A Regular Meeting was held by the Schertz City Council of the City of Schertz, Texas, on July 15,
2014, at 6:00 p.m., in the Hal Baldwin Municipal Complex Council Chambers, 1400 Schertz
Parkway, Building #4, Schertz, Texas. The following members present to -wit:

Mayor Carpenter recognized Executive Director of Development Services Brian James who
provided the following announcements and upcoming events:

Mayor Carpenter recognized City Manager John Kessel who stated that he received a nice
note from a citizen who complimented our library staff, particularly in the children's section.
Youth Services Librarian April Toman directs this area and one of the things they have
brought in this summer is a Chemistry Road Show, which includes chemistry exhibitions for
the kids to observe. This program is brought to us by the Texas A & M University.

• Presentation regarding the November 4, 2014 Joint General Election (J. Kessel/B. Dennis)
Mayor Carpenter recognized Deputy City Secretary Donna Schmoekel who provided
information regarding the upcoming general election for November 4, 2014. This year's
election will be for the positions of Mayor, Councihnember Place 1 and Councilmember
Place 2. Important Election dates and other information will be posted in the near future on
the City's website as well as in the August 2014 issue of the Schertz Magazine. The City
Secretary's office is available for any inquiries anyone may have regarding the election.
Hearing of Residents:
Mayor Carpenter recognized the following who spoke:
Ms. Connie Jordan, 104 Henry Ford, spoke regarding her concern about Item 9 on the agenda
tonight regarding Resolution No. 14 -S -35. This item proposes a new convenience store off of
FM 3009 and Elbel Road and she is concerned about 1)the traffic going in and out of the
proposed business 2) the refueling of the gasoline tanks 3) upkeep of the store in the years to
come and 4) safety of students and visitors traveling to the nearby school.
Mr. Reed Carr, 3509 Columbia Drive, of the Northcliffe Homeowners Association, who
requested consideration for possibly installing a speed bump on Wedgewood Street, located
between Portage Lane and Mayfair in his neighborhood to address excessive speed in this
area. Mayor . Carpenter responded that they would have his concern brought before the
Transportation Safety Advisory Commission (TSAC) at their next meeting.
Discussion and Action Items
1. Minutes — Approve the minutes of the regular meeting of July 8, 2014. (J. KessellB. Dennis)
Mayor Carpenter recognized Councihnember Fowler who moved, seconded by Mayor Pro -
Tem Scagliola to approve the Minutes of the regular meeting of City Council of July 8, 2014.
The vote was unanimous with Mayor Pro -Tem Scagliola, Councilmembers Fowler and
John voting yes and no one voting no. Councilmembers Edwards and Duke were absent.

2. Ordinance No. 14 -M -23 — Consideration and/or action approving an Ordinance making it
unlawful for certain sex offenders to reside within 1000 feet of a child safety zone; making it
illegal for sex offenders to go in, on, or within 1000 feet of a child safety zone. First Reading

AN ORDINANCE AMENDING CHAPTER 75 OF THE CITY OF SCHERTZ CODE
OF ORDINANCES MAKING IT UNLAWFUL FOR CERTAIN SEX OFFENDERS
TO RESIDE WITHIN 1000 FEET OF A CHILD SAFETY ZONE; MAKING IT
ILLEGAL FOR SEX OFFENDERS TO GO IN, ON, OR WITHIN 1000 FEET OF A
CHILD SAFETY ZONE; PROVIDING EXCEPTIONS TO THE ORDINANCE; AND
PROVIDING PENALTIES FOR VIOLATIONS OF THE ORDINANCE.
Mayor Carpenter recognized Police Chief Michael Hansen who stated that currently the City
of Schertz does not have an ordinance that regulates sex offenders in the City. Except for
those that are under probation or parole there are no laws that regulate where they go or
where they live. He stated as our population grows it is reasonable to believe we will see an
increase in registered sex offenders come to our city. One of the reasons they come to our
city is that unlike our neighboring cities, we do not have an ordinance addressing this issue.
Mayor Carpenter recognized CID Corporal Ernest Spradling who answered questions from
Council regarding this item requesting authorization to amend Chapter 75 of the City's Code
of Ordinances to make it unlawful for sex offenders to reside within 1,000 feet of a child
safety zone or go in, on, or within 1,000 feet of a child safety zone. In the proposed
ordinance, child safety zone is defired as a school, licensed day -care facility, private or
public playground, public or private youth center, public swimming pool, video arcade
facility, public or private park, or public library.
These restrictions are necessary because certain crime studies indicate that sexual offenders
are more likely than any other type of offender to be re- arrested for a new rape or sexual
assault. In addition, certain crime studies also suggest that individuals commonly commit
crimes in close proximity to where they reside.
Both the restrictions on sex offenders in the proposed ordinance relating to residency and
going in, on, or within a child safety zone are consistent with the restrictions that the State of
Texas has established in Article 42.12 (13B) of the Texas Code of Criminal Procedure. Staff
recommends approval.

