Mr. James stated that the Commission had been previously given a copy of the Parks Master Plan which was also presented to City Council, and tonight the Commission will consider making a recommendation on an amendment to the Comprehensive Land Plan with a revision to the Parks Master Plan. A survey of Schertz residents was conducted, and the survey data and public input indicates that there appears to be a strong desire to continue devoting adequate resources to Parks and Recreation in order to maintain and improve the quality of life for our residents. Mr. Richmond opened the Public Hearing at 6:22 P.M. There being no one to speak, Mr. Richmond closed the Public Hearing at 6:23 P.M. Mr. Braud asked what the Commission is taking action on. Mr. James stated that the Commission is recommending to City Council an amendment to the Comprehensive Land Plan with a revision to the Parks Master Plan. Mr. Braud stated if there were 329 participants then this is only 1 % of people in Schertz. Mr. Davis stated that there is a higher percentage if you look at the 10,000 households reported in the 2010 census. Discussion followed between. Staff and the Commission. Mr. Braud moved to recommend an amendment to the Comprehensive Land Plan with a revision to the Parks Master Plan to the City Council as presented. Mr. Greenwald seconded the motion. Vote was 5 -0. Motion carried. Mr. Richmond moved to Item 4A. 4. ITEMS FOR INDIVIDUAL CONSIDERATION Minutes Planning and Zoning Commission July 23, 2014 Page 3 of 7 A. Waiver — On -site Sewage Facility associated with PC2014 -033 Consider and act upon a request for approval of a waiver regarding on -site sewage facilities for proposed lots identified on the replat of Deer Park Subdivision Lot 15. The property consists of approximately 16 acres and is situated in the Francisco Rodriguez Survey No. 99, Abstract No. 484, Comal County, Texas; generally located south of the intersection of Bunker Street and Pathfinder. Mr. James gave a brief overview on the challenges to Staff on this item, and stated some of the items working with the property owner and the neighbors have been rendered moot. A notice went to homeowners for 2 waivers, one for water and one for sewer and a replat and the notice referenced a zoning event, which is not the case and is confusing. There is a provision in the Local Government Code when you have a replat of property which doesn't vacate the previous plat and there is a request for a variance that if written opposition is received by owners of more than 20% of the surrounding property in the notice area, then a 3/4 majority is required of those present from the approval body. Staff did receive 3 responses in opposition which may have been caused by the confusing mention of a zoning event. The challenge was that Staff does not have clarity if this is called a waiver and our recommendation was to table the plat until Staff can go back and review. However, residents who are here tonight and were opposed, following explanation, have changed their written opposition to the replat. Therefore, Staff is recommending to act on these items tonight. Mr. Cox presented this item by stating that the applicant is proposing to replat Lot 15 of Deer Park Subdivision into two lots. The new lots being created are Lots 29 (10.4 acres) & 30 (5.01 acres). The property is located in the Schertz Extra Territorial Jurisdiction (ETJ) and is not subject to city zoning regulations. The applicant is seeking approval of a waiver to install an on -site sewage facility (OSSF) on Lots 29 and 30 because of the lengthy distance to the nearest sewer line and costs associated with building and connecting to that line. The subject property is generally located at the intersection of Bunker Street and Pathfinder in the Schertz ETJ. There is currently a home on the property which is being served by a private well and septic system. The City's Future Land Use Plan identifies this property as Agricultural Conservation. The applicant is seeking approval of a waiver for Lots 29 and 30 to have privately owned On -Site Sewage Facilities (OSSF) which are regulated by Comal County. The applicant is requesting a waiver to the required connection to a public waste water system to allow privately owned on -site sewage facilities for Lots 29 and 30. Currently, the closest sewer connection to the subject property is located on the south side of the railroad crossing on Schwab Road approximately 500 feet south of the intersection of FM 482 and Schwab Road. The sewer line would need to be extended approximately 8,000 feet along Schwab Road, FM 482 and Bunker Street to reach the subject property. The Project Engineer estimates that it will cost $995,000 to extend the sewer main from its current location to the subject property. There is currently no source of public water near the subject property. The existing house on