HEARING OF RESIDENTS: No one spoke. CONSENT AGENDA: A. PC2016 -041 Consider and act upon a request for approval of a final plat of Units 12A & B of the Verde Enterprise Business Park Subdivision, an approximately 9 acre tract of land situated in the Toribio Herrera Survey No. 68, Abstract No. 153, City of Schertz, Guadalupe County, Texas, generally located 600 feet east of the intersection of Schertz Parkway and IH -35. Richard Braud Mr. Crawford moved to approve the consent agenda. Mr. Dahle seconded the motion. The vote was unanimous, 6 -0. Motion carried. PUBLIC HEARING: A. Hold a public hearing on an ordinance imposing a moratorium on property development due to a need to prevent a shortage of essential public facilities generally in the area from IH -10 to approximately 2,000 feet North of Lower Seguin Road between FM 1518 and the western boundary of the City Limits. Mr. Richmond moved this agenda item to the end after agenda item 4C. Minutes Planning and Zoning Commission August 24, 2016 Page 1 of 5 Brian James described the background of the Texas Local Government Code, Section 212 Subchapter E Moratorium on Property Development. Mr. James discussed the process for establishing a moratorium and mentioned that in certain circumstances cities may impose a moratorium on property development in the event that there exists a demonstrated need to prevent a shortage of essential public facilities or a significant need for public facilities. Mr. James discussed that the City is experiencing tremendous growth in southern Schertz and the expectations for fire response time and emergency services. Brian James explained the goals and objectives of the City Comprehensive Land Plan including managing growth in a manner that allows services and facilities to keep pace throughout the community and explained the purpose of the moratorium. Mr. Richmond opened the public hearing at 7:10 P.M. Robert Brockman — 1000 Elbel — Asked to see a map of the area. Mr. Richmond closed the public hearing at 7:13 P.M. Mr. James displayed a map on the projector and verbally described the area. There was a discussion with the commissioners and Mr. James regarding the moratorium, the planned new fire station #3, Randolph Air Force Base, the JLUS recommendation, and development. There was no action required on the agenda item. B. ZC2016 -007 Hold a public hearing, consider and act upon a request to rezone approximately 88.85 acres of land from Pre- Development (PRE) to Planned Development District (PDD). The property is more specifically described as 88.85 acres of land situated in the Eligio Gortari Survey No. 2, Abstract No. 5, County Block 5193, City of Schertz, Bexar County, Texas, generally located approximately 1,375 feet southeast of the intersection of FM 1518 and Trainer Hale Road Channary Gould presented the project, which was a proposal to rezone approximately 90 acres of land from Pre - Development District (PRE) to Planned Development District (PDD) for the Hallies Cove development, which is a master planned community project that would include up to 147 single - family residential lots. The subject area is generally located on FM 1518 approximately 1,375 southeast of the intersection of FM 1518 and Trainer Hale Road. The development is proposed to consist of single family residential homes and public parkland. The subject property currently has a single family dwelling located on the property and the remainder is undeveloped. Staff recommends approval of the zoning request based on compliance with the Comprehensive Land Use Plan and the proposed cluster design concept and layout of the subdivision. Mr. Richmond opened the public hearing at 6:12 P.M. Andy Herrerra, 8215 Trainer Hale Road, inquired about fencing and staff confirmed the resident's location in relation to the property and informed the resident that staff will communicate with him if he has any additional questions. Mr. Richmond closed the public hearing at 6:17 P.M. Minutes Planning and Zoning Commission August 24, 2016 Page 2 of 5 The commissioners had a discussion with Mr. James, Mr. Cox, and Mrs. Gould about proposed sewer system for the project, pump and haul as an interim solution while the South Schertz plant is being planned, floodplain boundaries within the proposed southerly parkland, screening and privacy fencing, anticipated price points for the residential homes, parking, and roadway widening of FM 1518 in the future. Mr. Crawford moved to approve this item with a modification to the way lot depth is defined in Section 2 of the PDD. Mr. Glombik seconded the motion. The vote was 5 -1, with Mr. Evans voting nay. Motion carried. S. ITEMS FOR INDIVIDUAL CONSIDERATION: A. PC2016 -006 Consider and act upon a request for approval of a replat of Verde Enterprise Business Park Unit 2, Lot 1, Block 9. The property consists of approximately 2.76 acres of land and is more specifically described as being a portion of the