PUBLIC HEARING: A. PC2016 -006 Hold a public hearing, consider and act upon a request for approval of a replat of Verde Enterprise Business Park Unit 2, Lot 1, Block 9. The property consists of approximately 2.76 acres of land is more specifically described as being a portion of the Toribio Herrera Survey No. 68, Abstract No. 153, Guadalupe County, and being all of Lot 1, Verde Enterprise Business Park Unit 2, Recorded in Volume 7, Page 327, Map and Plat Records, Guadalupe County, Texas. The property is generally located on the North East corner of Mid- Cities Parkway and IH — 35. Ms. Grobe presented a request by the applicant to replat Lot 1, Block 9 of the Verde Enterprise Business Park into a total of two (2) buildable commercial lots, Lot 2 and Lot 3. The subject property is generally located at the Northeast corner of Mid — Cities Parkway and III -35. The proposed replat is consistent with all applicable zoning requirements for the property, ordinances, and regulations of the City. Mr. Richmond commented that it was the practice of the Commission to table action on agenda items when an applicant is not present at the meeting to answer questions. Hold a public hearing, consider and make a recommendation on an amendment of Part III, Schertz Codes of Ordinances, Unified Development Code (UDC), Article 9 Site Design Standards, Article 10 Parking Standards and Article 14 Transportation. Mr. James gave a(presentation on agenda item and explained the City of Schertz entered into an interlocal agreement with the Schertz Cibolo Universal City Independent School District (SCUCISD) to designate processes, procedures, and fee structures to streamline delivery of certain government functions and services in an efficient manner. The interlocal agreement included provisions to allow alternative landscaping, tree preservation and parking standards. Staff recommends approval of the amendments to the UDC. Mr. James proposed two minor revisions to the wording on page 9.24 to read "Where any nonresidential or multifamily use lot or parcel, except for schools is adjacent..." and on page 9.27 to read "All new residential and nonresidential development within the City except for public schools... ". Staff recommends approval of the waiver based on the distance required for a sewer connection. Mr. Greenwald and Mr. Crawford asked questions regarding the existing development to the north and east of the subject property, the current sanitary sewer in the area, and the City's plans for providing sewer in the future. Malpez Survey No. 67, Abstract No. 221, City of Schertz, Guadalupe County, Texas, generally located northwest of the intersection of Live Oak Road and Schertz Parkway. GENERAL INFORMATION: Owner/ Applicant: Jen Texas 18, LLC Project Engineer: KFW Engineering & Surveying, Burt Wellmann, P.E. ITEM SUMMARY: The applicant is proposing to final plat approximately 35 acres of land establishing 84 single family residential lots. The site is zoned Single - Family Residential (R -7). The applicant is seeking approval of a waiver, pursuant to Unified Development Code (UDC) Sec.21.12.15, from Sec.21.14.1.K regarding the construction of roadway improvements to Live Oak Road. GENERAL LOCATION AND SITE DESCRIPTION: The subject property is currently undeveloped and is generally located on the northwest corner of where Live Oak Road intersects with Schertz Parkway. PUBLIC IMPROVEMENTS: The applicant is seeking approval of a waiver to UDC Sec.21.14.1.K regarding the construction of roadway improvements to Live Oak Road. The City's Master Thoroughfare Plan (MTP) identifies Live Oak Road as a 60 -foot roadway that extends west of Schertz Parkway and connects to Maske Road. The applicant is providing a 60 -foot right -of -way dedication for the Live Oak Road extension and is requesting a waiver to construct only 862 linear feet out of the total of 1,978 linear feet of right -of -way dedication based on rough proportionality. In accordance with UDC, Article 4 Procedures and Applications, Sec. 21.4.15.E.1 Timing of Public Infrastructure Improvement Construction, requires the installation of all public improvements required to serve the subdivision before a final plat is recorded or the applicant can defer the obligation to install the public improvements conditioned on the execution of a subdivision improvement agreement and sufficient surety to secure the obligations defined in the agreement. Therefore, the construction or deferment of construction will need to be addressed during the platting and civil construction plan review and approval process if the City requires as a condition of approval, that the developer bear a portion of the costs of municipal infrastructure improvements by the making of dedications, the payment of fees, or the payment of construction costs. The developer's portion of the costs may not exceed the amount required for infrastructure improvements that are roughly proportionate to the proposed development as approved by a professional engineer who is licensed in the State of Texas, and is retained by the municipality. Furthermore, the UDC, Article 12 Subdivisions, Sec. 21.12.2.D. requires that all land subdivided or platted shall comply in full with the requirements of this UDC. The improvements to serve the subdivision are reviewed with the civil construction plans at the time of platting to assure that the division or development of land subject to the plat is consistent with