Mr. Dodson had questions regarding security safe guards, hours of operation, service truck loading locations, and the height /material of the walls that will separate the facility from the surrounding properties. Ron Spamily -Owner of Texas Heritage Children Ranch - He was concerned with the Dollar General being so close to his child care facility, and he had questions regarding the location of the 8 foot masonry wall. Mr. Dahle closed the public hearing at 6:20 P.M. Minutes Planning and Zoning Commission September 12, 2018 Page 2 of 6 Mr. Outlaw clarified that this is a zoning case and not about the proposed buiiness. Mr. Greenwald had a question regarding what will be done with the other part of the property that is not being presented to commissioners. Ms. Grobe explained the masonry wall and landscape requirements, which are outlined by the city's design standards. Ashley Farrimond, from Kaufman Killen, explained the outdoor lighting, camera placement, truck delivery schedule, and hours of operation. Mr. Greenwald indicated TxDOT owns FM 1518, and the City of Schertz is working with TxDOT to have road improvements. Mr. Outlaw had a question on the quantity of opposed public notices that staff received. Ms. Grobe indicated that staff received 21 opposition, 0 favorable, and 0 neutral public notices. She also explained that the super majority required by state law only accounts for votes within the 200 foot notice. She indicated she did the calculations prior to the meeting and only five percent came from within that buffer. Mr. Dahle commented that this is a rezoning case and the Commission is not voting on the proposed business. As a resident of the area surrounding the proposed rezoning, he had concerns regarding the Dollar General's outside facade, and hopes to see a better designed faeade if the proposed project is approved. Mr. Outlaw indicated the location in question has multiple General Business Districts, and reiterated the property's various possible uses given its current zoning. He explained that a proposed project could come in for something worse than the proposed Dollar General. Mr. Dahle indicated that Neighborhood Services is better suited for the specific location, and the rezoning of the property could eliminate most uses that would be considered undesirable. Mr. Braud asked why the Commission is being presented with the proposed use if they are only voting on the potential rezoning of the property. Mr. Braud indicated that he believes a Dollar General is not suitable for the proposed location, however, he is in agreement that Neighborhood Services is the zonina.cateizory best suited for this location. Mr. Braud indicated to the public that the residents in Willow Grove Subdivision are surrounded by General Business, and if the residents want to take action they need to study the UDC to figure out what should be done to help out staff with this concern. Mr. Dahle requested that Commissioners justify their vote if they choose to deny since they are recommending a decision to City Council. Mr. Greenwald stated denial and his reason was that he prefers the proposed property not be split into sections. Mr. Braud stated denial and his reason was the same as Mr. Greenwald. Ms. Grobe indicated Staff recommended approval of the wavier based on the distance to sewer connections. Commissioners and Staff had a discussion on the separation of the property into 4 individual lots that will have their own septic system, water table, and the potential discounts available for future connection to the City's main sewer line once it becomes available. Mr. Outlaw motioned to approve WA2018 -005. Mr. Braud seconded the motion. The vote was 4 -2 with Commissioner Evans and Greenwald with the Nay, motion carried. B. She noted that the plat includes standard notes since it is within their service area. Mr. Outlaw indicated that the wastewater lines typically go down the center of the roadway, and after looking at the map he noted the proposed property is a far distance from an available sewer Mr. Outlaw motioned to approve PC2018 -030. The site is zoned Planned Development District (PDD). This preliminary plat was reviewed using the PDD Ordinance 17 -S -02 design standards and the current UDC, Ordinance 11 -S -15 as amended. GENERAL LOCATION AND SITE DESCRIPTION: The subject property is currently undeveloped and is generally located approximately 380 feet east of the intersection of Crocket Cove and Winkler Trail, Guadalupe County, Texas, or 1,800 feet east of Homestead Parkway. ACCESS AND CIRCULATION: The UDC, Article 14, requires that all residential subdivisions have a minimum of two (2) locations accessing existing public streets. This unit is designed to have one (1) point of access from Archer Pass which will be constructed with Unit3B, and one (1) point of access from Homestead Parkway. The portion of Homestead Parkway that will be utilized will intersect with the proposed Borden Pass, Potter Place, and Kimble Way which extends throughout the Unit 7 preliminary plat. Prior to recording the final plat for this Unit, the final plat for Homestead Unit 3B must be filed with the County Clerk's office. TREE MITIGATION AND PRESERVATION: The applicant is responsible for complying with the Unified Development Code (UDC), Section 21.9.9 Tree Preservation and Mitigation. The applicant has submitted a tree affidavit which indicates that the site does not contain protected or heritage trees. The overall recreation and open space master plan was reviewed by the Parks and Recreation Advisory Board and approved as part of the PDD Ordinance 14 -S -29. The open space and parkland amenities will include both passive and active areas, as well as pathway and hike and bike trails which will provide links between the city park, open spaces, neighborhoods and the SCUCISD school site. Open space and park improvements will include such amenities as playscapes, sports courts, playing fields, pavilions, picnic tables, and natural water features. No parkland is being dedicated with this plat. The applicant and the City entered into a parkland development agreement that was executed January 4, 2017. GENERAL LOCATION AND SITE DESCRIPTION: The subject property is currently undeveloped and is