The property is specifically Lot 2, Block 13 of the Verde Enterprise Business Park, Unit 11 subdivision and generally located on Schertz Parkway approximately 250 feet north of the intersection of Schertz Parkway and IH -35 in the City of Schertz, Guadalupe County, Texas. GENERAL INFORMATION: Owner /Applicant: Blanco Business Center LP, Sanjay Misra Proiect Engineer: neer: GMK Engineers LLC, Jim Clements APPLICATION SUBMITTAL DATE: December 3, 2015 (Original Application) December 28, 2015 (Revised Application) PUBLIC NOTICE: Five (5) public hearing notices were mailed to surrounding property owners on December 30, 2015 with a public hearing notice to be published in "The Daily Commercial Recorder" and the "Herald" prior to the City Council public hearing. At the time of this staff report no responses have been received. ITEM SUMMARY: The applicant is proposing to rezone approximately 2.1 acres of land in the Verde Enterprise Business Park Planned Unit Development (PUD) Ordinance 07 -S -14A to Planned Development District (PDD). The Verde Enterprise Business Park PUD Ordinance 07 -S -14A was approved by City Council on March 6, 2007 to allow a mix of commercial and industrial uses. The request is to develop Lot 2, Block 13 of Unit 11 in accordance with the existing PUD Ordinance 07 -S -14A with the exception to the building setback adjacent to property located outside that is commercial or industrial. LAND USES AND ZONING: Subject Property: Zoning Land Use Planned Unit Development (PDD) Undeveloped d Planned Development District (PDD) Commercial / Hotel Adjacent Properties: Zoning North Right -of -Way (ROW) and Planned Development District (PDD) South Planned Development District (PDD) East Right -of -Way (ROW) and Planned Development District (PDD) West Right -of -Way (ROW) and City of Selma Commercial Zoninq Land Use Schertz Parkway and Undeveloped Bank Schertz Parkway and Hospital Journeys Way and Church GENERAL LOCATION AND SITE DESCRIPTION: The subject property is an approximately 2 acre tract of land that is located on Schertz Parkway approximately 250 feet north of the intersection of Schertz Parkway and IH -35. The property is currently undeveloped. PROPOSED ZONING: The request is to rezone the subject property generally to modify the development standards to change the setbacks for buildings from a perimeter lot line or property outside of the PUD from 50' to 20'. The subject property shall develop in accordance with the regulations of Ordinance 07 -S -14A except as follows: PA_ 1LTI14i !1111,14ki k &12 %10167iTiILTI14 aT1W- 11*r_1111 7AT141 4 aLTI14i•II Wi f_1i•117_17 A.1 Building Setback All buildings shall have a setback of at least twenty feet (20') from a perimeter lot line of property outside of the PUD. [7.9A(c)]. STAFF ANALYSIS AND RECOMMENDATION: Staff recommends approval of the zoning request. Staff has reviewed the request and is of the opinion that that proposed zoning request will be compatible with the surrounding adjacent land uses. It is unclear why the PUD was written to have a greater setback adjacent to commercial or industrial uses when the current zoning of General Business (GB) for the adjacent property located outside the PDD has a minimum side yard setback of zero (0). Planning Department Recommendation X Approve as submitted Approve with conditions* Denial * While the Commission can impose conditions; conditions should only be imposed to meet requirements of the UDC. COMMISSIONERS CRITERIA FOR CONSIDERATION: The Planning and Zoning Commission is making a recommendation to City Council on the propose zoning application. In considering action on a zoning application, the Commission should consider the criteria within UDC, Section 21 .5.4 D. Attachments: Aerial Map PDD Document Ord. Malpez Survey No. 67, Abstract No. 221, City of Schertz, Guadalupe County, Texas, generally located northwest of the intersection of Live Oak Road and Schertz Parkway. Owner/ Applicant: Burkett Live Oak LTD, James Horne Owner/ Applicant: JWD Management Corporation, James Horne Project t Engineer: KFW Engineers and Surveying, Bobby Torres, P.E. August 10, 2015 September 8, 2015 December 14, 2015 January 6, 2016 (Original Application) (Revised Submittal) (Revised Submittal) (Revised Submittal) BACKGROUND: The Commission has approved two (2) master plans and associated plats for the subject property between 2005 and 2011 and those approved applications have expired. On September 24, 2014 a preliminary plat and a waiver for access was approved by the commission. ITEM