Minutes Planning and Zoning Commission August 13, 2014 Page I of 5 Mr. Cox presented this item by stating that the Applicant is proposing to replat Block 18, Lot 1 of Kensington Ranch Estates Subdivision Unit 1 into seventeen (17) buildable lots and seven (7) common open space /drainage lots. The property is located in the Kensington Ranch Estates Planned Development District zoning. A public hearing notice was published in "The Daily Commercial Recorder" on July 28, 2014 and in the "Herald" on July 30, 2014. There were twenty nine (29) notices mailed to surrounding property owners on July 25, 2014. At the time of this meeting fourteen (14) responses from property owners within the 200 foot notification boundary were received, twelve (12) responses were opposed to the request, two (2) responses were in favor of the request, and no responses were neutral to the request. Mr. Evans closed the Public Hearing at 7:00 P.M. Mr. Crawford asked Ms. Moore to show the pictures of the 2009 flooding. Mr. Evans stated that the photos show where the culvert water drains to Schertz Parkway, and that the entry into the creek had been blocked and has been corrected. Mr. Brand asked Mr. Dice if the area proposed for the park is in Selma or Schertz. Mr. Dice answered that it is in the City of Selma and will be an HOA park. Mr. Brand asked about access to the HOA park. Mr. Dice answered that access would be through a public right -of -way and sidewalks. The new lots being created are Lots 3 (18.67 acres) & 4 (90.402 acres). The property is zoned Manufacturing A public hearing notice was published in "The Daily Commercial Recorder" on July 28, 2014 and in the "Herald" on July 30, 2014. `here were thirteen (13) notices mailed to surrounding property owners on July 25, 2014. At the time of this staff report four (4) responses from property owners within the 200 foot notification boundary were received, all four (4) responses were in favor of the request. The final plat of Enterprise Industrial Park Subdivision was approved on May 28, 2008 by the Planning and Zoning Commission. The plat was amended on August 30, 2013 to adjust the lot line between Lots i & 2, add a fourteen foot (14') CPS easement and correct the FEMA floodplain. The subject property is generally located on the north side of the intersection of Schertz Parkway and Lookout Road. The subject property is currently undeveloped. This development is designed to have two (2) points of access off of Lookout Road through variable width ingress - egress easements. The tree affidavit submitted indicates that there are no protected or heritage trees on the site. The site is serviced by Schertz water and sewer, CPS, AT &T, and Time Warner Cable. The applicant is responsible for all drainage associated with the subject property, and for compliance with the Storm Water regulations. The City Engineer has reviewed and approved a storm water plan for the subject tract. No roadway improvements or ROW dedications are required. BACKGROUND: The Planning and Zoning Commission approved the master plan on April 27, 2011 and subsequently approved an amended master plan on October 26, 2011. A preliminary plat for the entire 23 lot subdivision was approved on March 14, 2012 by the Planning and Zoning Commission. A six month extension for the preliminary plat was granted on March 12, 2014 by the Planning and Zoning Commission and expires on September 14, 2014. ITEM SUMMARY: The applicant is proposing to final plat approximately one (1) acre of land establishing one (1) commercial lot. The subject property is zoned Manufacturing -Light (M -1). The applicant is seeking approval of a waiver to install an on -site sewage facility (OSSF) on Block 1, Lot 15 because of the lengthy distance to the nearest sewer line and costs associated with building and connecting to that line. GENERAL LOCATION AND SITE DESCRIPTION: The subject property is generally located on Lower Seguin Road approximately 1800 feet northeast of the intersection of Lower Seguin and Loop 1604. The site is currently undeveloped. PUBLIC IMPROVEMENTS: The applicant is seeking approval of a waiver for Block 1, Lot 15 to have privately owned On -Site Sewage Facility (OSSF) which are regulated by Bexar County. The site is located within the San Antonio River Authority's (SARA) Certificate of Convenience and Necessity (CCN). In accordance with UDC, Article 15 Easements and Utilities, Sec. 21.15.3.13, Wastewater System, all lots, tracts and parcels on which the development is proposed shall be connected to a public wastewater system. Furthermore, the