Workshop Session
May 9, 2006
The Schertz City Council convened in Workshop Session on Tuesday, May 9, 2006
at 7:00 p.m. in the City Council Chamber Workshop, 1400 Schertz Parkway
Building #4 Schertz, Texas. The following members were present: Mayor Hal
Baldwin presiding, Council Members Carl Douglas, John Trayhan, Reginna Agee,
Tony Wilenchik and Michael Carpenter, City Manager Don Taylor, Asst. City
Manager John Bierschwale and Mary Ybarra, Deputy City Secretary.
#1 CALL TO ORDER:
Mayor Baldwin called the meeting to order at 7:00 p.m.
#2 HEARING OF RESIDENTS:
Ramon Cook, 913 Dimrock stated he would like City officials to take a good look the at
the City's impact fee issue. He was advised the City would have the item on the next
Council workshop.
#3 Discussion on agreement between the City of Schertz and Comal County for
the provisions of certain sanitation services.
City Manager Taylor explained that the agreement is the same as the City has in place
with Guadalupe County and added that the agreement fully complies with State mandated
requirements.
With no further discussion, it was Council consensus to consider the matter at their next
regular meeting.
#4 ORDINANCE: Discussion and first reading of an ordinance authorizing the
abandonment of a road and the conveyance thereof to the abutting
landowners. (Maske Road)
City Manager Taylor asked that the item be withdrawn from the agenda. The item would
be considered at a future meeting.
#5 ORDINANCE: Discussion and first reading of an ordinance authorizing an
exchange of right-of-way.
Leonard Truitt, Interim Planning Director/Building Official explained that it has been
determined that the existing right-of-way (City owned) is not needed for purpose of the
roadway and is to be changed to a new right-of-way adjacent the existing roadway. The
landowner proposes to dedicate new right-of-way as shown on map. The new right-of-

way will be built to City standards at the expense of the landowner. The abandoned road
portion would be conveyed to abutting property owners as permitted by State statute.
This item is still under discussion as mentioned with the above withdraw of agenda item
#4 and will be brought before Council for consideration at a future workshop.
#6 Discussion on contract and resolution with the Schertz Chamber of
Commerce for the 4th of July Celebration.
Assistant City Manager, Bierschwale informed that Sharon Pennington, Chamber
President was unable to attend due to a family emergency. For this reason, he went on to
explain that the contract and resolution are the same as used previous years for the City's
annual 4th of July Jubilee event and is before Council for review.
Council pointed out some typographical errors and made corrections on pages 1 and 2 of
the contract and in review of contract and service agreement with Peter Guel, (park clean
up) Council would like both contract and service agreement to be more specific as to
want areas of the park each (Peter Guel/SCOC) are responsible for. Council was assured
these items would be reviewed and brought back for Council consideration at a future
meeting.
Mayor Baldwin inquired if SCOC had selected the Grand Marshall for the 4th of July
parade. If selection hasn't occurred, he would like to suggest locating young men and
women of the armed forces returning, or on leave from the Iraq, etc. How appropriate to
honor these individuals on this day. The suggestion would be relayed to the SCOC.
#7 Discussion on Ordinance approving licensing agreement.
Michael Spain, City Attorney explained that the agreement covers the copyright police
video of the Interstate 35 shooting incident involving officer Kunz. Certain individuals
and organizations have expressed interest in using the video, and two of the categories
expressing interest are commercial use and police training.
In view of this and the document before Council the following items were discussed:
. Fee charge for the use of video
. Penalty for misuse of video (generating copies, internet, etc.)
. Would the video only be used for Police Training programs and Non-
profit organizations or would others entities be considered.
After discussion Council determined that they would like to hear from Police Chief Steve
Starr regarding what type of fee would be considered if any.

#8 Consider and take action allowing political signs to be placed on City
property on Election Day.
City Manager Taylor explained that in the past during election, candidates have placed
political signage on City property and pointed out that it's in violation of the City sign
ordinance, however, it has been done during this time. Council may consider waiving
placement or choose to amend the sign ordinance.
After a brief discussion, it was Council consensus that the City sign ordinance be
followed and that no political signage would be staked in the ground on City property.
Candidates would be allowed to hold, place signage on chairs, or attached to tables.
#9 Items by City Manager Taylor and Staff
. Infonned that final draft of Strategic Plan Budget Reference handbook is
part of Council packet and asked Council to review. It will be brought
forward at next Council meeting.
#10 Items by Council
General Announcements
Councilmember Douglas
. Mentioned that he had the honor of sitting in on interviews of Teen Court
Scholarship recipients. The seven applicants were outstanding and well deserving,
and selection of three out of seven was a very difficult decision.
Councilmernber Trayhan
. Had no comments.
Councilmernber Agee
. Had no comments.
Mayor Pro-Tern Wilenchik
. Inquired on animal shelter report during the month of April;
. Reported on the upcoming Doggy Dash event and mentioned that letters would be
going out to volunteers very soon.
Councilmember Carpenter
. Mentioned that BVY A meeting had be cancelled.
. Inquired if it were possible to combine Council rules and procedures (Ordinance
of 1994) with Modem Rules of Order.

. Asked that due to the City reaching its 50th Anniversary in 2008, would it be a
good idea to start research on historical data. Historical preservation is incidental
and shouldn't be lost. He asked that this item be placed on a future meeting for
discussion. In regard to historical preservation, Mayor Baldwin stated that Mr.
Tom DeKunder has expressed interest in possible research of historical building
in Schertz.
#11 Items by Mayor
. Inquired if a date has been scheduled for dedication of new ball fields.
. Mentioned that Tom Hann is researching information on original charter
members ofBVYA.
. Informed he is reading a proclamation and meeting with Archbishop Juan Gomez
on Saturday, May 13th at 5:30 pm at the Good Shepherd Catholic Church.
