CITY COUNCIL MINUTES REGULAR SESSION APRIL 19, 2005 The Schertz City Council convened in Regular Session on Tuesday, April 19, 2005 at 7:00 p.m. in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Schertz, Texas. Those present were Mayor Pro-Tem Reginna Agee, presiding; Councilmembers Carl Douglas, Steve Simonson, Tony Wilenchik and Ken Greenwald. Absent: Mayor Hal Baldwin. Those staff members present were Interim City Manager John Bierschwale and City Secretary Norma Althouse. Mayor Pro-Tem Agee asked everyone to rise and join her in the Pledge of Allegiance to the Flag. #1 HEARING OF RESIDENTS Robert Brockman of 1000 Elbel commented on the following: . The new lights at the library playscape are nice and that creates a reason for a new bucket truck. . Guadalupe County recognized 911 dispatchers. #2 ORDINANCE: Consider and take action on final reading of Ordinance regarding vehicular weight limits on roadways maintained by the City of Schertz. Mayor Pro-Tem Agee introduced an Ordinance and read the caption as follows: ORDINANCE NO. 05-D-15 BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES OF THE CITY OF SCHERTZ, TEXAS BE AMENDED BY REVISING SECTION 18-45, VEHICULAR WEIGHT LIMITS ON ROADWAYS MAINTAINED BY THE CITY OF SCHERTZ, TEXAS; AND PROVIDING A REPEALING CLAUSE. Mr. Bierschwale advised there have been no changes to the Ordinance since it was discussed at the workshop. Mr. Greenwald moved to approve the final reading of an Ordinance regarding vehicular weight limits on roadways maintained by the City of Schertz. NAYS: None. #3 ORDINANCE: Consider and take action on final reading of Ordinance regarding the authorization to install speed humps on City streets. Mayor Pro-Tem Agee introduced an Ordinance and read the caption as follows: ORDINANCE NO. 05-D-16 BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, PROVIDING THAT CHAPTER 18 OF THE CODE OF ORDINANCES OF THE CITY OF SCHERTZ, TEXAS BE AMENDED TO AUTHORIZE THE INSTALLATION OF SPEED HUMPS ON STREETS IN THE CITY OF SCHERTZ, TEXAS; AND PROVIDING A REPEALING CLAUSE. Mr. Bierschwale indicated there had been no changes since it was discussed at the workshop. Mr. Wilenchik thanked citizens, staff and TSAC for all their input. Mr. Douglas moved to approve the final reading of an Ordinance regarding the authorization to install speed humps on City streets. NAYS: None. #4 ORDINANCE: Consider and take action on final reading of Ordinance regarding amending a Franchise for Roadrunner Towing. Mayor Pro-Tem Agee introduced an Ordinance and read the caption as follows: ORDINANCE NO. 05.F-17 AMENDING A FRANCHISE FOR ROADRUNNER TOWING FOR NON- CONSENT TOWING OF DISABLED OR WRECKED VEHICLES WITHIN THE CITY LIMITS OF THE CITY OF SCHERTZ; IMPOSING PROVISIONS AND CONDITIONS RELATING TO THE EXERCISE OF SAME; AND PROVIDING FOR PENALTIES NOT TO EXCEED $500 FOR VIOLATION THEREOF; AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT WITH THIS ORDINANCE. . . ~ J..K . Mr. Bierschwale stated the Ordinance is ready for action. Roadrunner will pay for the advertisement of it in the Seguin-Gazette. Mr. Greenwald moved to approve the final reading of an Ordinance regarding amending a Franchise for Roadrunner Towing. Mr. Wilenchik seconded the motion, which carried with the following votes: AYES: Councilmembers Douglas, Simonson, Wilenchik and Greenwald and Mayor Pro-Tem Agee. NAYS: None. #5 ORDINANCE: Consider and take action on first reading repealing Ordinance 05-C-04 Relating to Fire Department and establishing a new Ordinance. Mayor Pro-Tem Agee introduced an Ordinance and read the caption as follows: AN ORDINANCE . BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS REPEALING ORDINANCE NO. 05-D-04 AND ESTABLISHING A NEW ORDINANCE FOR CHAPTER 7 OF THE CODE OF ORDINANCES OF THE CITY OF SCHERTZ, TEXAS RELATING TO THE FIRE DEPARTMENT; REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS; ADDING PROVISIONS FOR FEES FOR NON-RESIDENTIAL FIRE PROTECTION SERVICES AND FIRE OPERATIONS; ADDING PROVISIONS FOR FINES OF VIOLATIONS OF CERTAIN PROVISIONS OF THE CODE, INCLUDING A SEVERABILITY CLAUSE; PROVIDING A REPEALING CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE. Mr. Bierschwale related this Ordinance is ready for action. Mr. Douglas moved to approve the first reading of an Ordinance repealing Ordinance No. 05-C-04 relating to Fire Department and establishing a new Ordinance. Mr. Simonson seconded the motion, which carried with the following votes: AYES: Councilmembers Douglas, Simonson, Wilenchik and Greenwald and Mayor Pro-Tem Agee. NAYS: None. . #6 INTERLOCAL AGREEMENT: Consider and take action on Multi-Agency Narcotics Unit Interlocal Agreement. ;J.,J...'t Mr. Bierschwale mentioned that Police Chief, Steve Starr, is available to answer questions. The Police Officers will work as a group along IH-35 and will share the responsibility depending on each entity's number of officers. . Mr. Douglas asked if police dog, Ruger, counts as an officer and was told he does. Ramon Cook, one of the citizens in the audience, asked which county this covers and was told by Mr. Bierschwale it covers Guadalupe County. Mr. Greenwald commented the increase in the flow of traffic along IH-35 makes this agreement appropriate. Mr. Greenwald moved to approve the Multi-Agency Narcotics Unit Interlocal Agreement. Mr. Wilenchik seconded the motion, which carried with the following votes: AYES: Councilmembers Douglas, Simonson, Wilenchik and Greenwald and Mayor