UDC, Article 12 Subdivisions, Sec. 21.12.2.D. requires that all land subdivided or platted shall comply in full with the requirements of this UDC. Based on the requirements of the UDC not connecting to a public wastewater system and installation of OSSF requires a waiver to be granted by the Planning and Zoning Commission as prescribed in Sec. 21.12.15 Waivers. The UDC authorizes the Planning and Zoning Commission to grant waivers to the provisions in Article 12 when undue hardship will result from requiring strict compliance. STAFF ANALYSIS AND RECOMMENDATION: The applicant is requesting a waiver to the requirement for connection to a public waste water system to allow a privately owned on -site sewage facility (OSSF) at Block 1, Lot 15. Currently, the closest existing sewer line to the subject property, serving in the City of Schertz, is located at the intersection of FM 1518 and Lower Seguin Road. The sewer line would be required to extend approximately 12,700 feet along Lower Seguin Road to reach the subject property. The Project Engineer estimates the cost at approximately $1,256,000 to extend the sewer main from its current location on Lower Seguin Road and FM 1518 to the subject property. This extension would include the installation of a thirty two (32) manholes and trenching of the sewer line through a thirty foot (30') high point. The subject property is at an elevation of 696 foot which is six feet (6) lower than the Lower Seguin and FM 1518 intersection which is at an elevation of 702 foot. Due to the site's proximity to the City of Converse and the topography providing more favorable conditions for gravity flow, the Public Works Department inquired with the City of Converse about the possibility of this area tying into Converse's sewer system. Public Works has indicated that the City of Converse does not have the capacity to serve this area of the Schertz at this time. The applicant has provided a letter dated January 23, 2014 from the Bexar County Environmental Engineer stating that the proposed lot meets the minimum requirements for an OSSF in Bexar County. Staff recommends approval of the waiver based on the distance to the sewer connection. The granting of this waiver will not have a negative impact on existing or proposed municipal infrastructure. Additionally granting of this waiver will not be detrimental to the public health, safety or welfare, or be injurious to other property in the area. Planning Department Recommendation X Approve as submitted Approve with conditions* Denial * While the Commission can impose conditions; conditions should only be imposed to meet requirements of the UDC. COMMISSIONERS CRITERIA FOR CONSIDERATION: In considering final action on waivers to the UDC, the Commission should consider the criteria within the UDC: Section 21.12.15 Waivers A. General The Planning and Zoning Commission may authorize waivers from the provisions of this Article when, in its opinion, undue hardship will result from requiring strict compliance. In granting a waiver, the Planning and Zoning Commission shall prescribe only conditions that it deems necessary or desirable to the public interest. In making their findings, the Planning and Zoning Commission shall take into account the nature of the proposed use of the land involved and existing uses of land in the vicinity, the number of persons who will reside or work in the proposed subdivision, and the probable effect of such waivers upon traffic conditions and iN upon the public health, safety, convenience, and welfare in the vicinity. Waivers shall not be granted unless the Planning and Zoning Commission finds: 1) That the granting of the waiver will not be detrimental to the public health, safety, or welfare, or injurious to other property in the area; and 2) That the granting of the waiver will not have the effect of preventing the orderly subdivision of other land in the area in accordance with the provisions of this UDC. Such findings of the Planning and Zoning Commission, together with the specified facts upon which such findings are based, shall be incorporated into the official minutes of the Planning and Zoning Commission meeting at which such waiver is granted. Waivers may be granted only when in harmony with the general purpose and intent of this UDC so that the public health, safety, and welfare may be secured and justice done. B. The Planning and Zoning Commission may establish a time period for execution of each granted waiver. C. Such findings together with the specific facts on which such findings are based shall be incorporated into the