ZC201.4 -007 Hold a public hearing, consider and act upon a request to rezone approximately 3 acres of land in the Verde Enterprise Business Park Planned Unit Development (PUD) Ordinance 07- S-14A to Planned Development District (PDD) The property is specifically Unit 1 of the Verde Enterprise Business Park and generally located on the corner of Interstate Highway 35 and Mid - Cities in the City of Schertz, Guadalupe County, Texas. Ms. Wood presented this item by stating that the applicant is proposing to rezone approximately 3 acres of land in the Verde Enterprise Business Park Planned Unit Development (PUD) Ordinance 07 -S -14A to Planned Development District (PDD). The Verde Enterprise Business Park PUD Ordinance 07 -S -14A was approved by City Council on March 6, 2007 to allow a mix of commercial and industrial uses'. The request is to develop Unit 1 in accordance with the existing PUD Ordinance 07 -S -14A with the exception to the building setback adjacent to property located outside that is commercial or industrial. The subject property is an approximately 3 acre tract of land that is located at the intersection of Mid - Cities and the IH 35 Frontage road. The property is currently undeveloped. The applicant is requesting to rezone the subject property generally to modify the development standards to change the setbacks for buildings from a perimeter lot line on property outside of the PUD from 50' to 20'. Staff recommends approval of the zoning request. Ms. Haussmann, representing the Applicant, gave a presentation by stating the following points: • No residential in the area • Adjacent land use is commercial/industrial • Typical building setback between commercial and commercial/industrial = 0 feet • Proposed building setback of 20 feet significantly more than 0 feet • GCR Tire Center property is not subject to the 50 foot setback requirement • In conclusion, City Staff recommends approval, no opposition, and support from owner and developer of Verde Enterprise Business Park. The subdivision proposed contains two (2) commercial lots and the applicant is seeking approval of a waiver to install an on -site sewage facility (OSSF). GENERAL LOCATION AND SITE DESCRIPTION: The subject property is currently undeveloped and is located on the northwest corner of IH -35 and Hubertus Road intersection. The property is designated Highway Commercial per the City's Future Land Use Plan. PUBLIC IMPROVEMENTS: The applicant is seeking approval of a waiver for all lots within the subdivision to have privately owned On -Site Sewage Facilities (OSSF) which are regulated by Comal County. In accordance with UDC, Article 15 Easements and Utilities, Sec. 21.15.3.13, Wastewater System, all lots, tracts and parcels on which the development is proposed shall be connected to a public wastewater system. Furthermore, the UDC, Article 12 Subdivisions, Sec. 21.12.2.D. requires that all land subdivided or platted shall comply in full with the requirements of this UDC. The improvements to serve the subdivision are reviewed with the civil construction plans at the time of platting to assure that the division or development of land subject to the plat is consistent with all standards of this UDC pertaining to the adequacy of public facilities, that public improvements to serve the subdivision or development have been installed and accepted by the City or that provision for such installation has been made, that all other requirement and conditions have been satisfied or provided for to allow the plat to be recorded. Based on the requirements of the UDC not connecting to a public wastewater system and installation of OSSF requires a waiver to be granted by the Planning and Zoning Commission as prescribed in Sec. 21.12.15 Waivers. The UDC authorizes the Planning and Zoning Commission to grant waivers to the provisions in Article 12 when undue hardship will result from requiring strict compliance. STAFF ANALYSIS AND RECOMMENDATION: The applicant is requesting a waiver to the required connection to a public waste water system to allow privately owned on -site sewage facilities for both lots within the subdivision because of the distance of the nearest sewer line and costs associated with building and connecting to that line. Currently, the closest sewer connection to the subject property is over 8,000 feet away. The Project Engineer estimates that it will cost $344,000 to $440,000 to extend the sewer main in its entirety from its current location. The subject property is located at the top of the sewer shed. The applicant indicated that they would like to construct the required on -site infrastructure on the property to provide for the connection to the sewer main once it is within a reasonable distance to the subject property. Staff recommends approval of the waiver based on the distance to the sewer connection and the subject property being located at the top of the sewer shed. The granting of this waiver will not have a negative impact on existing or proposed municipal infrastructure. Additionally granting of this waiver will not be detrimental to the public health, safety or welfare, or be injurious to other property in the area. COMMISSIONERS CRITERIA FOR CONSIDERATION: In considering final action on waivers to the UDC, the Commission should consider the criteria within the UDC: Section 21.12.15 Waivers A. General The Planning and Zoning Commission may authorize waivers from the provisions of this Article when, in its opinion, undue hardship will result from requiring strict compliance. In granting a waiver, the Planning and Zoning Commission shall prescribe only conditions that it deems necessary or desirable to the public interest. In making their findings, the Planning and Zoning Commission shall take into account the nature of the proposed use of the land involved and existing uses of land in the vicinity, the number of persons who will reside or work in the proposed subdivision, and the probable effect of such waivers upon traffic conditions and upon