12-17-02 CITY COUNCIL MINUTES REGULAR SESSION 12-17-02 The Schertz City Council convened in Regular Session on Tuesday, December 17, 2002 at 7:00 p.m in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Schertz, Texas. Those present were Mayor Hal Baldwin, presiding; Councilmembers Steve Simonson, Reginna Agee, Tony Wilenchik and Ken Greenwald. Staff present were City Manager Mark Marquez and City Secretary Norma Althouse. Mayor Baldwin welcomed everyone and asked them to rise and join him in the Pledge of Allegiance to the Flag. #1 PRESENTATION OF CHRISTMAS LIGHTING CONTEST AWARDS Mayor Baldwin commented the City had a great tree lighting ceremony and a great Christmas in the park. He is very proud of the City. Before announcing the winners of the Christmas Lighting Contest and presenting them their awards, he introduced two of the judges of the contest - Jackie Javier and Donna Olsen. The theme ofthe contest was Festival of Angels and the winners were as follows: RESIDENTIAL Eugene Rice of Forest Ridge Subdivision at 4496 Brush Creek Arthur Andreolli of Arroyo Verde Subdivision at 3832 Arroyo Seco (he was not present) Javier Rodriguez of Northcliffe at 5621 Fairway Ernest Hensley of Oak Forest Subdivision at 1313 Circle Oak Alexander and Sharlene Todd of Caroline Crossing Subdivision at 3657 Diamond Falls Jerete Adame of Lone Oak Subdivision at 101 Roundtree Curtis Jenkins of Savannah Square Subdivision at 3705 Wm Scarbrough Terry Wells of Woodland Oaks Subdivision at 2457 Grove Park Balis Daily, Sr. of Aviation Heights at 411 Exchange Lori Kuntz of Ashley Place II Subdivision at 438 Twinpoint Creek Gary Shuck of Ashley Place I Subdivision at 211 Newrock Creek (he was not present) 78 COMMERCIAL: GVEC at 908 Curtiss Ave. (represented by Sean Alvarez) Following presentation of the awards, a group picture was taken. #2 HEARING OF RESIDENTS Robert Brockman of 4505 Grand Forrest commented on the following: There is more than one Carolina Crossing. Guadalupe County has an emergency operations center at their new jail and they held a ceremony today. Employees parking on the grass behind the Municipal Complex bugs him, and his suggestion is to assign parking spots. Mr. Marquez advised him there are plans to pave the area. Police Chief Steve Cantrell introduced two new communications employees - Michelle Lopez and Deborah Hood. Council welcomed them aboard. #3 APPROVAL OF MINUTES: Regular Session 10-15-02 Special Workshop Session 10-30-02 Regular Session 11-05-02 Special Workshop Session 11-13-02 Regular Session 11-19-02 Special Workshop Session 11-27-02 Regular Session 12-03-02 Mr. CJreenwald moved to approve the minutes, as written, for the Regular Session of 10-15-02, the Special Workshop Session of 10-30-02, the Regualar Session of 11-05-02, the Special Workshop Session of 11-13-02, the Regular Session of 11-19-02, the Special Workshop Session of 11-27-02 and theRegular Session of 12-03-02. Mr. Simonson seconded the motion, which carried with the following votes: AYES: Councilmembers Simonson, Ague, Wilenchik and Greenwald. NAYS: None. /b4 BID AWARD: Consider and take action awarding bid for uniforms. Mr. Marquez reminded Council this is the first of three (3) phases. This bid is for uniforms for Public Works. 79 Mrs. Agee moved to award the bid for uniforms for Public Works to Unifirst in the amount of $210.75 per week. Mr. Greenwald seconded the motion, which carried with the following votes: AYES: Councilmembers Simonson, Agee, Wilenchik and Greenwald. NAYS: None. #5 ORDINANCE: Consider and take action approving first reading of Solicitor's Ordinance. Mayor Baldwin introduced an Ordinance and read the caption as follows: AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTXZ, TEXAS REPEALING CHAPTER 13 OF THE CODE OF ORDINANCES OF THE CITY OF SCHERTZ, RELATING TO PEDDLERS, SOLICITORS AND ITINERANT MERCHANTS WITHIN THE CITY OF SCHERTZ AND REPLACING WITH A NEW CHAPTER 13, PEDDLERS AND SOLICITORS; PROVIDING A PENALTY CLAUSE; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Mr. Greenwald moved to approve the first reading of an Ordinance pertaining to Peddlers and Solicitors. Mr. Wilenchik seconded the motion, which carried with the following votes: AYES: Councilmembers Simonson, Agee, Wilenchik and Greenwald. NAYS: None. #6 APPOINTMENTS: Consider and take action appointing Schertz Parkway Zone Board members. Mr. Simonson moved to appoint Gerald