ccrg 05-07-02 Schertz City Council – Regular Session Tuesday, May 7, 2002 The Schertz City Council convened in regular session on Tuesday, May 7, 2002 at 7:00 pm in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Schertz, Texas. The following members were present: Mayor Hal Baldwin, presiding, council members Norma Head, Billy Pitts, Reginna Agee, Tony Wilenchik and Ken Greenwald. Staff members present were City Manager Dewey Cashwell and Deputy City Secretary Mary Ybarra. At this time, Mayor Baldwin welcomed a room full of students from Joyce Briscoe's government class. He then asked everyone to rise and join him in the Pledge of Allegiance to the Flag. #1 PRESENTATION: Mayor Baldwin presented a plaque to Roger and Karen Olsen in recognition of their life saving effort on April 25, 2002. The Olsen's saved the lives of three men at 701 Aero Ave, who's home was burning. The Olsen's were driving by that morning and if not for their quick action, three sleeping men could have been seriously injured or worse. It so happens, that Mr. Olsen is a fireman with the San Marcos Fire Department, and some fellow firemen join him this evening. Mr. Olsen made introductions of those present and also introduced his mother and children that were present. # 2 PROCLAMATION: Mayor Baldwin read a Proclamation recognizing the week of May 12-18, 2002 as National Nursing Home Week. Ms. Darlene Evans, owner of Autumn Winds Retirement Home and resident accepted the proclamation and thanked council for their support. #3 Swearing in of Mayor and Councilmembers Place 1 and 2. Norma Althouse, City Secretary sworn in the Mayor, Hal Baldwin, Norma Head, Place1, and Billy Pitts, Place 2, as elected officials. No election was held May 4, 2002, because all candidates were unopposed. Approval of Minutes: #4February 27, 2002 March 5, 2002 March 19, 2002 Without further discussion, Ken Greenwald moved to approve the above minutes as presented. Reginna Agee seconded the motion, which carried with the following votes: AYES: Council members, Head, Pitts, Agee, Wilenchik and Greenwald. NAY: None. Before continuing with the next agenda item, Mr. Cashwell, introduced the new Chief of Police, Steve T. Cantrell. The new Chief brings a fine family to the community, his wife Jill and children, Taylor and Parker, Taylor of teenage years and Parker thoroughly enjoying the playscape. Chief Cantrell spoke briefly and thanked everyone for they're confidence and support. He hopes to meet and exceed all expectations. He is assuming command of a very good department and looks forward to a good future. Hearing of Residents: # 5 No residents signed up to speak. #6 ORDINANCE: Consider and take action on final reading of ordinance amending Article VII of the Code of Ordinances, Garage Sales. Mayor Baldwin introduced an ordinance and read the caption as follows: ORDINANCE NO. 02-L-6 BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS PROVIDING THAT THE CODE OF ORDINANCES OF THE CITY OF SCHERTZ, TEXAS BE AMENDED BY REVISING CHAPTER 10, MISCELLANEOUS OFFENSES AND PROVISIONS, ARTICLE VII, GARAGE SALES, SECTION 10-102 (c), SECTION 10-102 (d) AND SECTON 10-103 (a). (b) and (d); PROVIDING AN EFFECTIVE DATE AND PROVIDING A REPEALING CLAUSE. Mayor Baldwin noted the ordinance simply raises the fees of garage sale permits from $5 to $10. City Inspector, Leonard Truitt indicated ordinance also changes enforcement policy. Mrs. Agee moved to approve the final reading of an Ordinance amending Article of the Code of Ordinances, Garage Sales. Mrs. Head seconded the motion, VII which carried with the following votes: AYES: Councilmembers Head, Pitts, Agee, Wilenchik and Greenwald. NAY: None. #7 Ordinance: Consider and take action on final reading of ordinance amending Chapter 16 of the Code of Ordinances, Street and Sidewalks. Mayor Baldwin introduced an ordinance and read the caption as follows: ORDINANCE NO. 02-M-7 BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS PROVIDING THAT THE CODE OF ORDINANCES OF THE CITY OF SCHERTZ, TEXAS BE AMENDED BY REVISING CHAPTER 16, STREETS AND SIDEWALKS, ARTICLE 1, IN GENERAL, SECTION 16-5 (a) and (b) AND SECTION 16-6; PROVIDING AN EFFECTIVE DATE; AND PROVIDING A REPEALING CLAUSE. City Inspector, Leonard Truitt indicated ordinance is simply housekeeping items however, there was a penalty section added to the ordinance. Mr. Greenwald moved to approve the final reading of ordinance amending Chapter 16 of the Code of Ordinances, Street and Sidewalks. Mr. Pitts seconded the motion, which carried with the following votes: AYES: Councilmembers Head, Pitts, Agee, Wilenchik and Greenwald. NAY: None. #8 Ordinance: Consider and take action on final reading of ordinance amending Ordinance 98-L-34, Alcoholic Beverages. Mayor Baldwin introduced an ordinance and read the caption as follows: