SCHERTZ CITY COUNCIL – REGULAR SESSION
TUESDAY, APRIL 20, 2004
The Schertz City Council convened in regular session on Tuesday, April 20, 2004 at
7:00pm in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Schertz,
Texas. The following members were present: Mayor Hal Baldwin, presiding, Council
members Carl Douglas, Steve Simonson, Reginna Agee, Tony Wilenchik and Ken
Greenwald. Staff members present were City Manager Mark Marquez and Deputy City
Secretary Mary Ybarra.
Mayor Baldwin welcomed everyone and called the meeting to order. He asked for
everyone to rise and join him in the Pledge of Allegiance to the Flag.
At this time, Mayor Baldwin recognized and welcomed Samuel Clemens government
students in attendance, Paul Timmons, and Joyce Briscoe, retired teacher attending with
her granddaughter Kim.
#1PRESENTATION TO MAYOR AND CITY BY FORD ENGINEERING
Mr. Ed Ford, City Engineer commented that this past year Ford Engineering was able to
submit an engineering project to the State of Texas (Engineering Excellence Awards
category), and on judging for the State of Texas the project won First Place. As a result of
winning first place the firm was allowed to submit the award nationally to the American
Council of Engineering Companies in Washington D.C. The project wasn’t as fortunate
with the American Council of Engineering Companies, however the accomplishments
and contributions brought together by the project have been recognized by the
engineering industry and noted that the exhibit was displayed in Washington D.C (White
House) during National Engineers Week, and also displayed in Austin, Texas at the
Capitol. Because of the award the project was received a lot of recognition and added
that not only did the project receive first place, but also Ford Engineering is the only firm
in San Antonio to win first place, and this is the second first place by the firm.
Mr. Ford stated that Ford Engineering has been part of Schertz for the last twenty-six
years and it has been extremely rewarding to the firm all these years. With the Councils
forward thinking moving into the computer age of technology the firm has been able to
put together a dynamitic database, which no other small city in the United States has
accomplished, which is a tremendous accomplishment for the City.
At this time, Mr. Ford presented the award to Mayor Baldwin and read the inscription.
Mayor Baldwin acknowledged that Ford Engineering has done a fantastic job for the City
in the last twenty-six years, and thanked him for the recognition the award has brought
the City. Again, Mr. Ford reiterated that it has been rewarding to be associated with the
City all these years.
Mr. Ford went on to say that TML has an award program and the project will be
submitted and possibly the City will see another first place.
Mayor Baldwin as well as City Manager Marquez thanked Mr. Ford for the many years
of service to the City.
At this time, Councilmember Wilenchik took the opportunity to thanked Mr. Ford and
Larry Dublin for their support of the Doggy Dash event.
#2 INTRODUCTION OF NEW EMPLOYEES
Sam Willoughby, Public Works Director introduced new employees to Public Works
Department and gave brief background information on each.

Council welcomed them to the City.
#3 Hearing of Residents:

, 4505 Grand Forrest made the following comments:

A job well done on road stripping of Wiederstein Road.

Mentioned City vehicles need washing.

Informed of more student foot traffic at Savannah Drive and Schertz Parkway
intersection. Children will no longer be bussed if not outside the one-mile area.

Mentioned Ed Kuempel is up for re-election and commented wouldn’t it be
worth asking for his assistances in possibly getting a directional sign for Animal
Control along FM3009. It happens to be a TXDOT issue, however the issue
seems to be placed on the back burner.
??
Again, reiterated what he has said all along, Schertz is a good place to live.
#4 APPROVAL OF MINUTES:

