MINUTES WORKSHOP SESSION OCTOBER 12, 2005 The Schertz City Council convened in Workshop Session on Wednesday, October 12, 2005 in the Municipal Complex Conference Room at 7:00 pm, 1400 Schertz Parkway, Schertz, Texas. The following members were present: Mayor Hal Baldwin presiding, Council Members Carl Douglas, John Trayhan, Reginna Agee, Tony Wilenchik and Michael Carpenter. City Manager Don E. Taylor and Judy Tokar City Secretary. #1 CALL TO ORDER. Mayor PrOl. Tern Agee called the meeting to order at 7:00 p.m. #2 HEARING OF RESIDENTS Robert Brockman, 1000 Elbel Road wanted to know what state representative was responsible for allowin~ the flooding to occur over FM15l8, reminded Council of the meeting on October 13 t with Congressman Cuellar regarding transportation funding. Mayor Baldwin arrived at 7:03 p.m. . Johnie McDow, with BVY A, reported 250 kids played football, 50 cheerleaded and 15 volleyball teams. They are working on the fields and registration for spring ball starts in mid Jan 2006. It was a good turn out for football this year which was anticipated. Mr. McDow invited the Council to come their meetings. #3 Presentation by Jerry Mendenhall and Discussion on the Library Feasibility Study. Mr. Mendenhall explained the study was based on a three-prong approach. The three approaches were to visit different libraries including where Melissa Uhlhorn was previously employed, interviewed the users and staff and used the Texas Public Libraries Standard as a template for this library. The three libraries visited were Cedar Park, San Marcos and New Braunfels. The Schertz Library has a history of exceptional programs for children and those needs should be provided for and allow for expansion of excellence. Schertz Library primary users are Adult reading and Children programs. . Mr. Mendenhall said the Texas Public Libraries Standard recognizes three levels of service: basic, enhanced and comprehensive. They used the "enhanced" standard as the target-planning guide and modified some of the state's standards to reflect this Library's unique needs and programs. The study was limited to the facilities and collections that impact the building space. The collection goal for this study is to provide 2 volumes per Workshop 10-12-05 4 capita which is near the "Enhanced" rating of the Texas Public Library Standards. The collection areas will be split 75% adult and 25% children's area. . The library services are based on population, which determines the type of facility. Mr. Menhenhall projected in 10 years the population could be between 50,000 to 100,000. The conceptual plan for the building is 35,000 square feet includes circulation, mechanical, and walls and allows for expansion in the future. The library functional areas are staff, adult, and children's collection and work support areas; volunteers support areas; common central and exterior support areas and outside garden space. Ms. Douglas suggested the ideal of a Parks Department horticultural center for learning as well as growing their own plants. The summary of conceptual cost estimates was based on dividing up the different areas and assigning a cost per square foot. Total estimated cost for the building is $6,863,429.00. The cost included the construction of the building and the equipment. Mr. Taylor stated the library started with 20,000 circulations per year and presently is it up to 258,000 circulations annually. Mayor Baldwin said the funding for the library is being considered as part of the bond package along with other proposed projects. #4 Discussion on regarding moratorium in Live Oak Hills Subdivision. . Mr. Spain said the Live Oak Hills Subdivision was platted in the 1960's and has remained undeveloped. The subdivision does not have any infrastructure. There is a procedure under the Local Government Code for City's to impose a moratorium on development if certain prerequisites are met. The initial moratorium was established in February 2005 and expired in July 2005. During that time, the City was looking to the legislature for changes in the law that would spur the development. There is a law in Texas that allows cities to take property and trade it with the developer but it has become very unpopular. Mr. Tony Eugenio, developer and major property owner proposed a PlD for the subdivision. In a PlD, lot owners would be assessed for the infrastructure. After numerous conversations with Mr. Eugenio, the moratorium was extended to November 10th. The condemnation process is one option but Mr. Spain said there are philosophical issues but condemnation is becoming more and more unpopular. It was Mr. Spain's recommendation to let the moratorium expire and come back later to the Council with further information. #5 Discussion on the request from Schertz Chamber of Commerce to lease office space. . Workshop 10-12-05 5 . Mr. Bierschwale, Vice Chair of the Schertz Chamber of Commerce is requesting the use of one of the small offices in the Community Center starting in December for a period of one year. This will give the Chamber time to get well established. The Council agreed that it was a good idea to have a chamber in the city and help them get started. The item will be put on the regular meeting agenda for