CITY COUNCIL MINUTES
SPECIAL WORKSHOP SESSION
SEPTEMBER 15, 2004
The Schertz City Council convened in Special Workshop Session on
Wednesday, September 15, 2004 at 7:00 p.m. in the Municipal Complex
Conference Room, 1400 Schertz Parkway, Schertz, Texas. Those present
were Mayor Hal Baldwin presiding; Councilmembers Carl Douglas, Steve
Simonson, Reginna Agee, Tony Wilenchik and Ken Greenwald. Those staff
members present were City Manager Mark Marquez and City Secretary
Norma Althouse.
#1 HEARING OF RESIDENTS

Robert Brockman of 4505 Grand Forest had the following comments
1) Feels we need a new public library.
2) The Planning and Zoning meeting last night was crowded.
3) The Police Department is doing a great job on Schertz Parkway.
4) The Jay Walking Ordinance seems to be dead.
5) Has a hard time identifying numbers on new ambulances.
6) Questioned if they will put fill at back gate at Wiederstein Rd.
Kurt Cole of737 BroadleafWay: spoke regarding the basketball court in the
Park at Woodland Oaks. He asked that the City not spend too much money
to remove hoops since they've only been there a short time.
#2 Discuss final reading of an Ordinance approving the proposed
budget for FY 2004/2005.
Mr. Marquez said there were no changes. Council was ready for this to be on
next Tuesday's agenda.
#3 Discuss final reading of an Ordinance approving the proposed tax
rate for FY 2004/2005
Mr. Marquez advised there were no changes to the Ordinance. Council was
prepared for this item to be on next Tuesday's agenda.
. #4 Discuss final reading of Ordinance creating a Municipal Court of
Record in City of Schertz, Texas.

Municipal Court Judge, Stacy Padgett, asked Council to please approve the
Ordinance. They agreed they were prepared for this item to be on next
Tuesday night's agenda.
#5 Consider and Take Action On An Ordinance Correcting Certain
Administrative Provisions of Ordinance 04-E-25 Calling A Special
Election To Be Held In The City Of Schertz, Texas For The Pnrpose Of
Voting On A Proposition Concerning Establishing An Ad Valorem Tax
Ceiling On Residence Homesteads Of The Disabled And Of Persons
Sixty-Five (65) Years Old Or Older And Their Spouses; And Declaring
An Emergency.
Mayor Baldwin introduced an Ordinance and read the caption as listed
above. (The Ordinance number is now 04-E-27)
Mr. Marquez stated the action item this evening doesn't change the date of
the election. It only involves administrative changes.
Mayor Baldwin asked how clear the definition is of disabled. Mr. Marquez
admitted he is not comfortable with the language.

Mr. Simonson felt disabled should be clarified. Mayor Baldwin stated he
read the laws and they are not clearly definitive.
Mr. Greenwald thinks Michael Spain, City Attorney, said specifically it has
to be a disability approved by Social Security.
Mr. Wilenchik moved to approve the Ordinance calling a Special Election as
contained in the caption above. Mr. Simonson seconded the motion, which
carried with the following votes.
AYES: Councilmembers Douglas, Simonson, Agee, Wilenchik and
Greenwald.
NAYS: None.

. #6 Discuss public hearing (scheduled September 21, 2004) on request
from City of Schertz to rezone 78.14 acres from Predevelopment (PD) to
Residential-5 (R-5)
Mr. Marquez stated that when Northcliffe was annexed, we did not rezone
and that needs to be corrected.
#7 Discuss public hearing (scheduled September 21, 2004) on request
from City of Schertz to amend the Comprehensive Land Plan, Chapter
5 Transportation), Figure 5.2 (Master Thoroughfare Plan)
Mr. Marquez informed Council they have before them a map that was
established by the committee. The committee was comprised of members
from City Council, Planning and Zoning, TSAC and staff.
Mr. Marquez advised it went to Planning and Zoning last night and they had
no difficulty accepting it.

After a lengthy discussion, Council felt they were ready to have this item
placed on next Tuesday's agenda.
#8 Discussion regarding Park at Woodland Oaks
Mr. Marquez indicated he was pleased with City Councils recommendations
and with the suggestions ofthe two HOA's.
Mr. Wilenchik thought maybe there were too many basketball hoops. How
about a half court?
Mayor Baldwin referred to Mr. Cole's remark about the cost of removing the
basketball hoops. Mr. Marquez wondered whether or not we should remove
them.
Gail Douglas, Community Services Director, talked about the street light on
the opposite comer of the park not being bright enough. Along that line, Mr.
Wilenchik wants to see the gazebo lit. Mrs. Agee asked if they could use
timed lights.
. Mrs. Douglas reminded Council they need to abide by the City's agreement
with the HOA.

#9 Consider and take action on cancellation of Workshop Session,
October 27, 2004.

Mr. Wilenchik moved to approve cancellation of the workshop session for
October 27,2004. Mr. Greenwald seconded the motion, which carried with
the following votes:
AYES Councilmembers Douglas, Simonson, Agee, Wilenchik and
Greenwald.
NAYS: None

General Announcements
Hometown Hero time is upon us again. Council needs to come up with some
names for submitting an application.
Reminded everyone about the ALS Party in the Park.

Mentioned he thought they were looking at a Sign Ordinance but Mr.
Marquez said that's in progress.

Stated seventeen cases were referred to the Guadalupe County Advocacy
Center last month. They were very appreciative that Mr. Brockman showed
up to help.

Commented he heard rumors people from New Orleans were showing up in
San Antonio to escape flooding from the heavy rains.