3. Resolution No. 14 -R -61 — Consider a Resolution adopting amendments to the Articles of

withdrawal of the City of Converse from the Cibolo Valley Local Government Corporation;
approving an amendment to the Memorandum of Understanding with the Cibolo Valley
Local Government Corporation to reflect the changes to the Corporation's Membership. (J.

AMENDMENT TO THE MEMORANDUM OF UNDERSTANDING WITH THE
CIBOLO VALLEY LOCAL GOVERNMENT CORPORATION TO REFLECT THE
CHANGES TO THE CORPORATION'S MEMBERSHIP AND OTHER MATTERS;
PROVIDING FOR SEVERABHdTY; REPEALING CONFLICTING

Mayor Carpenter recognized Deputy City Manager John Bierschwale and General Manager
of the Schertz- Seguin Local Government Corporation Alan Cockerell who introduced this
item stating the City has been a member of Cibolo Valley Local Government Corporation
(CVLGC) since 2010. Since 2013, the member cities have included Schertz, Cibolo, and
Converse. On June 26, 2014 the City of Converse requested to withdraw from CVLGC. In
order to accomplish this, CVLGC and each member city (including Converse) need to adopt
amendments to CVLGC's Articles of Incorporation and Bylaws. Only with those changes
can CVLGC properly effectuate the complete withdrawal of Converse. Additionally, we
need to amend the MOU between the cities and CVLGC. Both the resolution adopting the
changes to CVLGC's governance documents and the proposed change to the MOU are
attached. CVLGC requests consideration before its next Board meeting, currently scheduled
for July 24, 2014. Staff recommends approval.

Texas acknowledging and supporting the Business Plan of Cibolo Valley Local Government

Mayor Carpenter recognized Deputy City Manager John Bierschwale and General Manager
of the Schertz - Seguin Local Government Corporation Alan Cockerell who introduced this
item stating the City has been a member of Cibolo Valley Local Government Corporation

(CVLGC) since 2010. On May 22, 2014 a joint meeting of the City Councils of the member
cities (Schertz and Cibolo) was held where CVLGC presented its business plan for securing,
developing, and producing potable water resources for use by the CVLGC member cities.
At this meeting, it was requested that each governing body of the member cities take action
approving a resolution committing to the CVLGC business plan and accepting the
responsibility of additional financial support in regards to the development of additional
potable water resources.
This item was tabled at the June 24, 2014 City Council Meeting. The City Council requested
a copy of the updated business plan with the altered investment information based on the
withdrawal of the City of Converse from the CVLGC. This updated action now reflects an
adjusted approximate annual cost for each city (Schertz & Cibolo) of $380,163 for the period
years of 2015 through 2019, as we go forward in search of developing other water sources
within Wilson, Gonzales, and Guadalupe counties.

5. Ordinance No. 14 -D -32 — Consideration and/or action approving an Ordinance revising the
speed limit on Graytown Road from Boenig Drive to 11110 to 45 mph. First Reading (B.

Mayor Carpenter recognized Storm Water Manager Larry Busch, Jr. who introduced this
item stating the speed limit on Graytown Road is 40 mph. In the past few years,
development and traffic has increased in the area. Public Works and Engineering completed
a traffic study in the area to determine the appropriate speed for the roadway. The 85-
percentile results were a higher speed than 45 mph; however, staff recommends that a safe
traveling speed for Graytown Road is 45 mph.
The Traffic Safety Advisory Commission recommended approval at their regular meeting on
June 5, 2014. Staff recommends approval.
Mayor Carpenter recognized Mayor Pro-Tern Scagliola who stated he had concerns about
how we make the final decision of what the speed limit will be and do we simply go with the
85 percentile traffic study results. Mr. Busch, along with Executive Director of Development
Services Brian James stated that city staff physically goes out to these sites and look at

various things such as sight distances, road condition, improvements, and even surrounding
landscaping in the area. They test drive down the road themselves to determine what a safe
traveling speed is for that area before making a final determination. They also get
comprehensive reports from the road counters that reflect data of high, low and average
speeds.
Mayor Carpenter commented that he recently realized that speed limit signs are also an
indicator of the expected speed of traffic around us as we travel so that we are cognizant of
the danger that could be there. It is a warning that others will be traveling at that speed. It is
not just a control for traffic speed but also information that is critical for our safety.

