13-R-87 A&E Lopez contract- Ribbon CurbsRESOLUTION NO. 13-R-S7 A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS AUTHORIZING A CONTRACT WITH A&E LOPEZ CONS'T'RUCTION, INC. RELATING TO THE CONSTRUCTION OF RIBBON CURBS ON BOTH SIDES OF LAZY OAK DRIVE AND THE SIDEWALK EXTENSION ON CIRCLE OAK DRIVE TO LAZY OAK DRIVE AS WELL AS CONSTRUCTION OF A SIDEWALK IN THE PARK ADJACENT TO LAZY OAK DRIVE AND A SIDEWALK EXTENSION ON WOODLAND OAKS DRIVE AND AUTHORIZING THE BUDGET ESTIMATES FOR THE PROJECTS AND OTHER MATTERS IN CONNECTION THEREWITH WHEREAS, The City staff of the City of Schertz (the "City") has recommended that the City accept the bid proposal from A&E Lopez Construction for the construction of ribbon curbs on both sides of Lazy Oak Drive and the sidewalk extension on Circle Oak Drive to Lazy Oak Drive as well as construction of a sidewalk in the park adjacent to Lazy Oak Drive and a sidewalk extension on Woodland Oaks Drive and approve the project expenditures; and WHEREAS, City staff has received qualifications indicating that A&E Lopez Construction is qualif ed to provide such services for the City; and WHEREAS, this project will be funded from the 2006 Street Bonds; and A&E Construction will complete the ribbons curbs and sidewalks as laid out in the bid specifications. The road reconstruction project for Lazy Oak Drive will be completed by the Public Works Street Department. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS THAT: Section 1. The City Council hereby authorizes the City Manager to execute and deliver, the contract with A&E Lopez Construction to complete the construction of ribbon curbs on both sides of Lazy Oak Drive and the sidewalk extension on Circle Oak Drive to Lazy Oak Drive as well as construction of a sidewalk in the park adjacent to Lazy Oak Drive and a sidewalk extension on Woodland Oaks Drive for an amount of $33,999 with an Alternate Bid 1 of $22,680 for a sidewalk extension on Circle Oak Drive and an Alternate Bid 2 of $4,200 for a sidewalk extension on Woodland Oaks Drive in the amount of $60,897 with an amount not to exceed $b6,967. Section 2. The recitals contained in the preamble hereof are hereby found to be true, and such recitals are hereby made a part of this Resolution for all purposes and are adopted as a part of the judgment and findings of the City Council. Section 3. All resolutions, or parts thereof, which are in conflict or inconsistent with any provision of this Resolution are hereby repealed to the extent of such conflict, and the provisions of this Resolution shall be and remain controlling as to the matters resolved herein. Section 4. This Resolution shall be construed and enforced in accordance with the laws of the State of Texas and the United States of America. Section 5. If any provision of this Resolution or the application thereof to any person or circumstance shall be held to be invalid, the remainder of this Resolution and the application of such provision to other persons and circumstances shall nevertheless be valid, and the City Council hereby declares that this Resolution would have been enacted without such invalid provision. Section 6. It is officially found, determined, and declared that the meeting at which this Resolution is adopted was open to the public and public notice of the time, place, and subject matter of the public business to be considered at such meeting, including this Resolution, was given, all as required by Chapter 551, Texas Government Code, as amended. Section 7. This Resolution shall be in force and effect from and after its final passage, and it is so resolved. PASSED AND ADOPTED, this 15th day of October, 2013. The bids are tabulated and attached, along with supporting information required in the Instruction to Bidders. Review of the bids indicate that A&E Lopez Construction, Inc, is the low bidder with a Base Bid of $33,999.00, and Additive Alternate 1 Bid of $22,680.00, and an Additive Alternate 2 bid of $4,200.00 with no irregularities or minor informalities. The Engineer's Estimate far the Base Bid project construction was $33,907.00, and the average Base Bid was $81,572.10. It is our recommendation that the City award the contract to A&E Lopez Canstructioa, Inc. in the amount of $33,999.00.
