12-30-2002 Schertz City Council - Special Session Monday, December 30, 2002 The Schertz City Councii convened in special session on Monday, December 30, 2002 at 7:00pm in the Municipal Complex Conference room, 1400 Schertz Parkway, Schertz, Texas. The following members were present: Mayor Hal Baldwin, presiding; Councilmembers Steve Simonson, Tony Wilenchik and Ken Greenwald. Late arrivai Councilmember Agee (7:25 p.m.). Staff members present were City Manager Mark Marquez and Deputy City Secretary Mary Ybarra. Mayor Baldwin called the meeting to order at 7:00pm. #1 ORDINANCE: Discussion and possible action on emergency reading of Ordinance regarding annexation. Mark Marquez, City Manager briefly explained the annexation request, added warranty deed with vendor's iien was acquired. The annexation of property is approximately 88 acres, the entire acreage being 96.76 acres of which portion of property (frontage) is already in the city. Mr. Griffith, representative is present to answer any questions council may have. Mayor Baldwin introduced an ordinance and read the caption as follows: ORDINANCE NO. 02 A-27 AN ORDINANCE PROVIDING FOR THE EXTENSION OF THE BOUNDARY LINES OF THE CITY OF SCHERTZ, TEXAS BY THE ANNEXATION OF CERTAIN TERRITORY OWNED BY HILLSTAR INVESTMENTS, LTD.; DECLARING AN EMERGENCY; AND RELATED MATTERS. Counci]member Wilenchik moved to approve the ordinance providing for the extension of the boundary lines of the City of Schertz, Texas by the annexation of certain territory owned by Hilistar Investments, Ltd.; and declaring an emergency. Councilmember Simonson seconded the motion, which carried with the following votes: AYES: Councilmembers Simonson, VVilenchik and Greenwald. NAY: None #2 BID REJECTION: Consider and take action rejecting bid for Wiederstein Road Project. Mr. Marquez, City Manager explained memo as part of council packet outlines reasons for bid rejections. In review, it was found two of the three bidders did not qualify, forms filled out incorrectly, improper tabulations, etc. For this reason, there is a need to re-advertise, and go out for bids on this issue. 84 In bdef discussion, it was determined bids exceeded the budget amount. It was also pointed it only left one responsive bid, and recommendation of Engineer is to reject all bids on the project and re-advertise. Councilmember Simonson moved to reject all bids for the Wiederstein Road Project and go out for new bids. Councilmember Greenwald seconded the motion, which carried with the following votes: Before vote was called, a brief discussion was held on price variation submitted. It was pointed out these are some of the reasons for recommendation to reject bids. A vote was called at this time. AYES: Councilmember Simonson, Wilenchik and Greenwald. NAY: None. #3 Items by City Manager General Announcements City Manager Marquez commented on council FYI memo's and stated they were worthy of review. He added Association of Mayors Conference information is included in packet and asked if anyone was interested in attending to please call so reservations can be made. #4 Items by Council General Announcements Councilmember Simonson 4-B Board Liaison BVYA Councilmember Simonson advised he would be out of town for about a week. He will be available for councils first meeting in January. Councilmember Agee 4-B Board Liaison Schertz Housing Authority Liaison Schertz Library Board No comment, however, apologized for her tardiness. Councilmember Wilenchik 4-B Board Liaison Schertz Humane Society Liaison HOA Coalition 85 Councilmember Wilenchik asked Johnny Bierschwale, Assistant City Manager on upcoming meeting and asked if meeting had been scheduled. He was asked, what Thursday would he be available. He is open for any Thursday. Meeting will be scheduled at 6 p.m. on a Thursday and he would be advised. Councilmember Greenwald 4-B Board Ex-officio P & Z Commission Ex-officio SSLG Corp. Councilmember Greenwald passed out agenda of December 19, 2002 meeting of the SSLGC, minutes, pumping tests conducted, finance memorandum, Linda Duncan report on Gonzales County Underground Water Conversation District (GCUWCD) meeting, which included agenda, minutes and memo on SAWS well test program. It was pointed out wells 7 & 8 are to go on line. Mr. Marquez reported he has given the go ahead, he stressed it's important to proceed. At this time, question was asked, when would Schertz water be on line? Johnny Bierschwale advised construction is 750' away. Right now construction is sitting at City of Marion arena, where owner of property is giving the contractor some problem.
