ccwks 03-28-06 MINUTES City Council Workshop Session March 28, 2006 The Schertz City Council convened for a Workshop Session on Tuesday, March 28, 2006 at 7:00 p.m. in the City Council Chamber Workshop, 1400 Schertz Parkway Building #4 Schertz, Texas. The following members were present: Mayor Hal Baldwin presiding, Council Members Carl Douglas, John Trayhan, Reginna Agee, and Michael Carpenter, City Manager Don Taylor, Asst. City Manager John Bierschwale and Judy Tokar City Secretary. Absent: Council Member Tony Wilenchik #1 CALL TO ORDER: Mayor Baldwin called the meeting to order at 7:00 p.m. #2 HEARING OF RESIDENTS: Sharon Pennington, Schertz Chamber of Commerce President announced the Chamber was hosting a "Meet the City Candidates" and public forum on Thursday, April 27, 6:30 p.m. at the Community Center. Robert Brockman, 1000 Elbel Road, asked how many ambulances the City had and for an update on the ambulance that was involved in an accident. #3 CONSENT AGENDA: A. ORDINANCE: Discussion on final reading on an ordinance for Specific Use Pennit to allow a manufactured home on 1.12+ acres ofland situated out of the Jeromino Leal Survey No. 79, Abstract No. 424, Parcel 5C, County Block 5058, Bexar County, Schertz, Texas. The property is generally located near Old Lower Seguin Road and Aranda Lane. The property is zoned Residential/Agriculture (R- A). Applicant: Michael and San Juana Starr. B. ORDINANCE: Discussion on final reading on an ordinance to rezone 19.992+acres from General Business (GB) and Residential District-l (R-1) to Residential District-6 (R-6). The tract is situated out of the T. Herrera No. 68 Survey, Abstract No. 153, Guadalupe County, Schertz, Texas. The property is generally located at the intersection of Live Oak and Maske Road. The property is referred to as Mesa Oaks II. Applicant: Burkett Live Oak, Ltd. C. ORDINANCE: Discussion on final reading on an ordinance to rezone 19.098+ acres from General Business (GB) to Residential-Agriculture District (R- A). The tract is situated out of the E. Gotari Survey No.2, Abstract No.5, Bexar Workshop 3-28-06 149 County, Schertz, Texas. The property is generally located at the southwest comer of Ware Seguin Road and FM 1518. The property is being referred to as Schertz Forest, Unit 2. Applicant: Schertz Forest Joint Venture D. ORDINANCE: Discussion on final reading on an ordinance providing that the Code of Ordinances, City of Schertz, Texas be amended by revising Section 18-76, maximum limits on specific street, Schertz Parkway. E. ORDINANCE: Discussion on final reading on an ordinance providing that the Code of Ordinances, City of Schertz, Texas be amended by revising Section 18-76, maximum limits on specific street, Lower Seguin Road. Mayor Baldwin asked if anyone wanted to discuss the items on the Consent Agenda, there was no discussion. These items would be acted upon at the regular meeting of April 4th. #4 AUDIT: Discussion and action approving imancial audit for FY 2004-2005. Mayor Baldwin introduced Fred Timmons, a partner with Thompson, Williams, Biediger, Kastor and Young. L.C. Mr. Timmons distributed the final financial audit for fiscal year 2004-2005 to the Council. He said there were no changes from his summary presentation at the last meeting. Mr. Timmons said the City was given a clean opinion, this year there is a general fund unreserved balance of $4.8 million and net excess over revenues of $490,239.00. Council Member Agee made a motion, seconded by Council Member Douglas to approve the financial audit for FY 2004-2005. The vote was: A YES: Council Member Douglas, Trayhan, and Agee. NAY: None. ABSTAIN: Carpenter. #5 Discussion on Letter of Engagement for Thompson, Williams, Biediger, Kastor and Young for auditor services. Mr. Taylor concurred with the Letter of Engagement and recommended that auditing services with Thompson, Williams, Biediger, Kastor and Young be extended starting with FY 2006 until FY 2010. The Council agreed and the item will be considered for action at the April 4th meeting. #6 ORDINANCE: Discussion and final reading on an ordinance adopting and enacting a new Code of Ordinances for the City of Schertz, Texas; providing for the repeal of certain ordinances not included therein; providing for a penalty for the violation thereof; providing for other manner of amending such code; and providing when such code and this ordinance shall become effective. Workshop 3-28-06 150 Ms. Tokar said the ordinance was adopting the code of ordinances. The code would be accessible for the public with a link on the City's website, hard bound copies and installed on staffs personal computers. #7 Discussion on resolution supporting the San Antonio River Authority's action to facilitate the creation of the partnership for regional water development and authorizing and directing the City Manager of the City of Schertz to take action in support of and the creation of the partnership on behalf of the City of Schertz Mr. Taylor recommended that the City support the resolution from the San Antonio River Authority for participation in the regional water partnership. The resolution consideration will be on the April 4th agenda for action. #8 Discussion on appointments to fill vacancies on the Library Advisory Board. The two applicants approved by the Library Advisory Board for Council consideration were Laura Wilson and John Correu. The Council agreed upon their recommendation. #9 Items by City Manager Taylor and Staff Mr. John Bierschwale, Asst. City Manager said Congressman Henry Cuellar is assisting the City and engaging the railroad company regarding flooding at the bridge. #10 Items by Council Councilmember Douglas . Asked if Congressman Cuellar political signs should be removed now that the primary election is over. Councilmember Trayhan . Expressed a concern about action items on a workshop agenda when it is advertised as a workshop and not as a regular meeting. Cmmcilmember Agee No Comment. Councilmember Carpenter . Attending BVY A meeting this week . Heard the School District is considering canceling the bond election . Was the strategic planning information from the Council being compiled . Commented on the Steve Simonson Award banquet that it was a nice event . Asked about a follow up on a request to the City Attorney on questions from citizens on tax abatements and had not gotten a response yet. #11 Items by Mayor Workshop 3-28-06 151 . Asked if anyone was interested in attending the Region 7 meeting in Devine. . Commented that the opening day for baseball on Saturday was a good turn out of parents and kids. . Reminded everyone about the bond election committee meeting on Thursday, March 30 at 7:00 p.m. # 12 ADJOURNMENT Mayor Baldwin adjourned the meeting at 7 :34 p.m. , ATTEST: Workshop 3-28-06 152
