Schertz City Council – Regular Session
Tuesday, January 7, 2003
The Schertz City Council convened in regular session on Tuesday, January 7, 2003 at
7:00pm in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Schertz,
Texas. The following members were present: Mayor Hal Baldwin, presiding, council
members Steve Simonson, Reginna Agee, Tony Wilenchik and Ken Greenwald. Staff
members present were City Manager Mark Marquez and Deputy City Secretary Mary
Ybarra.
Mayor Baldwin welcomed everyone and called the meeting to order. He asked for
everyone to rise and join him in the Pledge of Allegiance to the Flag.
#1 Hearing of Residents:
Julie Scherader
, representing the Students in Christ Youth Center (Oak Street), passed
out flyer inviting everyone to the Grand Opening of the "Kids Café" on Friday, at 5:30
p.m. She personally would like to invite council to attend, representing the city. Everyone
is invited; the news media will be present as well as various community leaders. This is a
time for families to come together, get a free meal, and have lots of fun. Sponsors for the
grand opening are the San Antonio Food Bank and Bank One. Ms. Scherader thanked
council for their time.
Robert Brockman
, 4505 Grand Forrest had the following comments:

Once, again he would like to bring up the issue of the four way stop at Ashley Oak
Drive. Before the sign is taken out he believes the HOA should be informed of the
change. This would stop a flood of calls from the HOA.
#2 Presentation of Gordon Dunkley of the Randolph Metrocom Chamber of
Commerce.
Mayor Baldwin informed everyone Mr. Dunkley was unable to attend and moved on with
the agenda.
#3 Recognition of certified Paramedics.
At this time, Mayor Baldwin and EMS Director, Dudley Wait presented certificates and
patches to those individuals (EMT) and (EMT-1) completing a Paramedic course, which
started January, 2002 and finished December 12, 2002 (meeting Monday -Thursday,
eight hours a day), resulting in successfully passing the State Paramedic exam. Those
individuals are:

#4 Approval of Minutes:

Councilmember Simonson moved to approve the above minutes as presented.
Councilmember Agee seconded the motion, which carried with the following votes:
AYES:
Council members, Simonson, Agee, Wilenchik and Greenwald.
NAY:
None.
#5 ORDINANCE:
Consider and take action approving final reading of
Solicitor's Ordinance.
Mayor Baldwin introduced an Ordinance and read the caption as follows:
ORDINANCE 03-L-01
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS
REPEALING CHAPTER 13 OF THE CODE OF ORDINANCES OF THE
CITY OF SCHERTZ RELATING TO PEDDLERS, SOLICITORS AN
INTINERANT MERCHANTS, WITHIN THE CITY OF SCHERTZ, AND
REPLACING WITH A NEW CHAPTER 13, "PEDDLERS AND
SOLICITORS"; PROVIDING A PENALTY CLAUSE; PROVIDING A
REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND
PROVIDING AN EFFECTIVE DATE.
Mr. Marquez pointed out that the only changes or additions to the ordinance were an
application, contractor license card, and Crime Watch sign that would be placed on the
door. These additions are included as part of council packet.
Councilmember Greenwald moved to approve final reading of Solicitor's Ordinance.
Councilmember Agee seconded the motion, which carried with the following votes:
AYES:
Councilmembers Simonson, Agee, Wilenchik and Greenwald.
NAY:
None.
#6 Discuss and take action on first reading of Ordinance adopting Guidelines
and Criteria for Tax Abatement and Reinvestment Zone.
Mr. Marquez explained that the city sunsets the ordinance. The ordinance is reviewed
every two years for changes if needed. The old ordinance expired on December 31, 2002.
No substantial changes have been made. Changes were minimal; includes modifying
application process dealing with developers requesting tax abatements, and more
attractive incentives.
Mr. Marquez advised that Amy Madison, Community Development Director would be
available at next workshop for a detailed up dated on the city's tax abatement program.
Mr. Marquez pointed out that the city gets back approximately $3 for every dollar
invested. He believes the program is successful and recommends the continuation.
Councilmember Simonson moved to approve first reading of Ordinance adopting
Guidelines and Criteria for Tax Abatement and Reinvestment Zone. Councilmember
Agee seconded the motion, which carried with the following votes:

Councilmembers Simonson, Agee, Wilenchik and Greenwald.
NAY:
None.

General Announcements
Advised council of five (5) applicants received for Council vacancy of Place 1, scheduled
for Special Election on February 1,2003.
Stated he would be out of town Thursday and Friday for a 4-B Board Conference in
Corpus Christi. In his absence, Chief Cantrell, will be acting City Manager on Thursday
and Assistance City Manager, Johnny Bierschwale on Friday.

Reported BVYA was working on signing up ball players for the new season.
Reported coming across a 1936 Hammond World Atlas. He thought council would like to
know that the two cities listed in Guadalupe County, west of Seguin were Schertz, and
Marion. The Schertz population in 1936 was 409.

Reported meeting with the Library Board last night, and was advised the stats were up
tremendously, 51%. Also, they are in need of volunteers for the bookstore.

General Announcements
Mayor had nothing to report, however stated it was a pleasure to see the City' s EMS
upgrade.
#10 EXECUTIVE SESSION: Called under Chapter 551, Texas Government
Code, Sub-Section 551.072, Deliberation regarding real property.
An Executive Session was held 7:20 p.m. to until 8:45 p.m.
#11 Action, if any, on above Executive Session.
No action was taken.
Before adjournment Mr. Marquez wanted to remind council of the Mayors,

Councilmembers Conference, Feb. 7-10in Austin. If anyone has an interest, let us know
so reservation may be made. There is still time. Councilmember Agee stated she has
made plans to attend.
