81-F-16 ORDINANCE NO. q 1- F- J (, I AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS PROVIDING THAT THE CODE OF ORDINANCES, CITY OF SCHERTZ, TEXAS, BE AMENDED BY REVISING SECTION 19-38 AND SECTION 19-41 WHICH PROVIDE FOR RESI- DENTIAL USER CHARGE, PUBLIC SCHOOL USER CHARGE AND DEPOSIT TO ASSURE PAYMENT. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: I THAT Section 19-38(a)(1)b of the Code of Ordinances of the City of Schertz, Texas, be amended so that such section shall read as follows: II Section 19-38(a) (1 )b. User charge--Each single-family user of the sewer system shall be assessed a monthly rate based on one hundred(lOO) percent of the user's average water consumption as computed for the months of December, January and February. Eighty cents($O.80) shall be assessed for each one thousand(l,OOO) gallons. In the event a customer moves from one address to another within the city, his sewer rate at the new address shall be the same as that at the former address until the annual rerating which shall occur in February of each year. In the event that no previous rate has been established by the customer, the rate assessed shall be determined by taking the overall average of chargeable water consump- tion of all single-family residences on the sewer system." II THAT Section 19-38(a)(3)b of the Code of Ordinances of the City of Schertz, Texas, be amended so that such section shall read as follows: "Section19-38(a)(3)b. User Charge--The user charge, based on one hundred (100) percent of all water consumed each month, shall be eighty cents($0.80) per one thousand(l,OOO) ga 11 ons . " III THAT Section 19-41 of the Code of Ordinances of the City of Schertz, Texas, be amended so that such section shall read as follows: .' "Section 19-41. Deposit to assure payment. A deposit of forty-five dollars ($45.00) or an amount equal to two and one-half (2~) times the esti- mated monthly bill, whichever is greater, will be re- quired for each patron. Any unused portion of such deposit shall be refunded to the consumer upon discon- tinuance of his service. After deposit has been held by the City for a period of five(5) years, and pro- vided the consumer has not been in default excessively in the payment of bills for utility service during such period of time, such deposit shall be refunded to the consumer. Refunds made under the provisions hereof will be made annually as of January first." Gilmore CITY SECRETARY CITY MANAGER There being a quorum present, the meeting was called to order by the Mayor, and, among other proceedings had were the following: The Mayor introduced the hereinafter set forth ordinance, which has been read and considered at the last regular meeting of the City Council on the 5 day of May , 19S1 . It was determined that the City Secretary had caused a short synopsis of said proposed ordinance to be published in the official City newspaper after its consideration at the last regular meeting of the City Council and prior to this meeting. Whereupon said ordinance was discussed and further considered by the Council. Thereupon it was moved by Councilmember Earl W. Sawyer and seconded by Councilmember Jacqueline Lawler that said ordinance be finally passed and adopted. The Mayor put the motion to a vote of the members of the City Council and the ordinance was finally passed and adopted by the following vote: AYES: All Couricilmembers present voted "Aye" NAYS: None