Mayor Carpenter recognized Councilmember Fowler who stated he noticed this road had a
lot of sharp curves in it and had that been taken into consideration. Storm Water Manager
Larry Busch stated that yes in this case the street had been widened. Additionally there are
early advisory speed signs placed well before the curves to warn motorists.

9. Ordinance No. 14 -S -35 — Conduct a public hearing and consider a request for a Specific Use
Permit to allow a Convenience Store with Gas Pumps at 853 FM 3009 with the associated

ORDINANCE NO. 14 -S -35
AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS
ZONING 853 FM 3009, SCHERTZ, GUADALUPE COUNTY, TEXAS TO ALLOW A
SPECIFIC USE PERMIT FOR OPERATION OF A CONVENIENCE STORE WITH
GAS PUMPS.
Mayor Carpenter recognized Senior Planner Lesa Wood who introduced this item stating that
Schertz 3009, LTD. is requesting a Specific Use Permit to allow a convenience store with gas
pumps on approximately 1 acre of land located at 853 FM 3009 and more specifically
described as Lot 2, Block l of the Schertz 3009 Market Subdivision with associated site plan.
The proposed development includes a 1,200 square foot convenience store with twelve (12)
gas pumps. The subject property is designed as a pad site adjacent to the proposed
Neighborhood Market which is located at Lot 1, Block 1 of the Schertz 3009 Market
Subdivision. Access to the site will be through two (2) shared driveways along FM 3009 and
Elbel Road. The subject property is currently zoned General Business (GB).
The public hearing notice was published in "The Daily Commercial Recorder" on June 30,
2014 and the "Herald" on July 2, 2014. Seven (7) public hearing notices were mailed to
surrounding property owners within two hundred (200) feet of the subject property on June
13, 2014. At the time of this staff report one (1) response was received neutral to the request.
The proposed convenience store with gas pumps will be subject to provisions of the Unified
Development Code (Ordinance 11 -S -15, as amended). Additionally, the Specific Use Permit
will be conditioned upon the following occurring:
a) A driveway permit for the shared driveway on FM 3009 located on Lot 1, Block 1 of the
Schertz 3009 Market Subdivision has been issued within one year of the adoption of the
Specific Use Permit ordinance; and
b) A building permit has been approved within one year of the adoption of the Specific Use
Permit ordinance; and
c) The use has begun operation within two years of the issuance of the necessary building
permit.
A Specific Use Permit allows for discretionary City Council approval of uses with unique or
widely varying operating characteristics or unusual site development features, subject to the
terms and conditions set forth in this UDC. Approval of a specific use permit authorizes a
property owner to submit subsequent development applications consistent with the approved
Specific Use Permit.. The Planning and Zoning Commission conducted the public hearing
on June 25, 2014 and offered a recommendation of approval by a unanimous vote. Staff
recommends approval of the Specific Use Permit request.
Mayor Carpenter opened the public hearing and as no one spoke, Mayor Carpenter closed the
public hearing and called for Council questions and comments.
Mayor Carpenter recognized Councilmember Fowler who stated this particular intersection
appears to be an appropriate use of this property and he liked the fact that all the lighting is

all under the canopy thereby not creating any lighting pollution. It also adds to the
competition of the convenience store across the street.
Mayor Carpenter recognized Mayor Pro -Tern Scagliola who stated he was concerned about
requesting a special use permit. Is this just a phase of a larger project? Senior Planner Lesa
Wood stated that it was a project on its own but was also a part of a larger subdivision. It is
half of a two part lot. The reason for issuing a specific use permit to the developer is because
it is required by our Unified Development Code for all convenience stores with gas pumps.
Mayor Pro -Tern Scagliola also asked about the improvements along Elbel Road and FM
3009. They are planning to put in a TkDOT approved diesel lane on FM 3009. Another
entrance will be full access. Sidewalks will be on the property and along FM 3009 and Elbel
Road. Drainage has been reviewed and it will drain back to the existing Dietz Creek.