all standards of this UDC pertaining to the adequacy of public facilities, that public improvements to serve the subdivision or development have been installed and accepted by the City or that provision for such installation has been made, that all other requirement and conditions have been satisfied or provided for to allow the plat to be recorded. In order to determine if the required improvements are roughly proportional, Staff and the applicant have agreed to utilize the City of San Antonio's methodology for evaluating rough proportionality. STAFF ANALYSIS AND RECOMMENDATION: The applicant has provided documentation demonstrating that construction of 862 linear feet of the Live Oak Road extension, along with improvements to the traffic signalization at the Schertz Parkway and Live Oak Road intersection will exceed the demand associated with the 84 residential lots that are part of the Bindseil Farms Subdivision. The cost of construction for roadway and traffic signal improvements has been reviewed and deemed roughly equivalent by the City Engineer. Staff has reviewed this request and supports this waiver. Staff recommends approval based on the calculations provided by the applicant for rough proportionality. COMMISSIONERS CRITERIA FOR CONSIDERATION: In considering final action on waivers to the UDC, the Commission should consider the criteria within the UDC: Section 21.12.15 Waivers A. General The Planning and Zoning Commission may authorize waivers from the provisions of this Article when, in its opinion, undue hardship will result from requiring strict compliance. In granting a waiver, the Planning and Zoning Commission shall prescribe only conditions that it deems necessary or desirable to the public interest. In making their findings, the Planning and Zoning Commission shall take into account the nature of the proposed use of the land involved and existing uses of land in the vicinity, the number of persons who will reside or work in the proposed subdivision, and the probable effect of such waivers upon traffic conditions and upon the public health, safety, convenience, and welfare in the vicinity. Waivers shall not be granted unless the Planning and Zoning Commission finds: 1) That the granting of the waiver will not be detrimental to the public health, safety, or welfare, or injurious to other property in the area; and 2) That the granting of the waiver will not have the effect of preventing the orderly subdivision of other land in the area in accordance with the provisions of this UDC. Such findings of the Planning and Zoning Commission, together with the specified facts upon which such findings iN are based, shall be incorporated into the official minutes of the Planning and Zoning Commission meeting at which such waiver is granted. Waivers may be granted only when in harmony with the general purpose and intent of this UDC so that the public health, safety, and welfare may be secured and justice done. B. The Planning and Zoning Commission may establish a time period for execution of each granted waiver. C. Such findings together with the specific facts on which such findings are based shall be incorporated into the official minutes of the Planning and Zoning Commission meeting at which such exception is granted. Planning and Zoning Commission shall not authorize a waiver that would constitute a violation of a valid law, ordinance, code or regulation of the City. D. Any decision of the Planning and Zoning Commission regarding waivers to the provisions of this Article may be appealed to the City Council. When considering an appeal, the City Council shall consider the same standards as the Planning and Zoning Commission as outlined above. The rough proportionality calculation submitted with the waiver request indicates that the amount of construction proposed by the developer along with the value of the right of way area being dedicated is roughly proportional to the demand that will be placed on the City's roadway system by the proposed subdivision. This is a valid justification for the waiver and approval of the waiver is recommended. No new half streets shall be platted that do not conform to the Master Thoroughfare Plan and the Comprehensive Land Plan. Where the proposed subdivision abuts upon an existing street or half street not conforming to the Comprehensive Land Plan requirements or the requirements of this UDC, the subdivider shall be required to dedicate any additional right -of -way to meet the street width required. 2. If new development of property that abuts City maintained roads does not meet the design or width standards in this UDC, the Developer shall be required to make the necessary dedication and improvements in conformance with this UDC or any other applicable code of the City. 3. The minimum dedication and construction costs shall be equal to one -half (112) of the minimum right -of -way (ROW) and construction costs associated with the proposed street 4. Improvements shall include right -of -way dedication, paving, curb and guttering, shoulder improvements and sidewalk as determined by the City. 5. Should any pavement be laid to widen existing pavement, the existing pavement shall be saw - cut back a minimum of two feet (2) to assure an adequate sub -base and pavement joint. The proposed Bindseil Farms Subdivision is located at the northwest corner of Schertz Parkway and Live Oak Road. The proposed subdivision will contain 84 residential