the property is serviced by OSSF and a private well. Staff recommends approval of the waiver based on the distance to the sewer connection and the Comprehensive Land Use Plan. The applicant had no comments at this time. Mr. James stated that the waiver needs to be done before the plat. Mr. Crawford stated that he wouldn't want to have the replat without the waiver. Mr. James concurred. Mr. Crawford asked the owner when this property would be divided. The Owner, Joseline Brestle, 20825 Sorrel Lane, Garden Ridge, stated that they had already started this process when they decided not to live there because of the stairs and it's too isolated. Clint Penniman, 2123 E. Common Street, New Braunfels, stated that the 5 acre lot that he is purchasing already has the well, septic and the house on it, so the other 10 acre lot needs the well and septic. Discussion continued between Staff and the Commission. Mr. Glombik moved to approve this item as presented. Mr. Greenwald seconded the motion. Vote was 5 -0. Motion carried. B. Waiver — Private Water Well associated with PC2014 -033 Consider and act upon a request for approval of a waiver regarding private water wells for proposed lots identified on the replat of Deer Park Subdivision Lot 15. The property consists of approximately 16 acres and is situated in the Francisco Rodriguez Survey No. 99, Abstract No. 484, Comal County, Texas; generally located south of the intersection of Bunker Street and Pathfinder. The site is located within the Green Valley Special Utility District service area; a letter from Pat Allen, the General Manager, just received indicates he does not have an opposition to the well. The applicant is requesting a waiver to the required connection to a public water system to allow private water wells for Lots 29 and 30. Currently, the closest water line to the subject property is located on the south side of the railroad crossing on Bunker Street approximately 2,900 feet north of the intersection of FM 482 and Bunker Street. The water line would need to be extended approximately 3,300 feet along Bunker Street to reach the subject property. The Project Engineer estimates that it will cost $408,940 to extend the water line from its current location to the subject property. The Schertz Sector Plan Amendment to the Comprehensive Land Use Plan identifies the subject property as being located in the Agricultural Conservation area. Agricultural Conservation is composed of mainly large -lot (5 acre min lot size) residential and agricultural with some AG related commercial uses. Additionally the sector plan identifies private water wells as acceptable water service for Agricultural Conservation subdivisions. Minutes Planning and Zoning Commission July 23, 2014 Page 5 of 7 The subject property is located over the Edwards Aquifer and a permit for an exempt well will need to be completed and submitted to the Edwards Aquifer Authority (EAA). Project Engineer Thomas Villanueva Jr., P.E. has provided a signed and sealed letter stating that "any new owners would be able to drill and install an exempt well at their sole expense, via a completed Edwards Aquifer Authority (EAA) application for an approved EAA well construction pen-nit". Additionally no water rights are required to obtain an exempt well permit from the EAA. In addition to obtaining a well permit from EAA, the property owner will need to obtain a City of Schertz Well Permit through the Public Works Department. There is currently no source of public water near the subject property. The existing house on the property is serviced by OSSF and a private well. Staff recommends approval of the waiver based on the distance to the water line and the comprehensive land use plan. Mr. Glombik moved to approve this item as presented. PC2014 -033 Deer Park Subdivision — Replat Hold a public hearing, consider and act upon a request for approval of a replat of Deer Park Subdivision Lot 15. The property consists of approximately 16 acres and is situated in the Francisco Rodriguez Survey No. 99, Abstract No. 484, Comal County, Texas; generally located south of the intersection of Bunker Street and Pathfinder. Mr. Cox presented this item by stating that the applicant is proposing to replat Lot 15 of Deer Park Subdivision into two lots. The new lots being created are Lots 29 (10.4 acres) & 30 (5.01 acres). The property is located in the Schertz Extra Territorial Jurisdiction (ETJ) and is not subject to city zoning regulations. There were 10 notices mailed to surrounding property owners on July 7, 2014. At the time of the staff report, four (4) total responses were received, three (3) responses were opposed to the request; one (1) response was neutral to the request; and no responses received were in favor of the request. But since then, two of them have rescinded their opposition and one changed to neutral so there is zero