Kessel) City Manager John Kessel took a moment to thank city staff and council for their participation in the recent Council Retreat Meeting held this past Thursday and Friday, 8 -01 -2017 Minutes Page - 2 - especially the Finance Department staff and Finance Director James Walters, and all the department heads who have been working hard to put together a very good budget. Prnclamatinn • Proclamation recognizing Stevens Johnson Syndrome (SJS). (Mayor Carpenter/Kelly Gutierrez) Mayor Carpenter stated we have proclamations that are generally celebratory and those that occasionally are informational such as in this case tonight. He spoke of a personal incident when he was an infant that resulted in very dangerous side effects and another one that affected his son. He read the proclamation and asked Ms. Kelly Gutierrez to come forward to say a few words regarding her young son's experience. Ms. Gutierrez stated her son had a reaction 5 years ago, losing 85% of his skin and today is legally blind as well from an allergic reaction to a seizure medication. So many people do not know anything about this type of thing. He has had over 27 surgeries in the past five years and is still far from done. He is their miracle and it has been a very difficult road. Please remember to educate before you medicate —it could save someone you love. Each new staff person was allowed some time to speak. Mayor and Council welcomed everyone on board to city staff. Promotion Ceremony Mayor Carpenter recognized Executive Director Dudley Wait who stated we are here this evening to recognize the promotion of Assistant Fire Chief Kade Long to Fire Chief. His family is here tonight along with a number of fire department staff members who were all asked to come forward for the pinning' ceremony and oath of office. Kade will become the sixth fire chief of the city and will follow in the footsteps of his five predecessors. Chief Kade Long has almost 20 years of public safety experience in the fire department service, beginning as a volunteer in China Springs, TX and then working in Duncanville, Vernon, TX, and then relocating to Schertz to become our Assistant Fire Chief. He is well prepared for this assignment, has his Bachelor of Science in Education and teaching certificate. He also holds a Masters Degree in Public Administration. He has 8 -01 -2017 Minutes Page - 3 - extensive training and education in the fire service and various disciplines within the fire service as well as emergency management. This evening we will do three things: 1) pinning of the fire chief badge, 2) pinning of the fire department rank insignia, and 3) swearing in as the new fire chief. After the pinning and swearing in, Fire Chief Kade Long spoke a few words expressing his appreciation and stated it was his honor to be here tonight with everyone. He thanked City Manager John Kessel and Executive Director Dudley Wait for this great opportunity. Schertz is a great community and him and his family are happy to be a part of it. He thanked the fire rescue staff members who took time out of their busy schedule to be here tonight and show their support for him. He expressed his sincere thanks to Retired Fire Chief David Covington and wished him well in his future fishing endeavors. This is an exciting adventure for him and he has a goal to deliver high quality customer service to the citizens. This will take a lot of teamwork and he looks forward to that. He thanked his family who took time to be here tonight and who have provided him a lot of support through the years. Lastly, he thanked the council and mayor for everything that they put into the city through their service as councilmembers. HearinLr of Residents No one spoke. Workshop • Update and discussion on the natatorium arrangement with Schertz Cibolo Universal City Independent School District (SCUCISD). (B. James) Mayor Carpenter recognized Executive Director Brian James who provided a powerpoint presentation with the following highlights: Background: • Original Use Agreement with SCUCISD provides that SCUCISD will have: • Use of 6 lanes from 5:30 a.m. to 9:30 a.m. during the school year and exclusive use of the lockers during that time. • After utilizing the pool for the last half of this past school year (January to June) SCUCISD, the YMCA and the City have been working to adjust the District's use to better serve everyone. It: SCUCIDI) often did not need to use the competition pool every