Toribio Herrera Survey No. 68, Abstract No. 153, Guadalupe County, and being all of Lot 1, Verde Enterprise Business Park Unit 2, Recorded in Volume 7, Page 327, Map and Plat Records, Guadalupe County, Texas. The property is generally located on the North East corner of Mid- Cities Parkway and III — 35. (Tabled August 10, 2016) Mr. Greenwald motioned to take this item off the table. Mr. Crawford seconded the motion. The vote was unanimous, 6 -0. Motion carried. Emily Grobe presented the project, which is a request to replat Lot 1, Block 9 of the Verde Enterprise Business Park into a total of two (2) buildable commercial lots, Lot 2 and Lot 3. The subject property is generally located at the Northeast corner of Mid — Cities Parkway and IH -35. The subject property is zoned Planned Development District (PDD), part of the Verde Enterprise Business Park PDD, and is currently undeveloped. The proposed replat is consistent with all applicable zoning requirements for the property, ordinances, and regulations of the City. It has been reviewed with no objections by the City Engineer, Public Works, Parks, Inspections, and Fire. Staff recommends approval. Mr. Evans asked about the proposed size for Lot 3 and suitability of the lot size. Ms. Grobe explained that the applicant submitted a site plan for the proposed lot and that the proposed lot size works with the site plan proposal. The commission did not have any additional questions. Mr. Dahle moved to approve this item. Mr. Glombik seconded the motion. The vote was unanimous, 6 -0. Motion carried. B. Waiver -Rough Proportionality on Sidewalk Construction Associated with PC2016 -046 Consider and act upon a request for approval of a waiver regarding Rough Proportionality on sidewalk construction related to the proposed final plat of the Clayton Homes Subdivision, an approximate 14 acre tract of land generally located 705 feet west of the intersection of FM 482 and Hubertus Road. The property is specifically described as 13.17 acres out of the Rafael Garza Survey No. 98, Abstract No. 175, City of Schertz, Comal County, Texas. Minutes Planning and Zoning Commission August 24, 2016 Page 3 of 5 Channary Gould presented the request for a waiver regarding Rough Proportionality on sidewalk construction related to the proposed final plat of the Clayton Homes Subdivision. The subject property is zoned Manufacturing Light (M -1) and the applicant requested a rezone to Agricultural District (AD), along with the plat application. The subject property is generally located 705 feet west of the intersection of FM 482 and Hubertus Road. The property is vacant and undeveloped. The City Engineer has reviewed the waiver request and has no objections. Staff recommends approval of the waiver request for the Clayton Homes Subdivision based on the calculations provided by the applicant for rough proportionality. The developer will be dedicating the necessary right -of -way along FM 482. Staff recommends approval. Mr. Dahle had questions about rough proportionality and traffic impact fees. Mr. James answered and discussed rough proportionality and road impact fee analyses for projects and how the process would work. Mr. Crawford moved to approve this item. Mr. Greenwald seconded the motion. The vote was unanimous, 6 -0. Motion carried. C. PC2016 -046 Consider and act upon a request for approval of a final plat of Clayton Homes Subdivision, an approximately 14 acre tract of land generally located 705 feet west of the intersection of FM 482 and Hubertus Road. The property is specifically described as 13.17 acres out of the Rafael Garza Survey No. 98, Abstract No. 175, City of Schertz, Comal County, Texas. Channary Gould presented that the proposal to final plat approximately fourteen (14) acres into two (2) lots. The subject property is generally located 705 feet west of the intersection of FM 482 and Hubertus Road. The property is vacant and undeveloped. The proposed final plat is consistent with applicable requirements for the property, ordinances and regulations. Staff recommends approval of the final plat. Ms. Gould mentioned that during the hearing for the preliminary plat application, Commissioner Greenwald asked about whether the project was within Green Valley SUD's CCN and she confirmed with the City's Engineering Department that the project site is within the City's sewer CCN but that Green Valley SUD provides water service. The commissioners had a brief discussion regarding zoning versus plat applications. Mr. Dahle moved to approve this item. Mr. Crawford seconded the motion. The vote was unanimous, 6 -0. Motion carried. REQUESTS AND ANNOUNCEMENTS: A. Requests by Commissioners to place items on a future Planning and Zoning Agenda. Commissioners and staff had a small discussion who is going to the American Planning Association Texas Chapter Conference. Mr. Dahle needs to look at his schedule and everyone else is going except for Mr. Greenwald. B.