lots. As part of the platting, process 2.678 acres will be dedicated to the City of Schertz as an extension of Live Oak Road along the existing Dietz Creek drainage channel. The dedicated R.O.W. will provide enough land for a total of 1,978 LF of roadway to be constructed. This dedication will include the entire frontage this project has along the R.O.W. for the future extension of Live Oka Road per the Master Thoroughfare Plan. The owner is requesting to construct 862 LF of the Live Oak Road extension at this time and the remaining; portion to be constructed at a later date at the expense of the City. The proposed 862 LF extension will have the Live Oak Road improvements end at Bindseil Creek, the entrance to the proposed neighborhood. The construction cost to extend Live Oak Road the entire 1,978 LF exceeds what is, per Texas Local Government Code, Section 212 .904, deemed roughly proportionate to the proposed subdivisions impact on the municipal infrastructure. A copy of the City of San Antonio's Rough Proportionality worksheet is attached. The worksheet calculates an impact (demand) of $291,616.00 and estimates the proposed public improvements to be $278,291. An actual cost :estimate -of $299,839.95 for the proposed extension has been provided by the Contractor performing the work and is attached to this request. Since the cost of proposed improvements exceed the impact of demand due to the subdivision; the owner requests that the proposed 862 LF extension of Live Oak Road, be acceptable to the City. On September 24, 2014 a preliminary plat and a waiver for access was approved by the Commission. On January 13, 2016 the Commission approved a new preliminary plat which revised the lot layout and added a second roadway access point off of Schertz Parkway, eliminating the need for the previously approved waiver. ITEM SUMMARY: The applicant is proposing to final plat approximately 35 acres of land establishing 84 single family residential lots. The zoning for the subject tract is Single Family Residential District -7 (R -7) which consists of a minimum lot size of 6,600 square feet, front yard setback of 25 feet, rear yard setback of 20 feet and side yard setback of 10 feet. GENERAL LOCATION AND SITE DESCRIPTION: The subject property is located generally northwest of the intersection of Live Oak Road and Schertz Parkway. ACCESS AND CIRCULATION: The UDC, Article 14, requires that all residential subdivisions have a minimum of two (2) locations accessing existing public streets. This development is designed to have two (2) points of access through the extension of Live Oak Road and from Mare Way which is a 50 -foot right -of -way (ROW) that was established with the replat of the Cottonwood II subdivision that was approved by the Commission on January 13, 2016. The Master Thoroughfare Plan identifies Live Oak Road as a collector class roadway that is 60 -foot wide. The Master Thoroughfare Plan shows Live Oak Road being extended from the intersection at Schertz Parkway northwest along the edge of Dietz Creek and intersecting with Maske Road. The connecting section of Mare Way must be constructed and accepted by the City and the replat of Cottonwood 11 subdivision must be recorded before the final plat of Bindseil Farms will be recorded. TREE MITIGATION AND PRESERVATION: The applicant is responsible for complying with Unified Development Code (UDC), Section 21.9.9 Tree Preservation and Mitigation. The tree affidavit submitted indicates that there are no protected or heritage trees on the property. PARKS: There is no parkland being proposed with this subdivision. The Parks, Recreation and Community Services Department has determined that a fee -in lieu of parkland dedication in the amount of $1,000 per dwelling unit will be paid by the Developer prior to recording of the final plat. This application was reviewed under UDC, Ordinance 11 -S -15 with amendments. PUBIC SERVICES: The site is serviced by Schertz water and sewer, GVEC, CenterPoint Energy, AT &T, and Time Warner Cable. PUBIC IMPROVEMENTS: All public improvements required for this subdivision are required to be installed prior to recording of the final plat per UDC, Section 21.4.15., unless otherwise specified in an approved development agreement. The civil construction plans has been reviewed and approved by the Public Works and Engineering Departments. Water and Sewer: This site is serviced through 8" water lines and 8" sewer lines that will be extended throughout the subdivision. Drainage: The applicant is responsible for all drainage associated with the subject property and for compliance with the Storm Water regulations. A drainage report has been reviewed and approved by the City Engineer. The City Engineer has granted a waiver to onsite detention based on the submitted drainage repot. The project engineer has demonstrated that that there is no adverse effect created by releasing storm water into the Dietz Creek channel. Additionally, approximately 10 acres of drainage ROW will be dedicated to the City. Sidewalks Hike and Bike Trails: Sidewalks will be constructed along both sides of the street throughout the subdivision. An 8' sidewalk will be constructed on the creek side along the Live Oak Road Extension and a 5' sidewalk will be constructed on the opposite side. All sidewalks will be designed to meet the City of Schertz specifications. Road Improvements: All streets will be developed to City of Schertz specifications.