consideration on October 18. #6 Discussion on traffic problem on Schertz Parkway at Legacy Oaks. Councilmember Wilenchik said on the original site plan there was to be a right turn only out of Legacy Oaks but there was an over sight in the final construction. The Planning and Zoning had concerns because of increased traffic when and if the property developed across the street. They recommended residents exiting onto the access road of IH35. The signage was never installed to direct the traffic across the road for a left turn onto Schertz Parkway. Staff feels that the right turn only out of Legacy Oaks could create a greater problem when vehicle make u-turns at the next median cut through to go to IH35. If a traffic signal is installed the median would have be redesigned. . Councilmember Wilenchik recommended that the City be proactive and install a traffic signal at Legacy Oaks and Schertz Parkway. The traffic will only get worst in the future. Mayor Baldwin asked the agenda item to considered for action on October 18th meeting. #7 Discussion on selection of official City newspaper. Mr. Spain explained the legal notice requirements are to be published in newspapers of general circulation distributed in the City. The City has been using the Seguin Gazette but there are fewer than 50 people in the City that subscribe to the Gazette. The other newspapers available in the general area is the New Brannfels Herald Zeitung, San Antonio Express News, Randolph Herald and the Commercial Recorder. Our records indicated about $25,000.00 was spent on publications and not exclusively with the Seguin Gazette. The Commercial Recorder who owns the Herald has made an offer to publish the notices in the Recorder and publish it in the Herald free of charge. The arrangement would satisfy both the spirit of the law and letter of the law. An Attorney General opinion says if you go out for bids with the situation of the Commercial Recorder and Herald, you can take into account the Herald's circulation in deciding what is the lowest and best offer. . It was noted by numerous concerned citizens that if the legal notices were being published in a newspaper that met the legal requirement it was not serving the majority of the citizens. Workshop 10-12-05 6 Council requested that the bidding process for the official City newspaper be on Oct. 18th agenda for action. . #8 Discussion on appointment of an alternate to the Charter Review Committee. Mr. Spain explained that there was a recommendation by the Mayor to appoint Mr. Greenwald as alternate on the Charter Review Committee. There is no provision to allow for an alternate but suggested Mr. Greenwald be appointed as a resource advisor. The appointment will be on the October 18th agenda for action. #9 Discussion on the review of applications and appointments to the Planning and Zoning Commission. Councilmember Wilenchik asked that the discussion of the applicants be in a closed session at the October 18th meeting. Mr. Spain was asked to research the proVISIOn nnder the Open Meetings Act if discussions would be allowed in closed session for appointments to the Planning and Zoning Commission. #10 Discussion on canceling the Workshop Session on Wednesday, October 26, 2005. . The reason for canceling the workshop, there will be several Council and staff mernbers attending the TML conference. The item will be considered for action on the October 18th meeting. #11 ORDINANCE: Discussion on ("mal reading of Ordinance of the Code of Ordinances, revising Chapter 18 - Traffic and Motor Vehicle, Section 18-32, Stop Intersections. There being no discussion; the item will be on the agenda of October 18th for action. #12 ORDINANCE: Discussion on ("mal reading on an Ordinance by the City Council of the City of Schertz, Texas amending the Unified Development Code (UDC) Ordinance 96-S-28 by rezoning 4.0+ acres out of the Rafael Garza Survey, Abstract No. 98. Comal County, Texas from Pre-Development (PD) to Manufacturing District-Light (M-l) There being no discussion; the item will be on the agenda of October 18th for action. #13 Items by City Manager Taylor and Staff General Announcements . Workshop 10-12-05 7 . . Mr. Taylor asked Council if they were interested in participating in the Metrocom Chamber of Commerce Air Show Reception on November 4th at Olympia Hills Golf and Conference Center. Council was not interested. #14 Items by Council General Announcements Councilmember Douglas · Plans to attend the Congressman Cuellar's meeting in Seguin on October 13th regarding highway funding Mayor Pro- Tem Agee No Comment Councilmember Trayhan · Attended Planning and Zoning meeting, reported on action taken by commission. . Appreciated the staff attending the armual Plarming conference. Councilmember Wilenchik . . Reminded Mayor Baldwin about sending letter to Guadalupe County about youth serving community service behind the bar at the VFW. Announced armual fundraiser for the Schertz Humane Society on Sat., Oct. 16th. . Councilmember Carpenter . Asked about Council Chamber construction status · Recommended that if the city seal was to be used on printed material that it be not be stretched or warped, leave in it's original design. # 15 Items by Mayor General Announcements .