morning (Monday — Friday), not using it at all some mornings and using it for fewer than the 4 allotted hours others. • To provide more opportunities for students to participate in swimming, SCUCISD has requested to shift some of their hours to the afternoon. • The YMCA is requesting to be notified if SCUCISD is not going to be using pool. 8 -01 -2017 Minutes Page - 4 - District will work to communicate when they will not be using their allotted hours so the YMCA can open it up to the public and schedule classes. ■ To allow the public to use the locker rooms in the afternoon, the lockers will only be closed to the public for a short time before and after the afternoon session to allow students to change (student arriving late will use the family changing rooms). 2017 -18 School Year Proposal • Use of 6 lanes from 5:30 a.m. to 9:30 a.m. Monday and Wednesday during the school year and exclusive use of the lockers during that time — but will notify in advance if not using. • Tuesday, Thursday and Friday 5:30 a.m. to 8:30 a.m. and exclusive use of lockers. • Tuesday, Thursday and Friday afternoon session 3:30 p.m. to 5:00 p.m. (use of lockers for 5 minutes before and after). Community Benefit • Reduces amount of time competition pool is not being used when reserved for SCUCISD but they are not using it. • Allows for some afternoon SCUCISD use to better meet needs of students. • Allows more use by the public on some mornings and when not used. Proposal • Direction being sought tonight to allow district and YMCA to finalize schedules. • Staff will submit a revised agreement that allows more flexibility to determine hours of use prior to each school year. • Agreement will also reference special use (summer clinic and tryouts) in addition to meets. After the presentation, Mr. James addressed questions and comments from council. Mayor Carpenter moved to Item 6 on the agenda. 6. Resolution No. 17 -R -54 — Consideration and/or action approving a Resolution authorizing the City Manager to enter into a contract with Sehico Services to provide the congregate meal for the Schertz Area Senior Center. (B. James /C. VanZandt/L. Shrum) Mayor Carpenter recognized Parks Director Chuck VanZandt who provided a powerpoint presentation with the following highlights: *On May 18, 2010, the City of Schertz entered into an operating agreement with Comal County Senior Citizens' Foundation. The Foundation was to provide one lunch meal five days per week. *The initial term of the operating agreement was for a period of twenty -nine months at a cost of $3,500 per month for a total of $101,500. 8 -01 -2017 Minutes Page - 5 - *On October 12, 2010, the Operating Agreement between the City of Schertz and the Comal County Senior Citizens' Foundation was amended so that the term of the agreement was extended through September 30, 2015. *Following a series of unforeseen events, the City of Schertz took over the management and provision of the congregate meal for the Schertz Area Senior Center in January 2014. *Staff worked with local restauranteurs to provide a variety of meals at a cost (to the seniors) of $4.00 per meal. This means a meal delivery was in effect for a period of approximately one year. During that time, congregate meal participation languished between 25 and 40 participants per day. *In December of 2014, staff discovered and contacted the Community Council of South Central Texas ( CCSCT). They indicated that they could provide the congregate meal at no charge; however, enrollment of the individual seniors in the program was required. * Staff successfully collected the enrollment forms from the seniors and passed them along to CCSCT to enroll them in the program in January 2015 and the seniors (and the City) began to receive the congregate meal at no cost. *In February 2015, CCSCT lost their ability to provide the meals at no cost and was forced to charge the City of Schertz $4.38 per meal delivered. The City was not made aware of this change until June of 2015 by attempting to back -bill the City for the charges. *Since the City of Schertz has no contract with CCSCT, the City/Parks Department was advised that the creation of a service agreement was of the upmost importance. An RFP was initiated by the Department to seek out other vendors /organizations that could provide the same service. *The RFP closed on March 23, 2017, with three respondents. A staff panel consisting of the Parks Director, Assistant Parks