Pro-Tem Agee. NAYS: None. #7 BID AWARD: Consider and take action on awarding bid for Civic Center. . Mr. Bierschwale recommended the bid be awarded to Vertex in the amount of $1,940,000.00. The contractor would have 300 days from the day the bid is awarded to complete the project. He went on to say they saved money on the PID project and part of that money could be used for this project since it came in over the projected estimate. Mr. Wilenchik explained there was an increase in the price of gasoline, steel and other supplies which they did not forsee. The project remains the same as requested. He then asked if the City would still hold functions at the Community Center while the Civic Center project is being completed and was told they would. Mr. Greenwald moved to award the bid for the Civic Center project to Vertex in the amount of $1 ,940,000.00. Mr. Wilenchik seconded the motion, which carried with the following votes: AYES: Councilmembers Douglas, Simonson, Wilenchik and Greenwald and Mayor Pro-Tem Agee. NAYS: None. . .?,~ . #8 Items by Interim City Manager General Announcements . Noted the mobile home has been moved and will be transported to the sub-station up off IH-35. . Informed Council they are designing a petition to go out with the water bills for those residents with a Cibolo address in the hopes of getting their zip code changed to 78154. The results will be turned over to the Post Office and if they get a 51 % response or more, it will be placed on a federal ballot. Mr. Douglas asked if this includes Northcliffe and was told it does. Mr. Wilenchik added it initially came up at a Homeowners's Association meeting. #9 Items by Council General Announcements Councilmember Douglas Liaison - EDC Liaison - Schertz Library Board . . Mentioned the Sign Ordinance Committee met yesterday and they are moving along. There is no time limit. They will take whatever time is needed. They meet every other week. . Commented he received an invitation, through the City, to a lecture on April 15th and he and his wife, Marjorie, attended. It was an opportunity of a lifetime. Mayoral candidate Carroll Schubert was there and was part of his group, so he had an opportunity to spend time with him. It was a very good event. Councilmember Simonson Liaison - BWA . Commented he had been discussing the beautification of FM 78 with Community Director, Gail Douglas, and would like to have it placed as an item on an upcoming workshop agenda. Councilmember Wiilenchik 4-B Board Liaison - Schertz Humane Society Liaison - HOA Coalition Ex-officio - TSAC Investment Advisor . 231 Reminded everyone of the Doggie Dash coming up on May 21st. The . contributions so far total over $4,000. He left some brochures with the City Secretary to display at City Hall for public information. They are attracting more than. dog owners. Last year they had roughly 200 participants and this year they're hoping to break 250. If so, they should raise approximately $5,000. Council member Greenwald 4-B Board Ex-officio - P&Z Commission Ex-officio - S/SLGC . Stated he missed the last Planning and Zoning Commission meeting. . Remarked the Schertz/Seguin Local Government Corporation meeting date has changed three times in the past week. As of right now, it is scheduled for May 2, at 1 :30 p.m. at the Police Department training room. He cannot make it because he does not wish to change his vacation dates. Could anyone attend in his place? Mr. Douglas asked what day of the week that is and when told it's a Monday, said he would try to attend. . Related attending the BVYA meeting last night because Mr. Simonson was under the weather. They have 850+ children registered this year. It helps that now they get to use the fields in Cibolo. Mr. Wilenchik inquired . when the new recreational facilities are slated to go out for bid. Mrs. Douglas replied they have a pre-bid meeting next week and bids are scheduled to be opened on May 10th. Mr. Bierschwale informed Council they advertised in San Antonio and Austin newspapers as well as the Seguin-Gazette. Mr. Greenwald remarked once the new fields are operational, they need to look at what to do with the Pickrell Park fields because they are still good fields. #1 0 Items by Mayor General Announcements . Mayor Pro-Tem Agee thanked Terry Aikman for providing snacks to the Guadalupe County Children's Advocacy Center. She mentioned some pamphlets were printed about the Center as the result of an anonymous donor. Mr. Greenwald asked if ithey just deal with sexual abuse and Mrs. Agee responded that's what the Center targets, and so far this month they've had twelve cases. At this time Mr. Wilenchik asked if there was any update on HEB opening up their parking lot. Sam Willoughby, Public Works Director, replied they were supposed to have started Monday. ASV is doing the project . '-32. . Mr. Wilenchik then asked about progress on the interconnecting road between HEB, McDonald's and Diamond Shamrock. Mr. Bierschwale told him the owners are trying to work out a contract. Mr. Bierschwale reminded Council there would be a meeting next Monday evening, April 25th, at 6:00 p.m. to interview candidates for the City Manager's position. Mayor Pro-Tern Agee then mentioned there is no need for an Executive Session and Council agreed. The Executive Session (involving #11 and #12 on the agenda) was not held. #13 ADJOURNMENT Thee being no further business to discuss, Mayor Pro-Tern Agee adjourned the meeting at 7:29 p.m. .
