ccreg 05-16-06 MINUTES REGULAR SESSION May 16, 2006 Schertz Council convened Session on Tuesday, May 16, 2006 Municipal Complex Council Chambers at 7:00 1400 Schertz Parkway #4, Schertz, Texas. The following members were present: Mayor Hal Baldwin presiding, Council Members Carl Douglas, John Reginna Agee, Tony Wilenchik Michael Also present were Manager, Don Taylor, Assistant City Manager John Bierschwale, City Secretary Judy and City Attorney Michael Spain. #1 Mayor Baldwin called the meeting to order at 7:00 p.m. #2 PLEDGE OF ALLEGIANCE TO THE UNITED STATES TEXAS Mayor Baldwin led the pledge ofallegiance. Mayor Baldwin introduced Mayor Jay Feibe1man, City of Garden Ridge. #3 HEARING Robert Brockman, 1000 Elbe1 Road, thanked the Public Works department for fixing the sidewalks at the Library and stated there was an issue with the developer regarding sidewalks in the Schertz Forest Subdivision. #4 INTRODUCTION: 2006-2007 MISS SWEETHEARTS OF COURT Sharon Pennington,. Coordinator for the Miss Sweetheart Court introduced the court. The finalist contest was held on May 5,2006. Those present were- Miss Liberty, Ashley Blumentritt; Miss Freedom, Julianne Royce; Miss Jubilee, Sabrina Nelson; Miss Friendly City, Miss Emily Furillo; and, Miss Schertz, Megan Ferguson. #5 PRESENTATION: Judge Padgett introduced the recipients ofthe Teen Court Scholarship Awards. They were Pablo Morales, Michael Brewer and Reginna Sutton. The students were awarded $1,000.00 scholarships. Regular Meeting 5-16~06 187 Councilmember Douglas and Mayor Baldwin stated that every student that participated was outstanding and congradulated them on their outstanding achievements. They agreed it was a difficult decision. #6 OF Schertz Humane Society President Lisa Connally and .ValerieWilenchik presented certificates of appreciation to those who participated in the 5th Annual Doggie Dash held on April 29, 2006. #7 NATIONAL LAW WEEK 20, 2006. Mayor Baldwin read and presented a proclamation to the Police Department proclaiming the week of May 14 - 20,2006 as National Law Enforcement Week. #8 Mayor Baldwin read and presented a proclamation to EMS proclaiming the week of May 14 - 21,2006 as Emergency Medical Services Week. #9 NATIONAL MAY 21-27, 2006. Mayor Baldwinread and presented a proclamation to Public Works department the week of May 21-27,2006 as National Public Works Week. Mayor Baldwin opened the public hearing at 7:40 p.m. #10 Public Hearing on amending the City of Schertz Unified Development Code, Article IX (Sign Standards). Robert Brockman, 1000 ElbelRoad, .asked if there were penalties in the sign ordinance for violators. There were.no further comments from the public. Mayor Baldwin closed the public hearing at 7:44p.m. Discussion on an of City of Schertz Ordinance No. 96-S-28 No.02-S-2, Regular Meeting 5-16-06 188 Standards, creating a ordinance replacing Article Standards; establishing a penalty; conflicting establishing an date. Mayor Baldwin recommended that the Council postpone action on the first reading of the sign ordinance until after the new council members are installed allowing them a chance to review the ordinance. Council Member Carpenter made a motion, seconded by May Pro Tern Wilenchik, to postpone the vote of the first reading of the sign ordinance until the next available workshop meeting. The vote was as follows: AYES: Council Members Douglas, Trayhan, Agee, Wilenchik and Carpenter. NAY: None. #12 CONSENT AGENDA: The following items may be acted upon in one motion. No separate discussion or action is necessary unless requested by the Mayor or a Councilmember, in which event those items will be pulled for separate consideration: A) Minutes for Regular Session of February 21, and April 18, 2006 and Public Hearing and Special Called Session of April 11 , 2006. B) Approve the Agreement between the City of Schertz and Comal County for the Provision of Certain Sanitation Services. C) First reading of an ordinance authorizing an exchange of right -of-way. Mayor Pro Tem Wilenchikmadeamotion, seconded by Council Member Trayhan, to approve the consent agenda items A-C. The vote was as follows; AYES: Council Members Douglas, Trayhan, Agee, Wilenchik and Carpenter. NAY: None. #13 and first reading on an ordinance by of Schertz authorizing a licensing Council Member Trayhan made a motion, seconded by Council Member Agee, to approve first reading on an ordinance by the City Council of the City of Schertz authorizing a licensing agreement. The vote was as follows: AYES: Council Members Douglas, Trayhan, Agee, Wilenchik and Carpenter. Edwards 