SUMMARY: The applicant is proposing to preliminary plat approximately 35 acres of land establishing 84 single family residential lots. The zoning for the subject tract is Single Family Residential District -7 (R -7) which consists of a minimum lot size of 6,600 square feet, front yard setback of 25 feet, rear yard setback of 20 feet and side yard setback of 10 feet. GENERAL LOCATION AND SITE DESCRIPTION: The subject property is located generally southwest of the intersection of Live Oak Road and Schertz Parkway. ACCESS AND CIRCULATION: The UDC, Article 14, requires that all residential subdivisions have a minimum of two (2) locations accessing existing public streets. This development is designed to have two (2) points of access through the extension of Live Oak Road and from Mare Way which is being established with the replat of Cottonwood 11 subdivision. The Master Thoroughfare Plan (MTP) identifies Live Oak Road as a collector class roadway 60' wide right of way. The MTP shows Live Oak Road being extended from the intersection at Schertz Parkway northwest along the edge of the Dietz Creek and intersecting with Maske Road. The connecting section of Mare Way must be constructed and accepted by the City and the replat of Cottonwood II subdivision must be recorded before a final plat of Bindseil Farms will be recorded. TREE MITIGATION AND PRESERVATION: The applicant is responsible for complying with Unified Development Code (UDC), Section 21.9.9 Tree Preservation and Mitigation. The tree affidavit submitted indicates that no protected or heritage trees will be removed from this site. The tree mitigation and preservation plan will be reviewed by Parks and Community Services department prior to approval of the final plat. PARKS: There is no parkland being proposed with this subdivision. The Parks, Recreation and Community Services Department has determined that a fee -in lieu of parkland dedication in the amount of $1000 per dwelling unit will be paid by the Developer prior to recording of the final plat. This application was reviewed under UDC, Ordinance 11 -S -15 with amendments. PUBLIC SERVICES: The site is serviced by Schertz water and sewer, GVEC, CenterPoint Energy, AT &T, and Time Warner Cable. PUBLIC IMPROVEMENTS: All public improvements required for this subdivision are required to be installed prior to recording of the final plat per UDC, Section 21.4.15., unless otherwise specified in an approved development agreement. The civil construction plans must be reviewed and approved by the Public Works and Engineering Departments prior to approval of the final plat. Water and Sewer: This site is serviced through 8" water lines and 8" sewer lines that will be extended throughout the subdivision. Drainage: The applicant is responsible for all drainage associated with the subject property and for compliance with the Storm Water regulations. A drainage report has been reviewed and approved by the City Engineer. The City Engineer has granted a waiver to onsite detention based on storm water. The project engineer has demonstrated that that there is no adverse effect created by releasing storm water into the Dietz Creek channel. Additionally, approximately 10 acres of drainage ROW will be dedicated to the City. Sidewalks Hike and Bike Trails: Sidewalks will be constructed along both sides of the street throughout the subdivision and along the Live Oak Road Extension. All sidewalks will be designed to meet the City of Schertz specifications. Road Improvements: All streets will be developed to City of Schertz specifications. A 60' ROW dedication has been provided for the extension of Live Oak Road from Schertz Parkway to the limits of the proposed subdivision. Construction plans for all public improvements will be submitted and approved by Public Works and Engineering prior to approval of the final plat. STAFF ANALYSIS AND RECOMMENDATION: The preliminary plat is consistent with applicable requirements for the property, ordinances and regulations. Staff recommends approval of the preliminary plat as submitted. Planning Department Recommendation X Approve as submitted Approve with conditions* N Denial * While the Commission can impose conditions; conditions should only be imposed to meet requirements of the UDC. COMMISSIONERS CRITERIA FOR CONSIDERATION: The Planning and Zoning Commission is the final approval authority of the preliminary plat. In considering final action on a preliminary plat, the Commission should consider the criteria within UDC, Section 21.12.8 D.