opposition. In addition, Staff received one in favor and one neutral. The Deer Park Subdivision. Plat was recorded on September 12, 1974 in the Comal County plat records. The subject property is generally located at the intersection of Bunker Street and Pathfinder in the Schertz ETJ. There is currently a home on the property which is being served by a private well and septic system. The subject property fronts on Bunker Street and Pathfinder which are both public streets. Access to the property will be from Bunker Street and Pathfinder. No public improvements are required for this subdivision. The City Engineer has reviewed and approved a storm water plan for Lots 29 and 30. No roadway improvements or ROW dedications are required. Staff recommends approval. The property is approximately a 19 acre tract of land situated in the C.M. Gahagan Jr. Survey No. 258, Abstract No. 142, Guadalupe County and Abstract No. 182, Comal County, City of Schertz, Texas and located on Eckhardt Road approximately 1000 feet south of the Froboese Lane. GENERAL INFORMATION: Owner /Applicant: La Salle Partners, John Keck Proiect Engineer: neer: Ford Engineering, Mark Hill, P.E. APPLICATION SUBMITTAL DATE: June 23, 2014 (Original Application) July 15, 2014 (Revised Submittal) BACKGROUND: The Master Plan was amended and approved by the Planning and Zoning Commission on February 12, 2014. The preliminary plat was approved by the Planning and Zoning Commission on May 14, 2014. ITEM SUMMARY: The applicant is proposing to final plat approximately 19 acres of land establishing 73 single family residential lots, one (1) drainage lot, and one (1) landscape lot. The zoning for Unit 4 is Single Family Residential District -6 (R -6) with a minimum lot size of 7,200 square feet. Side yard setbacks are established at seven and one half feet (75). GENERAL LOCATION AND SITE DESCRIPTION: The subject property is located generally northwest of the intersection of Eckhardt Road and the IH 35 frontage road. ACCESS AND CIRCULATION: The UDC, Article 14, requires that all residential subdivisions have a minimum of two (2) locations accessing existing public streets. This development is designed to have two (2) points of access via Unit 3 through Forrest Oak and Top Ridge Lane which will be constructed with Unit 3 and Eckhardt Road. A final plat for Unit 4 will not be recorded until the improvements from Unit 3 are accepted and the plat is recorded. TREE MITIGATION AND PRESERVATION: The applicant is responsible for complying with Unified Development Code (UDC), Section 21.9.9 Tree Preservation and Mitigation. A tree survey with a tree mitigation and preservation plan was submitted and reviewed by the Parks, Recreation and Community Services department. The tree survey identifies thirty (30) protected and four (4) heritage size trees on the site totaling five hundred and eighty two inches (582 "). Three (3) protected size trees totaling fifty four inches (54 ") will be removed. All trees being removed are tree species that are exempt from mitigation. No mitigation fees are due with this final plat application. PARKS: 10.503 acres of public parkland has been dedicated with Unit 1 of this subdivision. The Developer is working with the Parks, Recreation and Community Services Director on the design of the parkland improvements. However, the developer may elect to make a cash payment -in -lieu of development in the amount of $650 per dwelling unit prior to recording of the final plat. This application was reviewed under UDC, Ordinance 11 -S -15. PUBLIC SERVICES: The site is serviced by Schertz water and sewer, GVEC, AT &T, and Time Warner Cable. PUBLIC IMPROVEMENTS: All public improvements required for this subdivision are required to be installed prior to recording of the final plat of each Unit per UDC, Section 21.4.15., unless otherwise specified in an approved development agreement. The civil construction plans have been reviewed and approved by the Public Works and Engineering Departments. Water and Sewer: This site is serviced through 8" water lines and 8" sewer lines that will be extended throughout the subdivision. Drainage: The applicant is responsible for all drainage associated with the subject property, and for compliance with the Storm Water regulations. A drainage report has been reviewed and approved by the City Engineer. The subdivision is providing onsite detention. Sidewalks Hike and Bike Trails: Sidewalks will be constructed along both sides of the street throughout the subdivision and along Eckhardt Road. All sidewalks have been designed to meet the City of Schertz specifications. Road Improvements: All streets will be developed to City of Schertz specifications. An approximately 9' variable width ROW dedication has been provided for expansion along Eckhardt Road. Construction plans for all public improvements have been submitted and approved by Public