Bethke, Charles Sharpe and Fred Juarez to the Schertz Parkway Zone Board. Mr. Greenwald seconded the motion, which carried with the following votes: AYES: Councilmembers Simonson, Agee, Wilenchik and Greenwald. NAYS: None. #7 Discussion and action regarding upcoming meetings. Mr. Marquez mentioned the next workshop session would normally fall on January 1st. He suggested Council might want to cancel that meeting since it's New Year's Day. 8O Mr. Greenwald moved to cancel the workshop session on January 1, 2003. Mr. Simonson seconded the motion, which carried with the following votes: AYES: Councilmembers Simonson, Agee, Wilenchik and Greenwald NAYS: None. #8 Consider and take action setting a public hearing date for a change to the UDC, Article IV, Permissible Uses. Mr. Marquez explained this deals with changes relating to Sexually Oriented Businesses and zoning changes from General Business (GB) to Light Industrial (M-l). The changes to the UDC will correlate with the Sexually Oriented Business Ordinance already passed. Mr. Greenwald mentioned that Corpus Christi is being challenged on a similar situation. Mayor Baldwin asked the City Secretary about a recommended date for the public hearing and she recommended January 21, 2003. Mr. CJreenwald asked if the City has to resend notices on behalf of Council and when told they do, recommended they translate the legalese into English so people can understand it. Mr. Simonson moved to set the public hearing date for a change to the UDC, Article IV, and Permissible Uses for January 21, 2003. Mrs. Agee seconded the vote, which carried with the following votes: AYES: Councilmembers Simonson, Agee, Wilenchik and Greenwald. NAYS: None. #9 Items by City Manager General Announcements Advised Council they have a copy of the Annual Report for the City of Schertz in their packets. It was prepared by Minter & Associates. #10 Items by Council General Announcements Councilmember Simonson 4-B Board Liaison BVYA Mr. Simonson had nothing to report. 81 Councilmember Agee 4-B Board Liaison Schertz Housing Authority Liaison Schertz Library Board Mrs. Agee had nothing to report. Councilmember Wilenchik 4-B Board Liaison Schertz Humane Society Liaison HOA Coalition Mr. Wilenchik reported the Humane Society is having its Christmas party next door at the Community Center as we speak. Everyone is invited. Councilmember Greenwald 4-B Board Ex-officio P&Z Commission Ex-officio SSLG Corp. Mr. Greenwald announced the Schertz/Seguin Local Government Corporation would hold its monthly meeting this Thursday in the City of Schertz Police Conference Room at 1:30 p.m. He doesn't know of anything exciting that will be happening. Kamon Cook, who was in the audience and is the Vice-President of the Corporation, said the only exciting thing would be if they let him speak. #11 Items by Mayor General Announcements In reference to the Schertz/Seguin Local Government Corporation, Mayor Baldwin jokingly commented he needs a new water heater, but he's not buying one until the City has soft water. He then wished everyone a Merry Christmas and a happy New Year. #12 EXECUTIVE SESSION: Called under Chapter 551, Texas Government Code: (a) Sub-Section 551.071, Consultation with Attorney pending contemplated litigation (b) Sub-Section 551.072, Deliberation regarding real property Council took a very short break and then moved to the Conference Room where an Executive Session was held fi.om 7:36 p.m. until 8:45 p.m. After the Executive Session, Council moved back to the Council Chambers and reopened Item #7 on the agenda - discussion and action regarding upcoming meetings. 82 They decided to schedule a Special Meeting at 7:00 pm.on Monday, December 30, 2002 for the purpose of discussing and possibly approving annexation. Mrs. Agee moved to schedule a Special Meeting on Monday, December 30, 2002 at 7:00 p.m. Mr. Simonson seconded the motion, which carried with the following votes: AYES: Councilmembers Simonson, Agee, Wilenchik and Greenwald. NAYS: None. #13 Action, if any, on above Executive Session. There was no action required. #14 ADJOURNMENT Before adjournment, Mayor Baldwin announced there would be a farewell party for James S agebiel from 11:00 a,m until 3 ~00 p,m on December 20tk He also announced the dedication of the Herb Rehman Complex at the school district Central Office on December 18tk Mayor Baldwin then adjourned the meeting at 8:$0 p.~.