ORDINANCE NO. 02-L-8 BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS PROVIDING THAT THE CODE OF ORDINANCES OF THE CITY OF SCHERTZ, TEXAS BE AMENDED BY REVISING CHAPTER 3, ALCOHOLIC BEVERAGES, SECTION 3.2 (c); PROVIDING AN EFFECTIVE DATE; AND PROVIDING A REPEALING CLAUSE. Once again, City Inspector, Leonard Truitt indicated this ordinance is an official update and simply housekeeping issues. Mrs. Head moved to approve the final reading of ordinance amending Ordinance 98-L-34, Alcoholic Beverages. Mr. Greenwald seconded the motion, which carried with the following votes: AYES: Councilmembers Head, Pitts, Agee, Wilenchik and Greenwald. NAY: None. #9 ORDINANCE: Consider and take action on first reading of ordinance revising Section 18-76, Maximum Limits on Specific Streets. Mayor Baldwin introduced an ordinance and read the caption as follows: AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS PROVIDING THAT THE CODE OF ORDINANCES OF THE CITY OF SCHERTZ, TEXAS BE AMENDED BY REVISING SECTION 18-76, MAXIMUM LIMITS ON SPECIFIC STREETS; AND PROVIDING A REPEALING CLAUSE. Mr. Cashwell indicated this ordinance came about at the request of neighborhoods and conditions of these neighborhoods in terms of pedestrian activity throughout specific streets. Mr. Pitts moved to approve the first reading of ordinance revising Section 18-76, Maximum Limits on Specific Streets. Mrs. Agee seconded the motion, which carried with the following votes: AYES: Councilmembers Head, Pitts, Agee, Wilenchik and Greenwald. NAY: None. # 10 ORDINANCE: Consider and take action on ordinance amending the code of ordinances Chapter 2, Administration, Article 1, in General, Section 2-8, Competitive Bids for purchases and sales; providing an effective date and declaring an emergency. Mayor Baldwin introduced an ordinance and read the caption as follows: ORDINANCE NO. 02-M-9 BY THE CITY COUNCIL OF THE CITY OF SCHERTZ AMENDING THE CODE OF ORDINANCES OF THE CITY OF SCHERTZ, TEXS, CHAPTER 2, ADMINISTRATION, ARTICLE 1, IN GENERAL, SECTION 2-8, COMPETITIVE BIDS FOR PURCHASES AND SALES; PROVIDING AN EFFECTIVE DATE AND DECLARING AN EMERGENCY. Mr. Cashwell indicated this ordinance replaces the city's ordinance in alignment with State law requirements in terms of competitive bids. It allows the ordinance to be in keeping with the practices and regulations of state statute. In terms of those changes, when there are changes to the state statute, the city ordinance also changes. Mrs. Agee moved to approve the ordinance amending the code of ordinances Chapter 2, Administration, Article 1, in General, Section 2-8, Competitive Bids for purchases and sales; providing an effective date and declaring an emergency. Mr. Greenwald seconded the motion, which carried with the following votes: AYES: Councilmembers Head, Pitts, Agee, Wilenchik and Greenwald. NAY: None. #11 Consider and take action appointing Joe Potempa to the Board of Adjustment. Mr. Greenwald moved to appoint Joe Potempa to the Board of Adjustment. Mr. Wilenchik seconded the motion, which carried with the following votes: AYES: Councilmembers Head, Pitts, Agee, Wilenchik and Greenwald. NAY: None. #12 Consider and take action on appointing a member of city council as liaison between the city and the following: a. Schertz Humane Society b. Schertz Housing Authority Mayor Baldwin stated that the president of the Human Society; Mrs. Pia Jarmon has requested a liaison from city council. Mr. Wilenchikhas volunteered to serve in that capacity. Mayor Baldwin asked for volunteer to serve on the Schertz Housing Authority. Mr. Billy Pitts volunteered to serve as liaison on the Schertz Housing Authority. Because this is an action item, Mayor Baldwin asked for a motion. Mrs. Agee moved to appoint Mr. Billy Pitts as liaison to the Schertz Housing Authority, and Mr. Tony Wilenchik as liaison to the Schertz Human Society. Mrs. Head seconded the motion, which carried with the following votes: AYES: Councilmembers Head, Pitts, Agee, Wilenchik and Greenwald. NAY: None. Mr. Cashwell informed council on letter received from Texas Department of Transportation relative to plans to submit FM3009 in Schertz from IH 35 east to the future extension of Wiederstein Road to the MPO for funding consideration. These proposed improvements have estimated cost of $1,500,000 of which include: widen the existing 4-lane highway to include a raised center median, and access management strategies to enhance the operations and safety of corridor. Mr. Cashwell made mention of several meetings coming up: July 25-27, 2002, El Paso, for Mayors, Councilmembers and Commissioners, May 20, 2002, San Antonio, a session for Planning Commissioners and Staff sponsored by the Texas Chapter of the Planning Association. He asked if anyone is interested, please let us know so arrangement maybe made.
