'71] - F - /:$ , AN ORDINANCE DETERMINING AND FIXING THE r4AXIMUM SCHEDULES OF RATES TO BE CHARGED BY THE GUADALUPE VALLEY ELECTIC COOPER- ATIVE IN THE CITY OF SCHERTZ. TEXAS FOR ELECTRICITY AND ELECTRICAL SERVICES FURNISHED BY IT TO RESIDENTAL AND COMMERCIAL CONSUMERS; CONTAINING DEFINITIONS; FIXING THE EFFECTIVE DATE OF THESE CHARGES; MAKING MISCELLANEOUS PROVISIONS AND REPEALING ALL ORDINANCES IN CONFLICT. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ. TEXAS: Section 1. That the Guadalupe Valley Electric Cooperative (hereinafter called G.V.E.C.) is hereby authorized to place in effect the following schedules of rates within the corporate limits of the City of Schertz. Texas. SECTION 2 That electricity furnished by G.V.E.C. is for the individual use of the consumer at one point of delivery and shall not be resold or shared with others. SECTION 3 That no generation fuel cost is allowed in the G.V.E.C. base rate and if such a charge is allowed by the Public Utility Commission (Ilerein- after called the Commission) said charge must be shown separately on a consumer's bill as a Fuel Cost Adjustment (FCA). SECTI ON 4 That a Power Cost Adjustment (PCA) may be assessed. when ordered by the Commission. to adjust for increases or decreases in annual purchased power cost. SECTION 5 That G.V.E.C. is hereby authorized to operate with a Schedule of Services and Charges (attached hereto as Annex "A". approved by the G.V.E.C. Board of Directors as Rules and Regulations No. 17.0 and filed with the Commission as part of the G.V.E.C. Tariff dedlaration. Any subsequent change to this Schedule of Services and Charges so filed with the Commission must simultaneously be filed with the City Secretary. SECTION 6 That G.V.E.C. be authorized and directed. when so authorized and directed by Order of the Commission. to show a City Gross Receipt assess- ment as a separate line item on each customer's bill in the City. SECTI ON 7 That the rates and charges prescribed in this ordinance for fur- nishing of electricity and electrical services shall apply on all bills rendered after the effective date of this ordinance. viz. the date of final passage hereof. SECTION 8 That nothing contained in this ordinance shall be construed as in any manner. now or hereafter. limiting or modifying the right and power of the City. under the law. to regulate the rates charged by G.V.E.C. within the City. False Call for Service - When a consumer calls for service by the Cooperative and the trouble is found to be in the consumer's wiring, equipment or apparatus, the consumer shall be so notified. Any subsequent calls for service which are due to consumer's wiring, equipment or apparatus, shall be charged to consumer at actual cost, to include labor, transportation and normal overhead charges 17.2 Membership Fee - Each consumer shall become a member of the Cooperative and be bound by the Cooperative Charter, By-laws and all Rules and Regulations. The Membership Fee shall be $25.00 and shall be refund- able when service is discontinued, if all charges shall have been paid. For all accounts other than Mobile Homes, Commercial, Industrial and Irrigation $ 10.00 2. For Mobile Homes 50.00 3. S 100.00 over 50 H.P. $ 200.00 17.4 Waiving of Deposit - The deposits listed inl~3 shall be waived under the following conditions: 1. The consumer will be a residential account and is sixty five (65) years of age or older and such applicant does not have an outstanding account balance with the utility or another utility for the same utility service within the last two years. Such applicant shall obtain in writing from the other utility a statement to this effect and present same to the Cooperative before any deposit may be waived. 2. The consumer is a residential account and has been a consumer of any electric utility within the last two years and is not delin- quent in payment of any billing from such electric utility and during the last twelve (12) consecutive months of service did not have more than one occasion in which a bill for such electric or other service became delinquent before it was paid and said consumer never had an electric service account disconnected for non-payment. Such applicant shall obtain in writing from the electric utility a statement of the above conditions and present same to the Cooperative before any deposit may be waived. 3. The applicant furnishes in writing a guarantee satisfactory to the Cooperative to secure payment of bills for the electric service required. Determination of the satisfactory nature of such guarantee shall be made on a case by case basis by the Cooperative. 