Director, and Environmental Health Manager scored the responses. A taste test panel on July 11, 2017 involved members of the Senior Center Advisory Board and the staff panel. Assistant Parks Director Lauren Shrum came forward and stated that after the scoring and taste test, Selrico was the top scorer with 96.06 points. The San Antonio Food Bank was second with 84.17 and the Community Action Partnership was third with 47.61. Things that were considered were their efficiency, safety, health plan, etc. As a result staff is recommending Selrico Services be the one to provide the meal service for the Schertz Area Senior Center. Currently, about 68 meals are now served daily. Staff is expecting this to increase as the program moves back into its newly renovated facility, offering better tasting food and better meal delivery service. The `not to exceed' contract is based on 100 meals per day. Also, moving forward, staff will pursue other reimbursement options through the Senior Nutrition Program funded by the Texas Department of Aging and Disability Services through the Alamo Area Council of Governments. Mr. VanZandt, Ms. Shrum and Mr. James addressed various questions from council. Mayor Carpenter recognized Mayor Pro -Tem Edwards who moved, seconded by Councilmember Gutierrez to approve Resolution No. 17 -R -54 with the not to exceed amount of $104,000. The vote was unanimous with Mayor Pro -Tem Edwards, 8 -01 -2017 Minutes Page - 6 - Counciimembers Davis, Gutierrez, Larson, Thompson, Kiser and Crawford voting for and no one voting no. Motion passed. Mayor Carpenter moved back to the Workshop portion of the agenda. ® Discussion regarding the proposed FY2017 -18 City of Schertz Fee changes. (B. James /J. Walters) Mayor Carpenter recognized Finance Director James Walters who provided a powerpoint presentation with the following highlights: • The Fee Schedule is reviewed once per year with the budget and tax rate • Rates are reviewed and compared to: • Related Expenses • Similar Service Offerings in the area Utility Rates: • Garbage Rates increase 3% • Water Rates increase 3% • Sewer Rates increase 6% Garbage Rates: ■ Rate increase 3% • Impact on residential customers: $0.36 • Final scheduled increase of the 8 Year Rate Contract initiated with Bexar Waste ♦ Contract called for 3% increases every other year St • Takes effect January 1 , 2018 per the contract Water Rates: ■ Rate increase 3% • Impact on average water customers: $1.60 • Follows 5 -year rate plan provided by WILLDAN consultants • The cost of water will increase with the additional debt service being issued by SSLGC to develop the Guadalupe Well Field Sewer Rates: ■ Rate increases 6% • Impact on average sewer customer: $1.91 • Follows 5 -year rate plan provided by WILLDAN consultants • Rate is higher % increase because the current sewer fees are not enough to cover sewer expenses ♦ Sewer Revenue Budget 2016 -17: $4,900,000 ♦ Sewer Expense Budget 2016 -17: $5,858,000 8 -01 -2017 Minutes Page - 7 - Civic Center Fees: ■ Review of Current Fee Schedule • Last increase was FY 2008 -2009 • Increased Services • Event Attendant Position Created in FY 2016 -17 • Increase in rentals • Averaging approximately 1,000 events a year • Review of Area Venues • Keep up with the market and remain comparable and competitive to area venues • Continue to evaluate fees each year Other Fees ■ Library — • Add a maximum charge for overdue library loan item: $5 • Reduced cost of replacement library card: $5 to $1 • Increased charge for a damaged/missing DVD cover: $1 to $3 • Add a materials recovery fee for items sent to collections: $10 8 -01 -2017 Minutes Page - 8 - ■ Magazine — • NonProfit Rates will now be set to a 25% discount • City Event Fees — • Adds approved rates to the fee schedule ♦ Jubilee ♦ SchetzQ ♦ Festival Angels ■ Police — Add state mandated fee for body camera recordings to the fee schedule: Base fee of $10 plus additional $1 per minute of recording • Fire Services- • I A7.MAT clean -up will be charged at cost based on the labor, supplies, and equipment used in the event instead of following an inflexible fee schedule which tried to do the same thing ■ EMS — • Increased EMT Class from $1,000 to $1,100 • Increased per capita charge 3% as allowed by the interlocal agreements to $14.25 • Public Works- • Increased meter installation fees to match increase in the price of meters Mr. Walters addressed a number of questions and comments from council. 