Ordinance 14-T-05 - Additional Funding P25 RadiosORDINANCE NO. 14-T-05 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS AUTHORIZING ADDITIONAL FUNDING FOR THE P25 RADIO TRANSITION; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT WITH THIS ORDINANCE; AND PROVIDING AN EFFECTIVE DATE WHEREAS, pursuant to Ordinance 13 -13-17, the City of Schertz (the ".0 ") issued tax notes in the amount of $785,000, and adopted a project budget for the radio and communication equipment upgrade; and WHEREAS, the City needs to increase the Project Budget by $33,228.83 for the purchase, programming, and installation of the P25 compliant radios which will be flmded by the Police Forfeiture; and WHEREAS, the City Council of the City has determined that it is in the best interests of the City to adjust the Project Budget as more fully set forth in this Ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: Section 1. The City shall increase the Project Budget and shall transfer $33,228.83 from the Police Forfeiture Fund to the Capital Project Fund 404 to fully implement the State mandated initiative radio compliance. Section 2. The recitals contained in the preamble hereof are hereby found to be hue, and such recitals are hereby made a part of this Ordinance for all purposes and are adopted as a part of the judgment and findings of the Council. Section 3. All ordinances and codes, or pants thereof, which are in conflict or inconsistent with any provision of this Ordinance are hereby repeated to the extent of such conflict, and the provisions of this Ordinance shall be and remain controlling as to the matters resolved herein. Section 4. This Ordinance shall be construed and enforced in accordance with the laws of the State of Texas and the United States of America. Section 5. If any provision of this Ordinance or the application thereof to any person or circumstance shall be held to be invalid, the remainder of this Ordinance and the application of such provision to other persons and circumstances shall nevertheless be valid, and the City hereby declares that this Ordinance would have been enacted without such invalid provision. Section 6. It is officially found, determined, and declared that the meeting at which this Ordinance is adopted was open to the public and public notice of the time, place, and subject matter of the public business to be considered at such meeting, including this Ordinance, was given, all as required by Chapter 551, as amended, Texas Government Code. Section 7. This Ordinance shall be effective upon the date of final adoption hereof and any publication required by law. PASSED ON FIRST READING, the 11th day of February, 2014. Tire Vendor will not subcontract any work related to the installation of Motorola Radios and accessories. The Vendor will begin the Work upon receipt of the Motorola equipment from the City, and expects to complete the installation Work in increments, by department. The Vendor agrees to provide sufficient liability insurance to cover any damages to City vehicles or property resulting from the installation process. For a period of 90 days from date of work completion CTS guarantees the workmanship of services delivered to be of sound integrity. This guarantee is limited to the labor and material of the work performed and in no way extends beyond that service. The material guarantee in no way extends beyond tine Warfanty provided by tine original equipment manufacturer. Vendor acknowledges that Vendor is an independent contractor of the City and is not an employee, agent, official or representative of the City. Vendor shall not represent, either expressly or through implication, that Vendor is an employee, agent, official or representative of the City. Income taxes, self - employment taxes, social security taxes and the like are the sole responsibility of the Vendor. The Vendor confirms that it (a) provides Statutory Workers Compensation insurance coverage for its employees in the amount and that it (b) has General Liability bnsurance coverage in the amount of $1,000,000.00 per occurrence ($ 2.000,000.00 annual aggregate), and (c) $1,000,000.00 Professional Liability Insurance, all as set forth on the certificate of insurance attached as Exhibit B.