4. The applicant demonstrates a credit rating satisfactory to the Cooperative by appropriate means, including, but not limited to credit cards, letters of credit reference or other credit refer- ences. Box 118, Gonzales, Texas Cancelling Sheet No. Effective Date: July 27, 1976 Applies to: All Territory (Location) TARIFF: ELECTRIC Rule and Regulation No. 17.0 Page 3 of 6 17.4 Waiving of Deposit (Con't) a manner as to be accurate, current and easily checked by the Cooperative without the expenditure of time and money to more than an absolute minimum degree. 17.5 Refund of Deposit 1. If service is not connected or after disconnection of service, the utility shall promptly and automatically refund the cus- tomer's deposit plus accrued interest or the balance, if any, in excess of the unpaid bills for service furnished. A transfer of service from one premise to another within the service area of the utility sh~ll not be deemed a disconnection within the mean- ing of these rules, and no additional deposit will be demanded unless permitted by these Rules and Regulations. 2. When the customer has paid bills for service for twelve (12) consecutive residential billings or for twenty-four (24) con- secutive commercial or industrial billings without having service disconnected for nonpayment of bill and without having more than two occasions in which a bill was delinquent, and when the cus- tomer is not delinquent in the payment of the current bills, the utility will refund the deposit plus accrued interest to the customer in the form of cash or credit to a customer's bill. 17.6 Interest on Deposits - Any deposit required of a consumer which shall be retained for more than 30 days shall be paid interest at the rate of six percent (6%) per annum. Such interest payment shall be made annually in the form of a credit to any active account in the name of the consumer who paid such deposit, or such interest shall be paid at the time the deposit is returned or credited to the consumer's account. The deposit shall cease to draw interest on the date it is returned or credited to the consumer's account. 17.7 Charges for Temporary Meter Loops - The Cooperative will furnish temporary meter loops for services to be for a period of less than twelve (12) months and such loop rental shall be at the rate of $10.00 per month, starting with the day the loop is installed. The ownership for such switch and accessories shall remain the property of the Cooperative. 17.9 Insufficient Fund Check -A charge of $5.00 shall be charged to the individual who gives the Cooperative a check which is returned for in- sufficient funds, or any similar reason, such charge to be added to the electric bill whenever the individual has such an account with the Co- operative. 17.10 Appliance Service Shop Charges - The following charges shall apply for work performed by the Cooperative Service Shop: One man........................ ..... Electric Water Heaters - up to a maximum of 28% 2. Electric Heaters: A. Cost to Cooperative under $25.00 - up to a maximum of 54% b. Cost to Cooperative of $25.00 or over - up to a maximum of 25%. 3. Other resale merchandise - up to a maximum of 25%, hmoJever, if merchandise is paid for at time of purchase, a 10% discount will be given. 4. If payment is not made by a member by such date, the balance of such account shall be added to the member's next electric service bill. 17.12 Sale of Used Poles - Used poles shall be sold under the following conditions: 1. To members of the Cooperative, for personal use on the premises served by the Cooperative. 2. To non-profit or charitable organizations located within and the poles to be used within the Cooperative area. 3. To non-members located within the Cooperative area, such poles to be used within the Cooperative area by the person or firm purchasing same. 4. To persons or firms for use outside the Cooperative area. Poles to be sold under the above priority shall be those poles removed from the Cooperative's existing lines, such poles to be classified in two categories. Category A - shall consist of poles which are re-usable in the Co- operative's System. These poles shall be returned to the pole yard and placed in the regular inventory. These poles may be sold, but shall be priced the same as a new pole of equal length and classifi- cation. Category B - shall consist of poles which are classified as unfit for re-use in the Cooperative's System. Such poles shall be returned to the pole yard and placed in the Resale Inventory. Such poles shall be immediately cut into 8, 10 and 20 foot lengths and stacked neatly according to lengths. The refuse left over from such cuttings shall be immediately disposed of by burning. Poles classified in this category shall be sold at 40~ per linear foot. Poles in this category may also be sold in the field by proper designated employees.