0 Discussion and/or action regarding City Council Rules of Conduct and Procedures (Item requested by Mayor Carpenter) Mayor Carpenter stated he had previously provided to the city (from the Chair) advice on three items. One was how to handle any objection to the placing of any items on future agendas and another one was what the procedure might be to take up if the Mayor, Mayor Pro -Tem and senior councilmember were not present. Third, how do the rules of council actually apply in executive /closed session? At the suggestion of City Attorney Charles Zech, the mayor was asked to put this on the agenda to see if council had any questions on these items because it needed to be brought up in open session, not just a letter format. There were not any further questions by council. Consent Agenda Items The Consent Agenda is considered self - explanatory and will be enacted by the Council with one motion. There will be no separate discussion of these items unless they are removed from the Consent Agenda upon the request of the Mayor or a Councilmember. 8 -01 -2017 Minutes Page - 9 - 1. Ordinance No. 17 -T -24 — Consideration and/or action approving an Ordinance by the City Council authorizing a budget amendment to fund the SchertzQ Event. Final Reading (S. Gonzalez/L. Klepper/M. Scheduling a Special Meeting of the City Council Consideration and/or action scheduling a Special Meeting of the City Council for August 29, 2017. (B. James /J. Walters) Mayor Carpenter recognized Executive Director Brian James who confirmed that this request is simply to allow staff to move the budget through the required public hearings. Mayor Carpenter made a motion from the Chair, seconded by Mayor Pro -Tem Edwards to approve scheduling a Special Meeting of the City Council for August 29, 2017. The vote was unanimous with Mayor Pro -Tem Edwards, Councilmembers Davis, Gutierrez, Larson, Thompson, Kiser and Crawford voting for and no one voting no. Motion passed. 5. Resolution No. 17 -R -57 — Consideration and/or action approving a Resolution by the City Council of the City of Schertz, Texas, calling an election to be held on November 7, 2017 for the purpose of electing councilmembers for place 3, place 4 and place 5 for a three year term and making provision for the conduct of the election; authorizing contracts with the elections administrators of Bexar and Guadalupe Counties to conduct this election; authorizing the election to be held as a joint election; resolving other matters incident and related to such election; and declaring an effective date. Dennis/Mayor /Council) 8 -01 -2017 Minutes Page - 10 - The following was read into record: RESOLUTION NO. 17 -R -57 A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, CALLING AN ELECTION TO BE HELD ON NOVEMBER 7, 2017 FOR THE PURPOSE OF ELECTING COUNCILMEMBERS FOR PLACE 3, PLACE 4 AND PLACE 5 FOR A THREE YEAR TERM AND MAKING PROVISION FOR THE CONDUCT OF THE ELECTION; AUTHORIZING CONTRACTS WITH THE ELECTIONS ADMINISTRATORS OF BEXAR AND GUADALUPE COUNTIES TO CONDUCT THIS ELECTION; AUTHORIZING THE ELECTION TO BE HELD AS A JOINT ELECTION; RESOLVING OTHER MATTERS INCIDENT AND RELATED TO SUCH ELECTION; AND DECLARING AN EFFECTIVE DATE Mayor Carpenter recognized Deputy City Secretary Donna Schmoekel who stated the attached Resolution calls the November 7th Joint General Election to elect Councilmembers in Paces 3, 4 and 5 for a three -year term to begin November 2017 and ending 2020. By contracting with the Bexar and Guadalupe Counties many benefits are realized such as: • Entities will divide the costs proportionately thereby creating a savings to each entity • Utilize common Early Voting and Election Day poll locations • Utilize common voting equipment • Utilize common voting clerks • Reduce Voter confusion and difficulty by only having to go to one location for all elections • Open more Early Voting locations within the different counties Action on this item will authorize staff to finalize agreements with Bexar, and Guadalupe counties and their respective Election Administrators to conduct the City election, as well as fmalize a Joint Elections Contract with other entities. Once Bexar County and Guadalupe County meet with Commissioners court they will issue their final early voting and election day locations. Our office should have this information no later than August 15t". Staff recommends approval. The cost for Guadalupe County is approximately $27,692.50 and Bexar County, $4,000. These prices could go down if other entities join the group. As customary, election information will be posted on the city website as soon as it is received and anyone who has any questions can call the City Secretary Office. 