549 Council Member Trayhan made a motion, seconded by Mayor Pro Tem Wilenchik to accept the election returns and declare the winners. For Mayor - Hal Baldwin, Councilmember Place 1 - Jim Fowler and Council Member Place 2 - David L. Scagliola. The vote was as follows: A YES: Council Members Douglas, Trayhan, Agee, Wilenchik and Carpenter. NAY: None ORDINANCE: AN CITY OF Mayor Baldwin read the election returns on the Charter Propositions. All propositions passed. Council Member Douglas moved, seconded by Council Member Trayhan, to accept the election returns for the charter amendments. The vote was as follows: A YES: Council Members Douglas, Trayhan, Agee, Wilenchikand Carpenter. NAY: None Regular Meeting 5-16-06 190 #16 Mayor Baldwin read the election returns for the bond election. PROPOSITION No. 1 For ~ 1,797 Against - 962 The Issuance of $6,000,000.00 of General Obligation Bonds to Construct and Equip A New Library and The Purchase of Land Relating Thereto. PROPOSITION No.2 For-1,406 Against - 1,348 The Issuance of $7,500,000.00 of General Obligation Bonds to Construct and Equip A New Recreation Center and The Purchase of Land Relating Thereto PROPOSITION No.3 For -1,916 Against - 844 The Issuance of $20,000,000.00 of General Obligation Bonds to Construct Street, Curb and Sidewalk Improvements and Drainage Incidental Thereto and the Purchase of Land Relating Thereto PROPOSITION NO.4 For - 1,928 Against 835 The Issuance of $4,000,000.00 of General Obligation Bonds to Construct Drainage Improvements and the Purchase of Land Relating Thereto PROPOSITION No.5 For - 1,326 Against 1,439 The Issuance of $1,500,000.00 of General Obligation Bonds to Construct and Equip New Athletic Fields and Related Facilities Council Member Trayhan made a motion, seconded by Council Member Douglas to accept the election returns for the bond election. Council Member Douglas commented that it was a pleasure to serve the citizens of Schertz .and it was a joy and learning experience to work withthe citizens and the Council. He was not going away and would remain active in some capability. Council Member Trayhan thanked the staff for their support and appreciated the opportunity given to him by the Council to serve for 8 months. #17 OATH MAYOR, COUNCIL Regular Meeting 5-16-06 191 Mayor Baldwin presented the certificate of election to Mr. Jim Fowler for Council Place 1 and Mr. David L. Scagliola for Council Place Mayor Pro TemWilenchikpresented the certificate of election to Hal Baldwin for Mayor. JudyTokar,CitySecretary administered the oath of office to Hal Baldwin for Mayor, Jim Fowler in Council Place 1 and David L. Scagliola in Council Place 2. Mayor Baldwin thanked Mr. Douglas and Mr. Trayhan for their service on the Council. He commended all the candidates on a clean campaign and looked forward to working with the new council. Council Member Fowler introduced his wife Pat and thanked the citizens for their vote and hoped to serve them well. Council Member Scagliola said his wife was at his daughter's graduation and unable to attend. He thanked the citizens who voted for him and felt humbled to be sitting here. Mayor Baldwin introduced his wife, Barbara and his family. He appreciated the opportunity to serve the City and would serve to the best of his ability. #18 by City Manager and Staff Mr. Taylor said he and his staff appreciated Mr. Douglas' and Mr. Trayhan's willingness to serve and welcomed the new members, Mr. Fowler and Mr. Scagliola. Mr. Spain handed out the copy of the new Charter and a draft ordinance of the new rules and procedures for Council Meetings. The meeting procedures are part of the ordinance simplifying them into one document. #19 Items by Council Council Member Fowler said it was areal learning experience going through a campaign and one thing that impressed him was that he realized how important the voters were. Council Member Scagliola no comment. Council Member Agee - Welcomed the new Council members. Mayor Pro Tem.Wilenchik thanked Mr. Douglas and Mr. Trayhan for their service and welcomed the new Council Members. Council Member Carpenter thanked Mr. Douglas and Mr. Trayhan for their. service, stating it was a privilege serving with them, and also welcomed the hew members. He also thanked Mr. Spain for his work on the Charter, and also . thanked the Charter Review Committee and the Bond Committee. Mr. Carpenter thanked the families of the those who served for the sacrifice the families have to make. Regular Meeting 5-16-06 192 #20 Mayor Baldwin thanked Mr. Bob Cantu for his service on the Charter Review Committee.
