14-R-63 - Supporting a Governance Charter Agreement with Joint Base San AntonioRESOLUTION NO. 14 -R -63 A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS SUPPORTING A "GOVERNANCE CHARTER" AGREEMENT BETWEEN JOINT BASE SAN ANTONIO (JBSA), STATE AND LOCAL GOVERNMENTS, COMMUNITY ORGANIZATIONS, AND LOCAL BUSINESSES. WHEREAS, as a result of Base Realignment and Closure (BRAC) 2005, installation support functions at Fort Sam Houston and Camp Bullis were combined with those at Randolph and Lackland Air Force Bases under a single organization to form the largest joint base operation in the Department of Defense: Joint Base San Antonio (JBSA); and WHEREAS, employing 80,000 people, Joint Base San Antonio is the largest employer in San Antonio, supporting more than 250,000 personnel in the regional area, comprising a total plant replacement value of $10.3 billion, and executes an annual budget of $240 million; and WHEREAS, On January 3, 2013, 10 USC § 2336 was signed to law, increasing Department of Defense /Service latitude in pursuing intergovernmental support agreements; and WHEREAS, in order to capitalize on this authority while continually striving to provide unrivaled installation support, 502d Air Base Wing (ABW) and Joint Base San Antonio Installation Commander, hosted a forum with community leaders and mission partners to discuss opportunities for P4 partnerships on February 21, 2014. WHEREAS, San Antonio Community Partnership will propose and manage public- public and public - private (P4) initiatives to achieve savings in energy efficiency, joint purchasing, and moral, welfare, and recreation (MWR) services; and WHEREAS, the ultimate aim of the San Antonio Community Partnership is to sustain and increase the military value of JBSA and support the economic vitality and quality of life in the region. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS THAT: Section 1. The City Council hereby authorizes collaboration with Joint Base San Antonio and San Antonio Community Partnership; a non - binding charter and would not commit the city contractually or financially. Section 2. The recitals contained in the preamble hereof are hereby found to be true, and such recitals are hereby made a part of this Resolution for all purposes and are adopted as a part of the judgment and findings of the City Council. Section 3. All resolutions, or parts thereof, which are in conflict or inconsistent with any provision of this Resolution are hereby repealed to the extent of such conflict, and the provisions of this Resolution shall be and remain controlling as to the matters resolved herein. Section 4. This Resolution shall be construed and enforced in accordance with the laws of the State of Texas and the United States of America. Section 5. If any provision of this Resolution or the application thereof to any person or circumstance shall be held to be invalid, the remainder of this Resolution and the application of such provision to other persons and circumstances shall nevertheless be valid, and the City Council hereby declares that this Resolution would have been enacted without such invalid provision. Section 6. It is officially found, determined, and declared that the meeting at which this Resolution is adopted was open to the public and public notice of the time, place, and subject matter of the public business to be considered at such meeting, including this Resolution, was given, all as required by Chapter 551, Texas Government Code, as amended. Section 7. This Resolution shall be in force and effect from and after its final passage, and it is so resolved. PASSED AND ADOPTED, this 22nd day of July, 2014.