official minutes of the Planning and Zoning Commission meeting at which such exception is granted. D. Planning and Zoning Commission shall not authorize a waiver that would constitute a violation of a valid law, ordinance, code or regulation of the City. E. Any decision of the Planning and Zoning Commission regarding waivers to the provisions of this Article may be appealed to the City Council. When considering an appeal, the City Council shall consider the same standards as the Planning and Zoning Commission as outlined above. We have coordinated with the City of Schertz Public Works Department, and there are no City of Schertz public sanitary sewer lines in the vicinity of this tract. The Owner of this tract proposes to provide an OSSF in accordance with Bexar County Regulations. Attached for you reference is the Bexar County Plat Approval Letter. After researching the location of the nearest public sewer main, the closest City of Schertz public sewer main is located approximately 2.4 miles at the Lower Seguin Road and FM 1518 intersection. The connection to the existing sewer line would requite approximately 12,700 feet of new sewer line running from Lot 15 in a northeasterly direction along Lower Seguin Road toward the FM 1518 and Lower Seguin Road intersection. The Lot 15 site is at elevation 696, The Lower Seguin Road and FM 1518 intersection is at elevation 702, The proposed sewer tie-in location at a higher elevation that the Lot 15 site. The proposed gravity sewer line extension would also require trenching through a 30 -ft high point at elevation 726. Extending a gravity sewer line from Lot 15 to the Lower Seguin Road and FM 1518 would cost approximately 1256000. Below is a breakdown of the cost estimate: 8" PVC Gravity Sanitary Sewer = (12,700 U @ $80.00/11.) = $1,016,000 32 Sanitary Sewer Manholes (assume 400-ft spacing) @ $7,500/each = $240,000 Total = 51,256,00 0 The large sum required to extend the sanitary sewer line would be a substantial burden on the owner of Lot 15. A six month extension for the preliminary plat was granted on March 12, 2014 by the Planning and Zoning Commission and expires on September 14, 2014. ITEM SUMMARY: The applicant is proposing to final plat approximately one (1) acres of land establishing one (1) commercial lot. The subject property is zoned is Manufacturing -Light (M -1). GENERAL LOCATION AND SITE DESCRIPTION: The subject property is generally located on Lower Seguin Road approximately 1800 feet northeast of the intersection of Lower Seguin and Loop 1604. ACCESS AND CIRCULATION: The subject property has frontage on Lower Seguin Road and has an existing a 50 foot egress and ingress easement which will provide future cross access and circulation to adjacent lots. TREE MITIGATION AND PRESERVATION: The applicant is responsible for complying with Unified Development Code (UDC), Section 21.9.9 Tree Preservation and Mitigation. The tree affidavit submitted indicates that no protected or heritage trees will be removed from this site. The tree affidavit has been reviewed and verified by the Parks, Recreation and Community Services department. PUBLIC SERVICES: The site is serviced by Schertz water, CPS, CenterPoint Energy, AT &T, and Time Warner Cable. PUBLIC IMPROVEMENTS: All public improvements required for this subdivision are required to be installed prior to recording of the final plat of each Unit per UDC, Section 21.4.15., unless otherwise specified in an approved development agreement. Water: This site will be serviced through an 8" water line that will be extended down Lower Seguin Road. Sewer: This site is not currently serviced by a public wastewater system. The applicant is requesting a waiver to allow the lot to be served by an On -site sewage facility (OSSF). Drainage: The applicant is responsible for all drainage associated with the subject property, and for compliance with the Storm Water regulations. A drainage report has been reviewed and approved by the City Engineer. The City Engineer has reviewed and approved a storm water plan. Sidewalks Hike and Bike Trails: Sidewalks will be constructed along Lower Seguin Road. The sidewalk will be designed to meet the City of Schertz specifications. Road Improvements: All streets will be developed to City of Schertz specifications. The subject property is located adjacent to Lower Seguin Road, which is identified on the Master Thoroughfare Plan as a 60 foot Right - of -Way. The applicant will be constructing all the required improvements including curb, gutter and sidewalks along Lower Seguin Road. Construction plans for all