81-F-28 THE STATE OF TEXAS ~ COUNTY OF GUADALUPE I CITY OF SCHERTZ ~ On this, the 5 day of October, 1981 , at 7:00 o'clock P.M., the City Council of the City of Schertz, Texas, convened at a regular meeting at the regular meeting place in the Municipal Building in the City of Schertz, Texas, pursuant to due call and notice to all of the members of said City Council, which meeting was at all times open to the public, and at which meeting the following members were present, to-wit: Jack M. Gilmore CITY SECRETARY CITY MANAGER There being a quorum present, the meeting was called to order by the Mayor, and, among other proceedings had were the following: The Mayor introduced the hereinafter set forth ordinance, which has been read and considered at the last regular meeting of the City Council on the 15 day of September, 1981. It was determined that the City Secretary had caused a short synopsis of said proposed ordinance to be published in the official City newspaper after its consideration at the last regular meeting of the City Council and prior to this meeting. Whereupon said ordinance was discussed and further considered by the Council. Thereupon it was moved by Counci1member Sawyer and seconded by Counci1member Lawler that said ordinance be finally passed and adopted. J/ - r -,?-g AN ORDINANCE OF THE CITY OF SCHERTZ, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES, CITY OF SCHERTZ, TEXAS, BE AMENDED BY REVISING SECTION 19-47 OF SAID CODE; PROVIDING A PENALTY FOR DELINQUENCY; BY REVISING SECTION 19-48 OF SAID CODE; DISCONTINUANCE OF SERVICE FOR FAILURE TO PAY; BY ESTABLISH- ING SECTION 19-50 OF SAID ORDINANCE; NEW CONSTRUCTION UTILITY CUSTOMERS, TEMPORARY SERVICES AND GARBAGE SERVICE ONLY; AND BY PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: SECTION 1. That Section 19-47 of the Code of Ordinances of the City of Schertz, Texas, be amended so that such section shall read as follows: "Section 19-47. Penalty for delinquency. (a) If a bill for water and sewer service is not paid on or before the tenth day of the month following the billing month, it shall be deemed delinquent and ten percent (10%) of the total amount of such bill shall be added to same as a penalty for nonpayment. If the lOth of the month occurs on a day when the Municipall Building is closed, the date for payment will be extend~d to the next succeeding day when it is open. Mail pos~marked the 10th or the extended date when the 10th is on a ~losed date, shall be accepted. Payments in the drop-box a~ 8:00 A.M. on the 11th or the extended date will be acceqted. An additional ten percent (10%) of the original amou~t of such bill shall be added for each additional thirty-Iday period for which such cust0mer i s del i nquent. " . I SECTION 2. That Section 19-48 of the iCode of Ordinances of the City of Schertz, Texas, be amended so that such section shall read as I ! "Section 19-48. Discontinuance Jf service for failure to pay (a) Any person that has not paild the bill for water and sewer service by the twentieth (30th) day of the month following the month in which bi11edJ shall have his water service discontinued. ! , (b) In the event of discontinudnce of service under this section, the service will ~ot be reinstated until all past due bills plus a reconnection charge of ten dollars ($10.00) and any and all p~na1ties have been paid. i (c) No service will be discontilnued on a Friday or a day before a holiday. Disconti1nuance of service will be extended until the next succeeding date when the Municipal Office is open. I I I (d) In the event that a customer of the city sewer system is supplied with water servic~ by a waterworks or supplier other than the City, such waterworks or supplier shall discontinue water service ~o such customer, upon notice from the City that such customer is del inquest in pay- ment of his sewer bill serVice." , follows: SECTION 3. That Section 19-50 of the Code of Ordinances of the City of Schertz, Texas, be established and that such section shall read as follows: "Section 19-50. New Construction Utility Customers, Temporary Services, and Garbage Service Only. (a) All new construction utility customers will be charged according to the following schedule: (1) Water service charges begin the date of service turn-on. (2) Sewer service charges begin the date of the sewer tap. (3) Garbage services charges begin the date of occupancy. Water service will not begin until a deposit has been made and a deposit card completed on the customer. In the case of a customer that has established a good credit rating with the City, (has had a deposit refunded), no deposit will be required. (b) Temporary Services (1) Extended Absence: When the owner or occupant of a residence plans to leave the area for thirty or more days, by request, the Utility Department will do a complete turn-off of services on the date requested and provide a final bill to the customer. If the customer desires, any deposit may be retained until he returns. Upon notification that the customer has returned, a service turn-on will be accomplished and the customer will be charged a service fee of ten dollars ($10.00), and billing will commence effective the date of turn-on. (2) Realtors and Rental Property Owners: Realtors or rental property owners that desire service for a specified period of time in order to clean-up or perform maintenance on their property are authorized to make a thirty-five ($35.00) dollar deposit that will not be credited to a specific property. Upon notification to the Utility Depart- ment that water service is required at a specific property address, a turn-on at that address will be accomplished. The customer must notify the Utility Department of the date and time that service is to be terminated. Upon termination of service, a utility bill will be prepared reflecting a pro- rated amount for the number of days that service was provided. (3) Developers, Builders, and Sub-dividers: Developers, Builders, and contractors that are in the process of constructing two (2) or more homes and require a water turn-on at the construction site are required to make a deposit based on 2t times the estimated water usage for all homes under construction. (4) Bulk Sales from fire hydrant-connection fee, deposit, and user charge: The sale of bulk water from fire hydrants throughout the city must be approved by the Director of Public Works. Under normal conditions, bulk water customers must use the water dispenser machine located on Live Oak Road. When a customer mwst use a fire hydrant to procure water, the custo- mer will be required to make a deposit of forty-five dollars ($45.00), pay a service charge of fifty dollars ($50.00), (not refundable) and will be charged at the rate of $.50 per thousand gallons of water obtained. In the event the customer advises the City that he will no longer be purchasing water, and all charges have been paid to the City, the deposit will be refunded. If, after refund of a deposit, the customer again desires to purchase bulk water, the service charge and deposit will each again be required. (c) Garbage Customer Only: Persons that are not water and sewer customers of the City but require garbage pick- up, will make a deposit for garbage pick-up in the amount of ten dollars ($10.00), or 2t times the garbage fee, whichever is greater." SECTION 4. The provisions of this ordinance shall take effect and be in force immediately upon and after its passage.