Councilmember Douglas moved to approve the minutes of Special Workshop Session of
January 14, 2004 and Regular Session of January 20, 2004. Councilmember Wilenchik
seconded the motion, which carried with the following votes:
AYES: Councilmembers Douglas, Simonson, Agee, Wilenchik and Greenwald
NAY: None.
#5 ORDINANCE: Consider and take action on final reading of Records
Management Ordinance.
Mayor Baldwin introduced an ordinance and read caption as follows:
ORDINANCE NO. 04-M-13
AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS ESTABLISHING RECORDS MANAGEMENT ORDINANCE AND
APPOINTING A RECORDS MANAGEMENT OFFICER; AND PROVIDING A
REPEALING CLAUSE.
With no changes to ordinance, Councilmember Greenwald moved to approve final
reading of Records Management Ordinance. Councilmember Wilenchik seconded the
motion, which carried with the following vote:
AYES: Councilmembers Douglas, Simonson, Agee, Wilenchik and Greenwald.
NAY: None.
#6 ORDINANCE: Consider and take action on final reading of Ordinance
adopting a moratorium on property development in a platted subdivision and other
matters in connection therewith.
Mayor Baldwin introduced an ordinance and read caption as follows:
ORDINANCE NO. 04-S-14
AN ORDINANCE ADOPTING A MORATORIUM ON PROPERTY
DEVELOPMENT IN A PLATTED SUBDIVISION, AND OTHER MATTERS
IN CONNECTION THEREWITH.
At this time, City Manager Marquez gave a brief explanation of ordinance explaining the
intent and what a moratorium meant. He did this for the government students in
attendance. He went on to say that the area called “Thirteen Row”-Live Oak Hills is not
established for development when it comes to water, sewer, etc. The moratorium gives
the city 120 days, with an option to extend for an additional 120 days to possibly come up
with solution or direction on how to handle the matter.
With no changes to the ordinance, Councilmember Agee moved to approve adopting a
moratorium on property development in a platted subdivision, and other matters in
connection therewith. Councilmember Simonson seconded the motion, which carried
with the following vote:
AYES: Councilmembers Douglas, Simonson, Agee, Wilenchik and Greenwald.
NAY: None.
#7 Consider and take action setting a public hearing date of May 18, 2004 to
rezone properties along the IH-10 Corridor from Residential/Agriculture (RA) to
General Business (GB) and Manufacturing District-Light (M-1).
City Manager Marquez advised this is a good move and went on to say the
Comprehensive Land Plan committee believes this is the way to go.
Councilmember Greenwald moved to set public hearing date of May 18, 2004 to rezone
properties along IH-10 Corridor from RA to GB and M-1. Councilmember Agee
seconded the motion, which carried with the following vote:
AYES: Councilmembers Douglas, Simonson, Agee, Wilenchik and Greenwald.
NAY: None.
#8 Consider and take action setting a public hearing date of May 18, 2004 for a
Specific Use Permit request from Forum Construction Company, Inc. for Block 1,
Lot 14, in the Schertz Business Park to allow for an office/warehouse facility to be
located in the Air Installation Compatible Use Zone (AICUZ).
There was brief discussion on whether the need of specific use permit was required.
Discussion followed on APZ 1 and APZ 2 zones. It is believed if the property is located
in the APZ 2 zone, there is no need for a specific use permit. Other property owners in
the Schertz Business Park were not required to provide a specific use permit at time of
construction, why is particular business?
The matter would be researched, however, it was Council consensus to set public hearing
date anyway, just in case the matter would require a permit after research.
Councilmember Simonson moved to set public hearing date of May 18, 2004 for a

Reminded everyone of the “Doggy Dash” run on the 24, starting at 8:00 am.
Last year at this time, there were a total of 65 registered runners signed up. This
year the total is 96. It looks like over 200 runners are expected the day of the
event. There has been outstanding support and thus far have almost $2,000 dollars
donated from businesses and private contributors. The event T-Shirt is neat and
plans are to submit the shirt for an award.

Reported the audit committee met on Monday, 20. The final audit report will be
ready for the next Council meeting. The audit is a good clean report. GASB 34
.
report is part of the audit this year and it created some set backs plus its' a bit
confusing to understand. However, it's required and the City complied.
