will cover all costs associated with the scope described above. A LOMB may be required due to construction within the FEMA designated Floodway. The fee above-does not include work involved for the preparation and submittal of the appropriate forms and documents to FEMA for review of a LOMR. Additional services and significant changes will be compensated for as provided by Attachment 1 to the Fourth Amendment to agreement for Engineering Services between the City of Schertz and Ford Engineering, Inc. dated April 30, 2013 {the "Fourth Amendment). Fuither, the services described in this letter shall be subject to the terms of the Agreement for Engineering Services between the City of Schertz and Ford Engineering, Inc. dated February 9, 2010, as amended by the First Amendment to Agreement for Engineering Services dated October 1, 20l 1, the Second Amendment to the Agreement for Engineering Services dated April 1, 2012, the Third Amendment to Agreement for Engineering Services dated October 30, 2012, and the Fourth Atendment.