8 -01 -2017 Minutes Page - 11 - Mayor Carpenter recognized Mayor Pro -Tem Edwards who moved, seconded by Councilmember Crawford to approve Resolution No. 17 -R -57. The vote was unanimous with Mayor Pro -Tem Edwards, Councilmembers Davis, Gutierrez, Larson, Thompson, Kiser and Crawford voting for and no one voting no. Motion passed. Roll call Vote Confirmation Mayor Carpenter recognized Deputy City Secretary Donna Schmoekel who provided the roll call votes for agenda items 1 -6. Closed Session 7. City Council will meet in closed session under Section 551.074 of the Texas Government Code, Personnel Matters to deliberate the appointment of a Municipal Judge. Mayor Carpenter convened into Closed Session at 7.58 p.m. Reconvene into Regular Session Mayor Carpenter reconvened into Regular Session at 8:45 p.m. 7a. Take any action based on discussions held in closed session under Agenda Item 7. Mayor Carpenter made a motion from the Chair, seconded by Mayor Pro -Tem Edwards to appoint Mr. Daryl Dullnig as the city's Municipal Court Judge effective immediately and 'compensated at the same rate as former Judge Hrncir and retain the services of Judge Takas as our secondary and backup court judge. The vote was unanimous with Mayor Pro -Tem Edwards, Councilmembers Davis, Gutierrez, Larson, Thompson, Kiser and Crawford voting for and no one voting no. Motion passed. Roll Call Vote Confirmation Mayor Carpenter recognized Deputy City Secretary Donna Schmoekel who provided the roll call vote for agenda item 7a. Requests and Announcements Announcements by City Manager. City Manager John Kessel provided a quick update from the retreat. Staff was able to work with Comal County and audit the rest of the numbers and identify at least one additional property, if not more, that was incorrectly coded. At this point, they have been corrected and we have recalculated the effective rate. We don't think it will change unless as you may find with any protests that may come in during the month of August, which is usually a very small percentage. It is actually very good news in our favor and more than what we expected. As a reminder, the current rate is .4911, and we are now calculating 8 -01 -2017 Minutes Page -12 - the effective rate at .4910. The rollback rate is 5083. We will be bouncing the budget against those numbers as a frame of reference. 9. Council members to request that items be placed on a future agenda. No discussion of the merits of the item may be taken at this time. Should a Council Member oppose placement of the requested item on a future agenda, the Mayor shall instruct the City Secretary to place on the agenda for the next regular session an item to discuss the merits of placing the item that was objected to on a future agenda for full consideration. Mayor Carpenter recognized Councilmember Crawford who asked if we would be talking about the fee schedule again on the next agenda. The mayor answered yes. For the next agenda he asked to discuss the hiring process of a new prosecutor. Mayor Carpenter restated that for the next agenda, we should have an item for the appointment procedures of a new prosecutor and invite our new municipal judge to join us for that discussion. Mr. Crawford also requested a discussion regarding any policies to be enacted in regard to social media conduct for council and/or members of committees/boards /commissions of the city. Mayor Carpenter said this should be done in open session and vetted in public. Mayor Pro -Tem Edwards added he thinks we should have a process in place to replace a municipal judge or - prosecutor. Mayor Carpenter stated this should indeed be on a future agenda in the near future to discuss some broad parameters on how we will proceed in the future with filling a vacancy; in fact, probably for any of the positions that report directly to the council —any unexpected vacancy. 10. Mayor Carpenter recognized Councilmember Gutierrez who thanked City Manager John Kessel and city staff, especially Finance Director James Walters, for an excellent presentation(s) concerning the budget. Everything was very informative. Mayor Carpenter stated he also would like to thank the staff for the budget presentations on Friday.