the public health, safety, convenience, and welfare in the vicinity. Waivers shall not be granted unless the Planning and Zoning Commission finds: 1) That the granting of the waiver will not be detrimental to the public health, safety, or welfare, or injurious to other property in the area; and 2) That the granting of the waiver will not have the effect of preventing the orderly subdivision of other land in the area in accordance with the provisions of this UDC. Such findings of the iN Planning and Zoning Commission, together with the specified facts upon which such findings are based, shall be incorporated into the official minutes of the Planning and Zoning Commission meeting at which such waiver is granted. Waivers may be granted only when in harmony with the general purpose and intent of this UDC so that the public health, safety, and welfare may be secured and justice done. b. The Planning and Zoning Commission may establish a time period for execution of each granted waiver. C. Such findings together with the specific facts on which such findings are based shall be incorporated into the official minutes of the Planning and Zoning Commission meeting at which such exception is granted. Planning and Zoning Commission shall not authorize a waiver that would constitute a violation of a valid law, ordinance, code or regulation of the City. D. Any decision of the Planning and Zoning Commission regarding waivers to the provisions of this Article may be appealed to the City Council. When considering an appeal, the City Council shall consider the same standards as the Planning and Zoning Commission as outlined above. James Docks with the City's Public Works Department provided me with the following information on the sewer: "if the Corner store had to do the entire line from where we currently are now it would be approximately 8,352% If the City get their portion in with the Town Creek sewer project and the school wasn't ready with their portion you would have to build approximately 3,984', if the City get their portion in and the school gets their portion you would still have to build approximately 2,460' to get it to your tract. This is not including easements that are needed. This was all measurements from Googie Earth and are approxinoata.« Based on this information and the fact that the total demand from this store will only require the minimum size main allowed, an 8-inch line, I estimate the cost for the segments described above to be approximately a)$6§8,16O for #/3S2 feet, h\$318,720 for 3/984 feet, c>$196,8D0, for I,4B0feet, We understand that there are (1) still some easements that need to be acquired from property owners along the length of the proposed sewer main, and (2) the timeframe for the development nf the Carnal ISD school site is 2020 or 2021, each of which must occur before the sewer main would be within a half mile of the I-lubertus Site. Taking these factors into account, we estimate that the installation of the sewer main to (or near) the Hubertus Site is at best still seven (7) years out. If this is the true picture then the only option for CSTappears to be a) $668,160 and unknown delays on easement acquisitions. CST has stated their economic model requires construction soon after purchase and k was stated they would anticipate construction in the first quarter of 2014. If you can give us an indication of staff support, CST would submit a variance request to install, use and maintain an onsite sewer facility. This would allow CST to generate revenue that would satisfy CST's return on investment criteria, as well as, add a source to increase the tax base and facilitate Qrnm/t8 for the [ity. The subject property is zoned General Business — 2 (GB -2). GENERAL LOCATION AND SITE DESCRIPTION: The subject property is currently undeveloped and is located on the northwest corner of IH -35 and Hubertus Road intersection. ACCESS AND CIRCULATION: The subject property will be allowed one (1) point of access point along Hubertus Road which will provide joint access for both lots. The driveway along Hubertus Road will be a full access driveway. Additionally, the property will be allowed one (1) access point along IH -35 based on the overall lot frontage TxDot has reviewed the plat for access and drainage with no objections. A 1' vehicular non - access easement has been provided along the remaining frontage on IH -35 and Hubertus Road. A cross access easements is shown on the plat to provide internal connections between neighboring lots, reducing the number of curb cuts and driveways needed in the area. Due to the large trucks entering the site a waiver has been requested by the applicant to exceed the maximum driveway width. In accordance with the Unified Development Code (UDC), Article 21.14.5.C, Driveway — Waivers, the City Engineer has granted a waiver to the maximum driveway width of thirty (30) feet, to permit a fifty five (55) foot wide driveway along Hubertus Road. TREE MITIGATION AND PRESERVATION: The applicant will be responsible for complying with Unified Development Code (UDC), Section 21.9.9 Tree Preservation and Mitigation. The applicant has submitted a Tree affidavit which indicates that protected or heritage trees will be removed from the site. A tree survey is required to be submitted at the time of final plat at which time mitigation fees will be determined. PUBLIC SERVICES: The site is serviced by Schertz water, GVEC, AT &T, and Time Warner Cable. PUBLIC IMPROVEMENTS: All public improvements required for this subdivision are required to be installed prior to recording of the final plat per UDC, Section 21.4.15., unless otherwise specified in an approved development agreement. The civil construction plans must be reviewed and approved by the Public Works and Engineering Departments prior to final plat approval. Water and Sewer: This site will be serviced through 12" water lines that will be extended along Hubertus Road for the length of the property. Sewer does not currently exist on the subject property.
