18-R-109 - 3rd amendment to ILC with City of Cibolo, SCUCISD Student Resource OfficerWHEREAS, the City of Schertz entered into an Interlocal Cooperative Agreement with the City of Cibolo ( "Cibolo ") and the Schertz- Cibolo - Universal City Independent School District (the "District ") for both cities to provide police officers for the District's Student Resource Officer program; and WHEREAS, the parties have previously agreed to two amendments to the Interlocal Cooperative Agreement; and WHEREAS, the District has requested a third agreement to the Interlocal Cooperative Agreement for the addition of a fourth School Resource Officer to increase the presence of law enforcement officers across the campuses of the District; and WHEREAS, the City staff of the City of Schertz (the "City ") has recommended that the City enter into this amendment to the Interlocal Cooperation Agreement with the City of Cibolo, Texas and the Schertz - Cibolo- Universal City Independent School District relating to the provision of certain police services to the District by the City and Cibolo; and WHEREAS, the City Council has determined that it is in the best interest of the City to contract with Cibolo and the District pursuant to the Interlocal Cooperation Agreement attached hereto as Exhibit A (the "Agreement "). BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS K 1* r� Section 1. The City Council hereby authorizes the Acting City Manager to execute and deliver the Agreement with the City and the District in substantially the form set forth on Exhibit A. Section 2. The recitals contained in the preamble hereof are hereby found to be true, and such recitals are hereby made a part of this Resolution for all purposes and are adopted as a part of the judgment and findings of the City Council. Section 3. All resolutions, or parts thereof, which are in conflict or inconsistent with any provision of this Resolution are hereby repealed to the extent of such conflict, and the provisions of this Resolution shall be and remain controlling as to the matters resolved herein. 50417899.1 Section 4. This Resolution shall be construed and enforced in accordance with the laws of the State of Texas and the United States of America. Section 5. If any provision of this Resolution or the application thereof to any person or circumstance shall be held to be invalid, the remainder of this Resolution and the application of such provision to other persons and circumstances shall nevertheless be valid, and the City Council hereby declares that this Resolution would have been enacted without such invalid provision. Section 6. It is officially found, determined, and declared that the meeting at which this Resolution is adopted was open to the public and public notice of the time, place, and subject matter of the public business to be considered at such meeting, including this Resolution, was given, all as required by Chapter 551, Texas Government Code, as amended. Where a portion of the Agreement is not supplemented, modified, amended and/or deleted by these Amendments, such unaltered portions of the Agreement shall remain in effect. The purpose of this Amendment is to Add an additional School Resource Officer from the City of Schertz, Texas as per Article 1.1.2 which states that the parties shall at least annually evaluate the number of SROs to be provided and may increase or decrease by mutual agreement the number of SROs. This brings the total number of SRO's provided from three to four. Increase the amount paid per SRO based on the City's rate adjustment request as per Article 2.21 as amended. Therefore the current SRO fee of $85,000 per SRO for the 2017 -2018 School Year is hereby increased to $87,000 per SRO effective the 2018 — 2019 School Year beginning August 2018. This is an increase of 2.235 percent based on the U.S. Department of Labor, Consumer Price Index for All Urban Consumers (the "CPI -U "), all items, unadjusted 12 months ended January of the previous year.