Works and Engineering Departments. STAFF ANALYSIS AND RECOMMENDATION: The proposed final plat is consistent with applicable requirements for the property, ordinances and regulations. Staff recommends approval of the final plat. At the time of this staff report eleven (11) responses from property owners within the 200 foot notification boundary were received, nine (9) responses were opposed to the request, two (2) responses were in favor of the request, and no responses were neutral to the request. BACKGROUND: The Kensington Ranch Estates Planned Development District (PDD) zoning was approved by City Council on September 16, 2005. The master development plan was amended on February 10, 2010 to allow drainage channel right -of -way dedication and the addition of seventeen (17) lots to Unit 1. The master development plan was amended a second time on August 10, 2011 to adjust the road alignment and phasing for Unit 3. The final plat for Unit 1 was approved by the Planning and Zoning Commission on March 14, 2006, The Unit 1 plat was amended on January 12, 2012 to provide a variable width drainage right -of -way. ITEM SUMMARY: The applicant is proposing to replat Block 18, Lot 1 of Kensington Ranch Estates Subdivision Unit 1 into seventeen (17) buildable lots and seven (7) common open space/ drainage lots. The property is located in the Kensington Ranch Estates Planned Development District zoning. GENERAL LOCATION AND SITE DESCRIPTION: The subject property is generally located on the west side of the intersection of Savannah Drive and Round Creek. The lot is currently undeveloped. ACCESS AND CIRCULATION: The UDC, Article 14, requires that all residential subdivisions have a minimum of two (2) locations accessing existing public streets. This development is designed to have two (2) points of access off of Savannah Drive. The Parks, Recreation and Community Services Department has determined that a fee -in lieu of parkland dedication in the amount of $1000 per dwelling unit, $17,000 total, will be paid by the Developer prior to recording of the final plat. My wife and I are property owners at 3501 Enchanted Farm, which is within 200 feet of the subject property. The location of our property apparently requires the City of Schertz to notify of us of this proposed replat. We thank you for this opportunity. We are opposed to this replatting. We purchased our home and moved to Schertz in April 2010. We moved here from an unincorporated area of northeast Bexar County. We selected the Schertz area because of its small town rural atmosphere and feel. We believed that living in the Schertz area would improve our quality of life. In viewing the strategic plan and vision of the Schertz leaders, this appeared to be within the city charter to include effective land use. While not being of legal background, in viewing the proposed replatting it would certainly appear that suggested use of this property would not be in the best interest of the affected residents of the Kensington Ranch Estates or the City of Schertz. The area is currently an area within the flood plan. Having lived in the Bexar /Guadalupe area since 1975, we are familiar with the flooding issues of south Texas. More recent to memory are the floods of 1998 and 2002; and even to some extent 2009. Schertz has taken tremendous strides to attempt to remedy many of the issues experienced during those times. Part of that remedy is the area adjacent to the area in question. Again, while not an engineer or a legal expert, it would seem illogical to violate the efforts taken to resolve flooding in this area by adding more homes adjacent to this area. We purchased our home because we liked the area and the rural feel of the community. This area in question provides a park -like greenbelt look and feel that is becoming more and more difficult to find throughout neighborhoods. The wildlife of this area are finding natural habitat less available each day as home /business development continues to thrive in the City of Schertz. This small 8 acre plot of land, adjacent to our neighborhood, with its back to the drainage facility engineered by Schertz, is one of the last wooded areas left to them. It is not, in our opinion, one that should be left to the decision of the developer, now Pulte, who has no interest in this area other than building homes and making money on their behalf, to remove it. The original developer, Centex, who has since been bought out /taken over by Pulte, apparently had no visible interest in developing this plot as the built and sold the homes in the now existing Kensington Ranch Estates area. Now that it is Pulte, and the majority of the lots have been developed or are being developed, want to extend that stamp to what little wildlife /park atmosphere there is left. That just doesn't seem to be in the best interests of the City of Schertz or its residents.
