PC2016 -021 Consider and act upon a request for approval of a final plat and vacation of a 16' sanitary sewer easement for the Misty Woods Subdivision consisting of 12.14 acres, located on Schertz Parkway approximately 770 feet north of Live Oak Road. 4. PUBLIC HEARING: The Planning and Zoning Commission will hold a public hearing related to zone change requests and replats within this agenda. The public hearing will be opened to receive a report from staff, the applicant, the adjoining property owners affected by the applicant's request, and any other interested persons. Upon completion, the public hearing will be closed. The Commission will discuss and consider the application, and may request additional information from staff or the applicant, if required. After deliberation, the Commission is asked to consider and act upon the following requests and make a recommendation to the City Council if necessary. A. Planning & Zoning April 27, 2016 Page 2 of 2 • TO: Planning and Zoning Commission 1 • • CASE: PC2016 -021 Misty Woods Subdivision — Final Plat Subject: Consider and act upon a request for approval of a final plat and vacation of a 16' sanitary sewer easement for the Misty Woods Subdivision consisting of 12.14 acres, located on Schertz Parkway approximately 770 feet north of Live Oak Road. GENERAL INFORMATION Owner /Applicant: Car Wash Partners, LTD, Randy Dym Project Engineer: Don McCrary and Associates, Sammy Flores BACKGROUND: The Planning and Zoning Commission approved the preliminary plat on May 9t", 2012. A final plat was approved by the Commission on September 12, 2012, and a revised final plat was approved administratively on May 1, 2013. The approved final plat expired on May 1, 2015. APPLICATION SUBMITTAL DATE: ITEM SUMMARY: April 20, 2016 (Original Application) This item considers a final plat for Misty Woods Subdivision and includes a vacation of a 16' sanitary sewer easement as part of this plat. The subject property, owned by Car Wash Partners LTD is approximately 12.14 acres. This plat creates 36 residential lots in three blocks. GENERAL LOCATION AND SITE DESCRIPTION: This tract is in the T. Herrera Survey No. 153, City of Schertz, Guadalupe County, Texas and is generally located on Schertz Parkway approximately 770 feet north of Live Oak Road. ACCESS AND CIRCULATION: Access to the proposed neighborhood will be from Schertz Parkway and Mesa Verde through the existing Mesa Oaks subdivision. TREE MITIGATION AND PRESERVATION: The applicant will be responsible for complying with the Unified Development Code (UDC), Section 21.9.9 Tree Preservation and Mitigation. Tree mitigation fees have been paid in full - $3,200 was paid on January 29, 2014 and an additional $9,000 was paid on December 21, 2015 for removal of a heritage tree damaged during construction. PARKS: The developer will pay parkland fees in the amount of $36,000 in lieu of dedication and development with the recording of the final plat. PUBLIC SERVICES: This site is serviced by Schertz water and sewer, AT &T, GVEC and Time Warner. PUBLIC IMPROVEMENTS: Water and Sewer: Construction of 8" water lines and 8" sewer lines to service the subdivision has been completed and tied in. There is an existing 16' sewer easement containing a 10" sewer line that is being vacated through this plat. This line will be replaced with a new 10' sewer easement as shown on the plat containing a 12" sewer line which will tie into an existing 16" sewer line on Schertz Parkway. Drainage: The applicant is responsible for all drainage associated with the subject property, and for compliance with the Storm Water regulations. A drainage report has been approved by the City Engineer. Hike and Bike Trail: Trails and sidewalks are planned for portions of Maske Road right -of -way. Ordinance number 12 -M -11 was approved by the City Council on May 8th, 2012 releasing approximately 0.24 acres of the right -of -way for the applicant to incorporate into residential Lots 10 through 14 of Block 3 and common Lot 15, Block 3. This ordinance shall be filed with the County prior to recording this plat. A portion of Maske Road has been set aside for a future hike and bike trail connecting Schertz Parkway and Live Oak Road. The Parks Department and the developer entered into an agreement (County Document No. 13- 010726) that states the developer will be responsible for developing and maintaining the trails as part of the City releasing a portion of Maske Road to the developer. Sidewalks: Sidewalks are required along Schertz Parkway. Sidewalks will be constructed along both sides of the street throughout the subdivision and are designed to meet the City of Schertz specifications. Additional Design Criteria: This property is adjacent to a principal arterial street ( Schertz Parkway) and as such must comply with additional design requirements of the UDC, Section 21.14.3: • A 20 -foot landscape buffer which includes 22 trees based on the 421.52 linear feet of frontage along Schertz Parkway. • The installation of an 8 -foot tall masonry wall shall be constructed prior to issuance of a Certificate of Occupancy on any homes. • A 50 -foot building setback line adjacent to Schertz Parkway. Public Infrastructure: The civil construction plans were approved by the Public Works and Engineering Departments. All street improvements are currently being constructed according to the Public Works Specifications Manual and are close to completion. The City has not yet accepted the improvements. STAFF ANALISYS: With the 2012 revised final plat, the developing engineer conducted a sight distance study and found that a clear line of sight easement is required along the 20' landscape easement on Schertz Parkway near the proposed Misty Cove intersection. The City engineer reviewed this study and approved the easement. There will be no obstructions permitted within this area; the installation of landscaping along Schertz Parkway will be provided by clustering the trees along the remainder of the right -of -way as approved by the Park and Recreation Department. 2 STAFF RECOMMENDATION: The plat was reviewed with no objections by the City Engineer, Public Works, Parks, Inspections, Fire and Police. Staff recommends approval.
