The site is zoned Planned Development District and is located at 1450 Schwab Road, City of Schertz, Comal County, Texas. Mr. Dziewit opened the public hearing at 6:03 P.M. Ms. Grobe presented a request for a variance to UDC Article 9, Section 21.9.5.E.2, Exterior Building Materials, in order to permit metal as the primary exterior building material for an electrical equipment shelter for the proposed off -site lift station for the Homestead subdivision. The property owner is proposing to construct a 9' high by 18'3" in length electrical equipment shelter. This shelter is to be used in conjunction with the proposed sewer lift station located on the same property being established for the residential subdivision Homestead. The request for a variance complies with the approval criteria for granting a variance. Staff recommended approval of BOA 2017 -003. Minutes Board of Adjustment May 22, 2017 Page 1 of 2 There were no additional comments from the public. Mr. Dziewit closed the public hearing at 6:09 P.M. Mr. Hartzog wanted clarification that there will be a masonry fence around the property and the electrical structure will have a primary finish as galvanized metal material. He asked if this lift station will be close to Cypress Point Subdivision. Mr. Fleming responded that the vertical material will be metal and the roof will be the only thing seen over the masonry fence. Ms. Grobe commented that strict interpretation of public use buildings as identified in Unified Development Code Article 9 are required to be 75% of a masonry material. Mr. Sale commented that this is not exactly a building but it is an electrical control panel. Mr. Sale commented that the structure and roof is more for more weatherproofing and to keep the workers from getting wet. Mr. Cox explained some of the newly adopted architectural standards and provided examples of other public use facilities with the similar unique requests. Mr. Hartzog asked if this structure has already been built. Mr. Fleming responded that the surrounding masonry fence has been started but the shelter has not been built. Mr. Hartzog moved to approve this item. Motion carried. 5. ANNOUNCEMENTS: A. Announcements by Members Reynolds seconded the motion. The vote was 5 -0. • Mr. Dziewit thanked the Parks Department for providing the park tours. • Mr. Hartzog enjoyed the information regarding the Committee of Committees meeting. The report is attached and was very interesting. Mr. Hartzog also enjoyed the park tour. He commented that the 4 °h of July Jubilee and will be needing more volunteers. Also, there will be an unavailing of the mural at the Pickerel Park swimming pool on May 24th • Mr. Dziewit asked the question if there was any Continuing Education coming up. Mr. Cox indicated that not at this time, but in the 'future staff is looking to have a refresher on the Open Meetings Act. B. Announcements by City Staff • Mr. Cox mentioned that the last Committee of Committee Advisory Board Meeting summary is in Board members packet. • Mr. Cox indicted that he would email the Board more information on the unavailing of the mural at Pickerel Park. • Mr. Cox indicated that the pool season will open the first weekend in June. REQUEST: The property owner is requesting a variance to UDC Article 9, Section 21.9.8.B.2.b Prohibited Materials in order to permit barbed wire atop of chain link fencing at an existing wastewater treatment facility. The request is to construct a new 6 -foot chain link fence with three - strand barb wire on top around the wastewater treatment facility. PUBLIC NOTICE: The public hearing notice was published in the "San Antonio Express" on September 8, 2017. There were sixty (60) notices mailed to surrounding property owners on September 6, 2016. At the time of this staff report four responses in favor, one response neutral to, and zero responses opposed have been received. ITEM SUMMARY: CCMA has plans to improve and expand the existing wastewater treatment facility in order to allow for an increased capacity to accommodate the growing demand. The improvements being proposed by CCMA involve constructing a new intruder proof security fencing with three - strand barb wire on top to comply with Texas Commission of Environmental Quality's requirement that a waste water treatment facility be completely enclosed by an intruder resistant fence with a minimum of six (6) feet tall and that a 6 -foot fence must have at least three (3) strands of barbed wire along the top. SUBJECT PROPERTY GENERAL LOCATION. ZONING AND LAND USE: The property is located at 12423 Authority Lane. The wastewater treatment facility fence would be set back approximately 3,000 feet from Schaefer Road. The requested variance does not violate the intent of this UDC or its amendments; The variance does not violate the intent of the UDC or its amendments because the intent of Section 21.9.8.B.2.b Prohibited Materials is to maintain an aesthetically pleasing appearance that would enhance the community's beautification efforts. The proposed chain link fencing with barb wire fencing on top would not significantly detract from the aesthetics of the surrounding area. Additionally, the proposed chain link fencing is to comply with Texas Commission of Environmental Quality (TCEQ) requirements. Under §217.328 Wastewater Treatment Facility Access Control, TCEQ requires that a wastewater treatment facility must be completely enclosed by an intruder resistant fence with a minimum of a 6 -foot tall fence and that it must have at least three (3) strands of barbed wire along the top. This TCEQ requirement conflicts with the City's UDC Section 21.9.8.B.2.b, which prohibits barbed wire fencing unless it is for the keeping of livestock. 2.
