GENERAL INFORMATION: Owner: Cinestarz Entertainment, LLC Applicant: EVO Entertainment Group Authorized Agent: Chandler Signs, LLC, Debbie Moltz REQUEST: The applicant is requesting variances to UDC Sec.21.11.9 Wall Signs, in order to permit the following: • Allowance of two (2) additional wall signs (including a second 477.68 square foot primary sign) for a total of five (5) wall signs. • Allowance of increased maximum area for a primary wall sign. • Allowance of four (4) signs per wall. • Allowance of one (1) wall sign to extend above the roofline. PUBLIC NOTICE: The public hearing notice was published in the "San Antonio Express" on October 3, 2018. There were two (2) notices mailed to surrounding property owners on October 4, 2018. At the time of this staff report, staff has received zero response opposed, neutral, or in favor of the request. ITEM SUMMARY: The subject property is an approximately 18 acre tract of land that is currently under construction with an approximately 73,330 square foot multi -use entertainment center. The applicant is proposing to install five (5) wall signs on the exterior of the building, including a second primary sign, which exceeds the maximum allowed number of signs by two (2). In accordance with the Unified Development Code, Article 11, Section 21.11.9 (C), the maximum number of signs permitted for a single occupancy building shall be limited to one (1) per wall with a maximum of three (3) signs. The applicant is proposing to install a primary wall sign on the northern fagade (facing 1 -35) that is 477.68 square feet, which exceeds the maximum allowed area of a primary wall sign. The applicant is also proposing to install a second primary wall sign on the southern fagade that is also 477.68 square feet. In accordance with the Unified Development Code, Article 11, Sec.21.11.9 (B), the maximum area of a wall sign is 15% of the fagade area or 250 square feet, whicheveris less. The fagade for the proposed EVO Entertainment is a total of 19,244.67 square feet, and 15% of the fagade is 2,886.7 square feet; therefore, the primary wall signs must not exceed 250 square feet since that is less than 15% of the facade. The applicant is proposing to install four wall signs on the northern fagade (facing 1 -35), which exceeds the maximum number of signs allowed per wall. In accordance with the Unified Development Code, Article 11, Section 21.11.9 (C), the maximum number of signs permitted for a single occupancy building shall be limited to one (1) per wall with a maximum of three (3) signs. The applicant is proposing to install one sign that extends 5 feet, 7.5 inches above the parapet on the northern fagade (facing 1 -35), which is not permitted. In accordance with the Unified Development Code, Article 11, Sec. 12.11.9 (D), in no case shall a wall sign project above the roofline of any building nor extend above the parapet wall if attached thereto. Wall signs shall be no closer vertically to the eave of the roofline or overhang than the predominant letter height. The requested variance does violate the intent of this UDC or its amendments; UDC Article 11 is intended to enhance property values, maintain aesthetic attractiveness, promote commercial opportunity in the City, and to support and further the objectives of the City's Comprehensive Land Plan. The variance does not meet the intent of the UDC because the subject signs exceed the maximum total number of wall signs, exceed the maximum area of wall signs, exceed the maximum number of wall signs per wall, and extend above the roofline. 2. Special conditions of restricted area, topography or physical features exist that are peculiar to the subject parcel of land and are not applicable to other parcels of land in the same zoning district; The purpose of a variance is to acknowledge the special circumstances particular to the subject property. The subject property is not influenced by conditions that are unique to the land or that prevent the business from being properly advertised. 3. The hardship is the result of the applicant's own actions; or 4. The interpretation of the provisions in this UDC or any amendments thereto would not deprive the applicant of rights commonly enjoyed by other properties in the same zoning district that comply with the same provisions. We would like to ask for variance to three aspects of the signage code: the quantity of signs allowed on a single face, the size of the signs relative to the site's elevation and the placement of a sign on a wall Quantity: Our proposed signs on the front of the building include: the main EVO Entertainment sign above the entrance, our tagline Films. Lanes. Games., a sign on the left front corner for the EVOVR` immersive virtual reality experience, and one on the left front corner that identifies the EVX® Enhanced Viewing Experience auditoriums that will be featured at this location. Historically, movies were shown in movie theatres, bowling happened in bowling alleys, food was served in restaurants, and each of those buildings would install a sign on their building to identify their business. In this newly developed cinema - hybrid model, where multiple 'businesses' work together to serve the same customers, more than one exterior sign is needed to identify the variety of our offerings. Size: Our building is set back from the 1 -35 access road and is behind future pad sites that will further limit visibility of the building. Additionally, the size of the 1 -35 elevation is large given the number of combined uses under a single roof. The size of the signs we propose is a little larger to match the scale of the building and to avoid looking tiny (like a postage stamp). Along with the design of the signs, the scale of the signs has been evaluated to determine the size we believe is needed to identify the building within the development. Our goal is to spend the minimum amount of money on our signs while installing the minimum size needed to provide the visibility and public awareness that we need to be successful. Placement: The EVO Entertainment sign at the building entry is the primary sign for the building and we need to make it unique and provide visual hierarchy with the other signs. The main EVO Entertainment sign was designed to nod to historic 'marquee' movie theatre designs that engage the edge of the parapet or canopy, with exposed LED tube appearance inside the letters. The 73,000 square foot EVO Entertainment center will include a 10- screen dine -in cinema featuring 100% luxury recliner seating, 16 lanes of bowling, over 100 of the industry's newest video & redemption arcade games, an immersive virtual reality experience center, private event spaces, a full- service restaurant & bar, and more! ITEM SUMMARY: The subject property is an approximately 0.5 acre tract of land that is developed as a 9,184 square foot auto repair business (Schertz Car Care Center). A portion of the subject property fronting 1 -35 is being acquired by the Texas Department of Transportation (TxDOT) for an expansion of 1 -35. The existing, nonconforming freestanding ground sign currently resides in the portion of land being acquired by TxDOT, and it must be moved back into the property by approximately 10 feet. The requested variance does violate the intent of this UDC or its amendments; UDC Article 11 is intended to enhance property values, maintain aesthetic attractiveness, promote commercial opportunity in the City, and to support and further the objectives of the City's Comprehensive Land Plan. The variance does not meet the intent of the UDC because the subject sign exceeds the maximum allowed area for a freestanding ground sign. 2. Special conditions of restricted area, topography or physical features exist that are peculiar to the subject parcel of land and are not applicable to other parcels of land in the same zoning district; The existing freestanding ground sign is currently located on land that is being acquired by TOOT and is not allowed to encroach into the TOOT right -of -way. TOOT is requiring the sign to be relocated or removed. Even though this sign relocation is not the fault of the property owner, the freestanding ground sign is a nonconforming structure, and in accordance with UDC Article 7, Section 21.7.8, is not allowed to be relocated under the same design standards. The UDC, Article 7, Section 21.7.8, Relocation of nonconforming structures, states that no nonconforming structure or building shall be moved in whole or in part to any other location on the lot, or to any other location or lot, unless every portion of such structure is in compliance with all the regulations of the zoning district in which the structure is to be relocated. UDC Article 7 is intended to ensure that nonconforming uses and structures are held to the same standards as every other property within the same zoning district once there is an attempt to modify or relocate the nonconforming structure.