Councihnember John to approve Ordinance No. 14 -S -35, first reading. The vote was

10. Ordinance No. 14 -S -36 — Conduct a public hearing and consider a request to rezone
approximately 9 acres of land, generally located five hundred and twenty (520) feet north of
the intersection of IH 35 and Schertz Parkway from Planned Development District and
General Business (GB) to Planned Development District (PDD). First Reading (B.

AMENDING THE OFFICIAL ZONING MAP BY ZONING APPROXIMATELY 9
ACRE TRACT OF LAND FROM GENERAL BUSINESS (GB) AND PLANNED
DEVELOPMENT DISTRICT (PDD) TO PLANNED DEVELOPMENT DISTRICT
(PDD).
Mayor Carpenter recognized Senior Planner Lesa Wood who introduced this item stating that
Mid Cities 35 Partners, LTD is proposing to rezone approximately 9 acres of land from
General Business (GB) and Planned Development District (PDD) to Planned Development
District (PDD). The request is to rezone the subject property into the Verde Enterprise
Business Park Subdivision and develop in accordance with the 07 -S -14A PDD with the
exception to a building setback. The Verde Enterprise Business Park Ordinance 07 -S -14A
was approved by City Council on March 6, 2007 to allow a mix of commercial and industrial
uses.
The public hearing notice was published in "The Daily Commercial Recorder" on June 30,
2014 and the "Herald" on July 2, 2014. Eight (8) public hearing notices were mailed to
surrounding property owners within two hundred (200) feet of the subject property on June
18, 2014. At the time of this staff report one (1) response was received in favor of the
request.

The 9 acre tract of land will develop in accordance with the existing Verde Enterprise
Business Park PDD Ordinance 07 -S -14A with the exception of the building setback adjacent
to property located outside the PDD.
Staff has reviewed the request and is of the opinion that that proposed zoning request will be
compatible with the surrounding adjacent land uses. It is unclear why the PDD Ordinance 07-
S-014A was written to have a greater setback adjacent to commercial or industrial uses when
the current zoning of General Business (GB) for the adjacent property located outside the
PDD has a minimum side yard setback of zero (0).
The Planning and Zoning Commission conducted the public hearing on June 25, 2014 and
offered a recommendation of approval by a unanimous vote. Staff recommends approval.
Mayor Carpenter opened the public hearing and recognized the following who spoke:
Mr. Steve White, 805 Main Street, who stated he would like to have information regarding
flooding problems in this area. GCR has had water up to his knees there and they built a
drainage system on their own. He wondered if the drain that goes across that property has
been looked at or taken care of
As no one else spoke, Mayor Carpenter closed the public hearing and asked if a
representative from the developer could address Mr. White's question about drainage.
Mayor Carpenter recognized Ms. Michelle Hausmann representing the developer who
provided a slide presentation regarding the drainage improvements.
Mayor Carpenter recognized Mayor Pro -Tem Scagliola who asked Senior Planner Lesa
Wood if there were any other situations along this stretch we should be aware of. She stated
that the only other tract left is where the GCR Tire tract is located. The rest belongs to the
Verde Enterprise Business Park. The PDD has a development standard specific to that
subdivision. The rest of the adjacent property is already platted. Michelle Hausmann added
that now that Mid Cities owns the property, infrastructure can be completed as development
continues. Ms. Wood answered further questions concerning buffer zones, offsets and
landscaping standards from Mayor Pro -Tem Scagliola, Ms. Wood stated the PDD does not
relieve anyone from abiding by our standards.
Mayor Carpenter recognized Mayor Pro-Tern Scagliola who moved, seconded by
Councilmember Fowler to approve Ordnance No. 14 -5 -36, first reading. The vote was
unanimous with Mayor Pro -Tem .Scagliola, Councilmembers Fowler and John voting yes
and no one voting no. Councilmembers Edwards and Duke were absent. Motion Carried

Mayor Carpenter recessed the regular meeting into executive session at 7:20 p.m.

Councilmember Fowler to approve Resolution No. 14 -R -62. The vote was unanimous with
Mayor Pro -Tem Scagliola, Councilmembers Fowler and John voting yes and no one
voting no. Councilmembers Edwards and Duke were absent Motion Carried.