generally approximately 1,100 feet east of the intersection of Crocket Cove and Winkler Trail, Guadalupe County, Texas, or approximately 3,000 feet east of Homestead Parkway. ACCESS AND CIRCULATION: The UDC, Article 14, requires that all residential subdivisions have a minimum of two (2) locations accessing existing public streets. This unit is designed to have one (1) point of access from Elis Way which will be constructed with Unit 7, and one (1) point of access from Midland Drive which will be constructed with Unit 7. Prior to recording the final plat for this Unit, the final plat for Homestead Unit 7 must be filed with the County Clerk's office. TREE MITIGATION AND PRESERVATION: The applicant is responsible for complying with the Unified Development Code (UDC), Section 21.9.9 Tree Preservation and Mitigation. The applicant has submitted a tree affidavit which indicates that the site does not contain protected or heritage trees. PARKS: An approximately 15 acre public park with improvements is being proposed in the Homestead Master Development Plan as well as approximately 56 acres of private open space. The overall recreation and open space master plan was reviewed by the Parks and Recreation Advisory Board and approved as part of the PDD Ordinance 14 -S -29. The open space and parkland amenities will include both passive and active areas, as well as pathway and hike and bike trails which will provide links between the city park, open spaces, neighborhoods and the SCUCISD school site. Open space and park improvements will include such amenities as playscapes, sports courts, playing fields, pavilions, picnic tables, and natural water features. No parkland is being dedicated with this plat. The applicant and the City entered into a parkland development agreement that was executed January 4, 2017. PUBLIC SERVICES: The site is serviced by Schertz water and sewer, Guadalupe Valley Electric Coop (GVEC), AT &T, Spectrum, and Center Point Energy. PUBLIC IMPROVEMENTS: All public improvements required for this subdivision are required to be installed prior to recording of the final plat per UDC, Section 21.4.15, unless otherwise specified in an approved development agreement. The civil construction plans must be reviewed and approved by the Public Works and Engineering Departments prior to approval of the final plat. Water and Sewer: The site will be serviced through 8" water lines and 8" sewer lines that will be extended throughout the subdivision and stubbed for future development. GENERAL INFORMATION: Owner / Applicant: Robert and Imelda Cantu Engineer: Don McCrary & Associates / McLain Garrett ITEM SUMMARY: The applicant is proposing to develop approximately 39 acres of land into four (4) residential lots. The applicant is seeking approval of a waiver to UDC Sec. 21.15.313 wastewater systems in order to have the ability to install privately owned On -Site Sewage Facilities (OSSF) on each of the four lots. The subject property is currently developed with one single - family residential home and multiple barns, and is zoned Single — Family Residential / Agricultural (R -A). GENERAL LOCATION AND SITE DESCRIPTION: The subject property is located at 11330 Ware Seguin Road and is currently developed with one single - family residential home and multiple barns. PUBLIC IMPROVEMENTS: The applicant is seeking approval of a waiver to install a privately owned On -Site Sewage Facility (OSSF) on each of the lots being proposed, four lots in total. OSSF systems are regulated by Bexar County. Where the subject site is located, there is a dual Certificate of Convenience and Necessity (CCN) for sewer with the City of Schertz responsible for collection and Cibolo Creek Municipal Authority (CCMA) responsible for treatment. Additionally, a portion of the property is within an area with a dual Certificate of Convenience and Necessity (CCN) for sewer with the City of Schertz responsible for collection and San Antonio River Authority (SARA) responsible for treatment. The existing single - family home currently utilizes an On -Site Sewage Facility. In accordance with UDC, Article 15 Easements and Utilities, Sec. 21.15.3.13, Wastewater System, all lots, tracts and parcels on which the development is proposed shall be connected to a public wastewater system. Furthermore, the UDC, Article 12 Subdivisions, Sec. 21.12.2.D. requires that all land subdivided or platted shall comply in full with the requirements of this UDC. Based on the requirements of the UDC not connecting to a public wastewater system and installation of OSSF requires a waiver to be granted by the Planning and Zoning Commission as prescribed in Sec. 21.12.15 Waivers. The UDC authorizes the Planning and Zoning Commission to grant waivers to the provisions in Article 12 when undue hardship will result from requiring strict compliance. STAFF ANALYSIS AND RECOMMENDATION: The applicant is requesting a waiver to the required connection to a public waste water system to allow the installation of privately owned on -site sewage facilities on each of the proposed four lots of the Cantu Ranch subdivision. The request for on -site sewer facilities is due to the lengthy distance to the nearest sewer line connection. The project engineer has provided that the closest sewer connection is approximately 3,800 feet to the west near the intersection of Boenig Drive and Laura Heights. In order to utilize this closest sewer connection a sanitary sewer line would need to be extended approximately 1,995 feet west to the intersection of Boenig Drive and Ware Seguin Road, and then extended an additional 790 feet adjacent to Boenig Drive to an existing sanitary sewer manhole. The Engineering Department in reviewing this waiver request, provided that the Department is in support of granting the waiver and notes that it is consistent with similar waivers granted. Additionally, Engineering stated that they verified that the proposed preliminary plat associated with the waiver is laid -out in a manner to provide for connection a public sanitary sewer system in the future. This waiver request has been reviewed with no objections by Public Works, Engineering and Planning Departments. Staff recommends approval of the waiver based on the distance to sewer connections.