public improvements have been submitted and approved by Public Works and Engineering. Malpez Survey No. 67, Abstract No. 221, City of Schertz, Guadalupe County, Texas, generally located northwest of the intersection of Live Oak Road and Schertz Parkway. APPLICATION SUBMITTAL DATE: April 28, 2014 (Original Application) May 30, 2014 (Revised Submittal) August 15, 2014 (Revised Submittal) August 25, 2014 (Revised Submittal) BACKGROUND: A master plan for the subject property was approved by the Planning and Zoning Commission on May 24, 2005. The Commission approved the preliminary plat for Unit 1 on April 25, 2007 and the final plat was approved on July 25, 2007. The approved final plat expired on July 25, 2009. A new master plan and preliminary plat for this subdivision was approved by the Commission on October 12, 2011. The master plan and preliminary plat expired on October 12, 2013. ITEM SUMMARY: The applicant is proposing to preliminary plat approximately 34 acres of land establishing 84 single family residential lots, two (2) drainage lots, and three (3) landscape lots. The zoning for the subject tract is Single Family Residential District -6 (R -7) with a minimum lot size of 6,600 square feet. Side yard setbacks are established at ten feet (10'). GENERAL LOCATION AND SITE DESCRIPTION: The subject property is located generally southwest of the intersection of Live Oak Road and Schertz Parkway. ACCESS AND CIRCULATION: The UDC, Article 14, requires that all residential subdivisions have a minimum of two (2) locations accessing existing public streets. This development is designed to have two (2) points of access through the extension of Live Oak Road. The Master Thoroughfare Plan (MTP) identifies Live Oak Road being extended from the intersection at Schertz Parkway northwest along the edge of the Dietz Creek and intersecting with Maske Road. Until the remaining portion of the Live Oak Road extension is completed a thirty (30) foot emergency access easement will serve as an additional access point for emergency situations. TREE MITIGATION AND PRESERVATION: The applicant is responsible for complying with Unified Development Code (UDC), Section 21.9.9 Tree Preservation and Mitigation. The tree affidavit submitted indicates that no protected or heritage trees will be removed from this site. The tree mitigation and preservation plan will be reviewed by Parks and Community Services department prior to approval of the final plat. PARKS: There is no parkland being proposed with this subdivision. The Parks, Recreation and Community Services Department has determined that a fee -in lieu of parkland dedication in the amount of $1000 per dwelling unit will be paid by the Developer prior to recording of the final plat. This application was reviewed under UDC, Ordinance 11 -S -15 with amendments. PUBLIC SERVICES: The site is serviced by Schertz water and sewer, GVEC, CenterPoint Energy, AT &T, and Time Warner Cable. PUBLIC IMPROVEMENTS: All public improvements required for this subdivision are required to be installed prior to recording of the final plat of each Unit per UDC, Section 21.4.15., unless otherwise specified in an approved development agreement. The civil construction plans must be reviewed and approved by the Public Works and Engineering Departments prior to approval of the final plat. Water and Sewer: This site is serviced through 8" water lines and 8" sewer lines that will be extended throughout the subdivision. Drainage: The applicant is responsible for all drainage associated with the subject property and for compliance with the Storm Water regulations. A drainage report has been reviewed and approved by the City Engineer. The City Engineer has granted a waiver to onsite detention based on storm water calculations proving that there is no adverse effect created by releasing storm water into the Dietz Creek channel. Additionally, approximately 10 acres of drainage ROW will be dedicated to the City for improvements to the channel. Sidewalks Hike and Bike Trails: Sidewalks will be constructed along both sides of the street throughout the subdivision and along the Live Oak Road Extension. All sidewalks will be designed to meet the City of Schertz specifications. Road Improvements: All streets will be developed to City of Schertz specifications. A 60' ROW dedication has been provided for the extension of Live Oak Road from Schertz Parkway to the end of the proposed subdivision. Construction plans for all public improvements will be submitted and approved by Public Works and Engineering prior to approval of the final plat. 1.
