REGULAR MEETING
March 7, 2017
A Regular Meeting was held by the Schertz City Council of the City of Schertz, Texas, on March 7,
2017, at 6:00 p.m. in the Hal Baldwin Municipal Complex Council Chambers, 1400 Schertz Parkway,
Building #4, Schertz, Texas. The following members present to -wit:

Mayor Carpenter called the meeting to order at 6:00 p.m.

Councilmember Kiser provided the opening prayer followed by the pledges of allegiance to the flags
of the United States and the State of Texas.

Mayor Carpenter recognized each Department Director /Supervisor who provided a brief bio on each
of their new employees. The staff members were given a chance to say a few words if they wished.
Mayor and Council welcomed the new employees aboard.
Mayor Carpenter recognized current Planning & Zoning Commissioner and former Councilmember
Ken Greenwald who was in the audience this evening. Mayor Carpenter welcomed him back.

• Announcements and recognitions by City Manager (J. Kessel)
Mayor Carpenter recognized City manager John Kessel who stated he received a note from a
citizen commending Assistant Public Works Director Jimmy Hooks. Mr. Kessel stated that
the note says Mr. Hooks was on FM 3009 & FM 78 and noticed a dog running around;
normally people would just go on and not stop. Mr. Hooks corralled the dog and was able to
get it to its owner. Mr. Kessel read the note expressing her gratitude stating that he saved her
from a terrible loss and she appreciated his integrity.

- Lone Star Programing Award
Mayor Carpenter recognized Assistant Parks Director Lauren Shrum who provided
information on winning this award. This was for the submittal of `Trunk or Treat' and
`Movie in the Park' programs.
- Maintenance Award
Mayor Carpenter recognized Assistant Parks Director Lauren Shrum who provided
information on winning this award. She stated that this submittal was for the innovative
ways in which the Parks crew places our monument stones.
• Presentation regarding the City of Schertz support for the 7th Annual Selma/Schertz Salute To
Service Members 5K Operation Comfort Run. (Councilmembers Thompson/Gutierrez)
Mayor Carpenter recognized Councilmember Thompson and Councilmember Gutierrez who
presented Mayor Carpenter with the award. Councilmembers Thompson and Gutierrez stated
that they appreciated the joint efforts by the cities and especially participating in this great
event for our wounded soldiers.

Mayor Carpenter recognized Executive Director of Economic Development Kyle Kinateder
who provided Council with the 2016 Schertz Economic Development Corporation Annual
Report. Highlights included:
• SEDC Projects: David Lack Blvd. extension (GE Oil & Gas), 1300 Schertz Parkway,
Major Wire.
• Business Retention: Business Retention Manager, Schertz BRE Plan, Company Visits,
Workforce Initiatives.
• Recruitment: Website, Recruitment missions.
• Commercial Growth.
• Update on the FY 2016 Annual Development Incentive Compliance and Certification Process.

Mayor Carpenter recognized Executive Director of Economic Development Kyle Kinateder
who provided council with an update on the FY 2016 Annual Development Incentive
Compliance and Certification Process. Highlights included:

Hearing of Residents
This time is set aside for any person who wishes to address the City Council. Each person should fill
out the speaker's register prior to the meeting. Presentations should be limited to no more than 3
minutes.
All remarks shall be addressed to the Council as a body, and not to any individual member thereof.
Any person making personal, impertinent, or slanderous remarks while addressing the Council
may be requested to leave the meeting.
Discussion by the Council of any item not on the agenda shall be limited to statements of specific
factual information given in response to any inquiry, a recitation of existing policy in response to an
inquiry, andlor a proposal to place the item on a future agenda. The presiding officer, during the
Hearing of Residents portion of the agenda, will call on those persons who have signed up to speak in
the order they have registered.

Mayor Carpenter recognized the following who spoke:
• Mrs. Maggie Titterington, President of The Chamber, who provided thanks to all those that
volunteered and judged during their very successful `Taste' event. Ms. Titterington also
commented on the Economic Development Incentive item, requesting that possibility the city
could look into getting or proposing some incentives for the existing small businesses.
• Mr. Glen Outlaw, 3729 Forsyth Park, who spoke about the CIP increase for Councilmembers
pay, stating that Council should look into this as most employees only received a 2 percent
increase and that council, is receiving a 2.6 percent increase. He commented on the low
percentages that he received from other entities, again stating that they were much lower than
2 percent and would hope that they might follow up on the CIP rate increase.
Consent Agenda Items
The Consent Agenda is considered self - explanatory and will be enacted by the Council with one
motion. There will be no separate discussion of these items unless they are removed from the
Consent Agenda upon the request of the Mayor or a Councilmember.
1. Minutes — Consideration and/or action regarding the approval of the minutes of the Regular
Meeting of February 28, 2017. (J. Kessel/B. Dennis)
2. Ordinance No. 17 -M -10 — Consideration and/or action approving an Ordinance amending the
City of Schertz Code of Ordinances Chapter 24, Article 11, Food Establishments, Section 34-
22, regarding the adoption of the Texas Food and Beverage Establishment rule. Final
Reading (D. Wait/M. Harris /J. Hamilton)

AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS
AMENDING THE CITY OF SCHERTZ CODE OF ORDINANCES CHAPTER 34,
ARTICLE 11. FOOD ESTABLISHMENTS, SECTION 34 -22, REGARDNG THE
ADOPTION OF THE TEXAS FOOD AND BEVERAGE ESTABLISHMENT RULES;
REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
WITH THIS ORDINANCE; AND PROVIDING AN EFFECTIVE DATE
3. Boards, Committees and Commission resignations and appointments — Consideration
and/or action ratifying the resignation of Lisa Locken from the Parks & Recreation Board and
appointing Elizabeth Strong as a regular member to the Schertz Historical Preservation

Mayor Carpenter recognized Councilmember Thompson who moved, seconded by Mayor
Pro -Tern Edwards to approve consent agenda items 1 -3. The vote was unanimous with
Mayor Pro -Tem Edwards, Councilmembers Davis, Gutierrez, Larson, Thompson, Kiser
and Crawford voting for and no one voting no. Motion passed.

4. Ordinance No. 17 -C -06 — Conduct a Public Hearing and and/or action approving an
Ordinance amending the Schertz Code of Ordinances Chapter 18, Buildings and Building
PR Regulations, Article N, National Electrical Code, Section 18 -81, Article 210.52 Dwelling
Unit Receptacle Outlets (D) Bathrooms. First Reading (B. James /L. Wood/G. Durant)
The following was read into record:
ORDINANCE NO. 17 -C -06
AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS
AMENDING THE CODE OF ORDINANCES OF THE CITY OF SCHERTZ
CHAPTER 18, BUILDINGS AND BUILDING REGULATIONS, ARTICLE IV,
NATIONAL ELECTRICAL CODE, SECTION 18 -81. AMENDMENTS. 210.52
DWELLING UNIT RECEPTACLE OUTLETS (D) BATHROOMS.
Mayor Carpenter recognized Building Official Gil Durant who stated staff has determined a
need to revise the current building code, Chapter 18 Buildings and Building Regulation,
Section 18 -81 Amendments with regard to the separation of electrical outlets and showers and
bathtubs in residential bathrooms. The amendment proposed would allow switches and
receptacle outlets in a bathroom closer to a shower or bathtub provided certain safety
requirements are met.
Mayor Carpenter opened the public hearing and as no one spoke, closed the public hearing for
Council Comments. There were no comments from Council.
Mayor Carpenter recognized Councilmember Thompson who moved, seconded by Mayor
Pro -Tem Edwards to approve Ordinance No. 17 -C -06 first reading. The vote was unanimous
with Mayor Pro -Tem Edwards, Councilmembers Davis, Gutierrez, Larson, Thompson,
Kiser and Crawford voting for and no one voting no. Motion passed.
Roll Call Vote Confirmation
Mayor Carpenter recognized City Secretary Brenda Dennis who provided the roll call votes
for agenda items 1 -4.
Requests and Announcements
5. Announcements by City Manager.
Mayor Carpenter recognized City Manager John Kessel who stated that at the council dais,
there are packages regarding the upcoming YMCA re- enrollment.
6. Future Agenda Item Request for City Council: This is an opportunity for City Council
members to request that items be placed on a future agenda. No discussion of the merits of
the item may be taken at this time. Should a Council Member oppose placement of the

requested item on a future agenda, the Mayor, without allowing discussion, shall ask for the
consensus of . the other City Council members to place or not place the item on a future
agenda.
No requests were made.

Mayor Carpenter recognized Councilmember Thompson who commended the Public
Affairs Department, Linda, Mary, Natalie, Melissa and others who again ran a great
Wilenchik Walk for Life event this past Saturday. Councilmember Thompson commented
on the "Signs of Love" stating that these are hand made by staff.
