17-R-68 Approval of Hazard Mitigation Plan with Bexar CountyA RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SC HERTZ, TEXAS AUTHORIZING APPROVAL OFT E HAZARD ITIGATION PLAN WITH BEXAR COUNTY, AND OTHER MATTERS IN CONNECTION THEREWITH. WHEREAS, natural hazards in the City of Schertz area historically have caused significant disasters with losses of life and property and natural resources damage; and WHEREAS, the Federal Disaster Mitigation Act of 2000 and Federal Emergency Management Agency (FEMA) require communities to adopt a hazard mitigation action plan to be eligible for the full range of pre - disaster and post- disaster federal funding for mitigation purposes; and WHEREAS, FEMA requires that communities update hazard mitigation action plans every five years in order to be eligible for the full range of pre- disaster and post- disaster federal funding for mitigation purposes; and WHEREAS, the City of Schertz has assessed the community's potential risks and hazards and is committed to planning for a sustainable community and reducing the long -term consequences of natural and man- caused hazards; and WHEREAS, the Bexar County Hazard Mitigation Plan (attached hereto as Exhibit A) outlines a mitigation vision, goals and objectives; assesses risk from a range of hazards; and identifies risk reduction strategies and actions for hazards that threaten the community; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS THAT: Section 1. The City Council hereby approves the Bexar County Hazard Mitigation Plan as set forth in Exhibit A. Section 2. The City vests with the Mayor the responsibility, authority, and means to inform all parties of this action; assure that the Hazard Mitigation Plan will be reviewed at least annually and that any needed adjustments will be presented to the City Council for consideration. Section 3. The City will pursue available funding opportunities for implementation of the proposals designated therein, and will, upon receipt of such funding or other necessary resources, seek to implement the actions contained in the mitigation strategies; Section 4. The City agrees to take such other action as may be reasonably necessary to carry out the objectives of the Plan and report on progress as required by FEMA and the Texas Division of Emergency Management (TDEM). Section 5. The recitals contained in the preamble hereof are hereby found to be true, and such recitals are hereby made a part of this Resolution for all purposes and are adopted as a part of the judgment and findings of the City Council. Section 6. All resolutions, or parts thereof, which are in conflict or inconsistent with any provision of this Resolution are hereby repealed to the extent of such conflict, and the provisions of this Resolution shall be and remain controlling as to the matters resolved herein. Section 7. This Resolution shall be construed and enforced in accordance with the laws *f the State • Texas and the United States of America. Section 8. If any provision of this Resolution or the application thereof to any person or circumstance shall be held to be invalid, the remainder of this Resolution and the application of such provision to other persons and circumstances shall nevertheless be valid, and the City Council hereby declares that this Resolution would have been enacted without such invalid provision. Section 9. It is officially found, determined, and declared that the meeting at which this Resolution is adopted was open to the public and public notice of the time, place, and subject matter of the public business to be considered at such meeting, including this Resolution, was given, all as required by Chapter 551, Texas Government Code, as amended.
