81-L-21 ORDINANCE NO. $/-IJ.,-.:JJ AN ORDINANCE PROVIDING FOR AN ANNUAL LICENSE FEE FROM THE HOLDERS OF RETAIL BEER DEALER ON-PREMISES LICENSE, A RETAIL BEER DEALER OFF-PREMISES LICENSE, A PACKAGE STORE PERMIT, A WINE ONLY PERMIT, A WINE AND BEER RETAILERS PERMIT, A WINE AND BEER RETAILERS OFF-PREMISES PERMIT, A LATE-HOUR PERMIT OR LICENSE, AND A MIXED BEVERAGE PERMIT, AS PROVIDED BY HOUSE BILL NO. 77, DESIGNATED AS TEXAS LIQUOR CONTROL ACT, AS ADOPTED BY THE FORTY- FORTH LEGISLATURE OF THE STATE OF TEXAS AT ITS SECOND SESSION, AS HAS BEEN AMENDED; PROVIDING A SAVING CLAUSE; PROVIDING A PENALTY; AND PROVIDING A REPEALING CLAUSE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: SECTION 1. That under and by virtue of the authority granted in House Bill No. 77, designated as "Texas Liquor Control Act", adopted by the Forty-Fourth Legislature of the State of Texas at its second session, as amended, there be and there are hereby prescribed and levied annual occupation taxes or license fees upon and there shall be collected from persons, firms, andcorporat1ions carrying on business within the limits of the City of Schertz, Texas, as follows: A. From the holder of each license authorizing the sale of beer by a retail dealer for consumption on or off the premises where sold as defined and required by the terms of the above mentioned act of the legislature, domiciled in the City of Schertz, Texas, and carrying on business thereon under such license, an annual tax or fee of twelve and 50/100 ($12.50) dollars. B. From the holder of each Package Store Permit as defined and required by the terms of such act domiciled in the City of Schertz, Texas, and carrying on business therein under such permit an annual tax or fee of sixty-seven and 50/100 ($67.50) Dollars. Provided that the annual tax or fee from the holders of a Package Store Permit to sell wine only shall be five ($5.00) dollars. C. From the holder of each license authorizing the sale of beer by retail dealers in the original container direct to the consumer but not for resale, and not to be consumed on the premises where sold as defined and required by the terms of the above mentioned act of the legislature, domiciled in the City of Schertz, Texas, and carrying on business therein under such license fee, an annual ~ ,,'J tax or fee of five and no/lOa ($5.00) dollars. D. From the holder of each license or permit authorizing the sale of beer or mixed drinks by virtue of a late-hours license or permit as defined and required by the terms of the above mentioned act of the legislature, domiciled in the City of Schertz and carrying on business therein under such license or permit fee, and annual tax or fee of fifty and no/100 ($50.00) dollars. E. From the holder of each permit authorizing the sale of mixed beverages direct to the consumer for on-premises consumption, as defined and required by the terms of the above mentioned act of the legislature domiciled in the City of Schertz and carrying on business therein under such permit fee, an annual tax or fee of two hundred and fifty and no/lOa ($250.00) dollars, commencing with the fourth year of business operation under the terms of the permit and as regulated by legislation. ~ F. From the holder of each license authorizing the sale of beer for consumption on-premises where sold as defined and required by the terms of the above mentioned act of the legislature, domiciled in the City of schertz, Texas, and carrying on business thereon under such a license, an annual tax or fee of ten and no/100 ($10.00) doll ars. >., IJ G. From the holder of each license or permit authorizing the sale of beer and wine by a retail dealer where sold for consumption on and off premises as defined and required by the terms of the above mentioned act of the legislature, and carrying on business thereon under such license or permit, an annual tax or fee of fifteen and no/100 ($15.00) dollars. H. From the holder of each license or permit authorizing the sale of beer and wine for consumption off-premises where sold as defined and required by the terms of the above mentioned act of the legis- lature, domiciled in the City of Schertz, Texas, and carrying on ~, business thereon under such license or permit, an annual tax or fee of seven and 50/100 ($7.50) dollars. SECTION 2. SAVING CLAUSE: That if any section, part, or provlslon of this ordinance is declared unconstitutional, or invalid, then, in that event, it is expressly provided, and it is the intention of the City Council in passing this ordinance, that all other parts of this ordinance shall not be affected thereby and shall remain in full force and effect. SECTION 3. PENALTY. That any person who shall violate any of the provisions of this ordinance shall be deemed quilty of a misdemeanor and upon conviction thereof shall be fined not exceeding $200.00, and each and every day of such violation shall be deemed a separate and complete offense. SECTION 4. REPEALING CLAUSE: :hat all ordinances and parts of ordinances in conflict with the terms of this ordinance are hereby repealed. ATTEST: -/' /". , " !
