COUNCIL - REGULAR SESSION
TUESDAY, JULY 5, 2005
The Schertz City Council convened in regular session on Tuesday, July 5, 2005 at
7:00 pm in the Municipal Complex Council Chambers, 1400 Schertz Parkway,
Schertz, Texas. The following members were present: Mayor Hal Baldwin
presiding, Council Members Carl Douglas, Steve Simonson, Reginna Agee, Tony
Wilenchik and Michael Carpenter. City Manager Don E. Taylor and Recording
Secretary Evelyn Boggess.
Mayor Baldwin called the meeting to order at 7:00 pm and asked everyone to rise and
join him in the Pledge of Allegiance to the flag.
#1 INTRODUCTION OF NEW EMPLOYEES
Police Chief, Stephen Starr introduced three (3) new employees, Catherine White as a
dispatcher, Officers Frank Schmidt and Sherman Rarrison as new Police Officers to the
City of Schertz Police Department.
Mayor Baldwin and Council welcome all.
#2 HEARING OF RESIDENTS

John Arrinl!ton, 19387 Old Wiederstein Road, Cibolo, Texas, briefed Council on Old
Wiederstein Road and Belmont Park Sub-division, Mr. Arrington provided a handout to
Council concerning Old Wiederstein Road and Belmont Park Sub-division. Mayor
Baldwin recommended that Mr. Arrington also provide a copy of the handout to Mr.
Larry Dublin ofFord Engineering who was present.
Robert Brockman, 1000 Elbel Road, had questions concerning item #6, the extension of
a moratorium. Mayor Baldwin responded that City Attorney, Michael Spain had
answered that question at a previous council meeting.
#3 PUBLIC HEARING: On establishing Reinvestment zones for:
a. TC II Land, L.P.
b. ProLogis Development Services
Amy Madison, Economic Development Director, explained that it is required to establish
the reinvestment zone prior to the adoption of tax abatement.
With no further discussion, Mayor Baldwin declared the public hearing closed.
#4 ORDINANCE: Consider and take action on first reading of Ordinance
establishing the TC II Land, L.P. Reinvestment Zone.

Council Member Douglas moved to establish the TC II Land, L.P. Reinvestment Zone.
Council Member Simonson seconded the motion, which carried with the following votes:
AYES: Council Members Douglas, Simonson, Agee, Wilenchik and Carpenter.

#5 ORDINANCE: Consider and take action on first reading of Ordinance
establishing the ProLogis Development Services, Inc. Reinvestment Zone
Mayor Baldwin introduced an Ordinance and read the caption as follows:

REINVESTMENT ZONE.
Amy Madison, Economic Development Director, made an announcement that Rome
Depot has signed a lease agreement with ProLogis.

Eric Brown, representative from ProLogis, explained that Rome Depot would be using
approximately 95,000 square feet of the building and that two (2) other companies were
looking to lease the balance of the new building. Mr. Brown stated that ProLogis feels
confident about having the building 100% leased before construction is finished.
Mayor Baldwin asked if Rome Depot would use facility as warehouse space, Mr. Brown
explained that this would be one of three (3) service centers in Texas.
Council Member Simonson moved to establish the ProLogis Development Services, Inc.
Reinvestment Zone. Council Member Agee seconded the motion, which carried with the
following votes:

#6 ORDINANCE: Consider and take action on fmal reading of Ordinance
extending a moratorium on property development in a platted subdivision and other
matters in connection therewith
Mayor Baldwin introduced an Ordinance and read the caption as follows:

ORDINANCE NO. 05-S-31
AN ORDINANCE EXTENDING A MORATORIUM ON PROPERTY
DEVELOPMENT IN A PLATTED SUBDIVISION, AND OTHER
MATTERS IN CONNESTION THEREWITH.
Tonv EUl!enio of 14502 Brook Rollow addressed council on this matter. Mr. Eugenio
owns approximately 150 to 160 lots in the Live Oak Rills subdivision and has addressed
council on this matter as early as last December with letters. Mr. Eugenio has submitted
letters to City Attorney, Michael Spain, but has not met with him to discuss options that
may be available. Mr. Eugenio does not have an objection to the moratorium at this time,
but would like the City of Schertz to move ahead with some plan. Mayor Baldwin
explained that the City is trying to find a legal way to resolve the issues of this area so
that the City can work with Mr. Eugenio to develop this subdivision. Mayor Baldwin
asked Assistant City Manager, John Bierschwale, where does the situation stands. Mr.
Bierschwale explained that it's a legal matter. City Manager, Taylor explained that the
City Attorney is researching the issue and that the legal process is to be followed and at
this time the moratorium is part of that process.
With out further discussion Council Member Douglas moved to approve final reading of
ordinance extending a moratorium on property development in a platted subdivision.
Council Member Wilenchik seconded the motion, which carried with the following votes:

#7 AGREEMENT: Discussion and Possible action regarding an Agreement for
Management Services Between the City of Schertz and the Schertz-Seguin Local
Government Corporation.
It was explained the agreement pertains to the hiring of a General Manager for the
Schertz-Seguin Local Corporation facilities. The General Manager would be assigned to
the City of Schertz and paid from the city budget, and then the Schertz-Seguin Local
Government Corporation would reimburse the City of Schertz. The council had several
questions concerning the document and asked the Assistant City Manager Bierschwale to
researched questions pertaining to the agreement and presents them at next workshop
meeting.
#8 CALLING FOR PUBLIC HEARING: Consider and take action calling a
public hearing on July 14, 2005 for the following:
a. Request to rezone 3.0i: acres from Residential! Agriculture
b. Request to amend the Unified Development Code
.
At this time, Council Member Agee moved to call for a public hearing on July 14, 2005
for the following:

#9 REAPPOINTMENTS: Consider and take action on reappointment of Board of
Adjustment members.
Council Member Agee moved to reappoint Earl Rartzog and Ted Duigon to the Board of
Adjustments. Council Member Douglas seconded the motion, which carried with the
following votes:
AYES: Council Members Douglas, Simonson, Agee, Wilenchik and Carpenter
NAYS: None
#10 Items by City Manager Taylor
General Announcements
. The Council was invited to attend a demonstration of the Pathfinder equipment
used by the City of Schertz Fire Department on July 7, 2005 at 2:00 pm in the
Community Center. This equipment is used to locate downed firemen so that the
fireman can be removed from danger quickly.
. Mr. Taylor also explained that the City Planner, Nancy McBeth is working very
hard in the planning area to make some changes.
.
. Mr. Taylor announced that while other areas are moving to water rationing the
City of Schertz does not have this concern.
. Mr. Taylor commented on the 4th of July Parade and note that employees and
volunteers worked very hard and everyone can take pride in this event.

· Announced that the Children's Advocacy Center will have a fundraiser on
September 1, 2005. Tickets will be available in the next couple of weeks. The
fundraiser will be a roast of Edmund Kuempel.

Investment Advisor
· Inquired about Northcliffe being an agenda item on the next workshop.
· Presented a question concerning the appointment of Mayor Pro-Tern and the City
Charter. The City Attorney, Michael Spain is to be contacted regarding the legal
determination of how this can be resolved.
· Explained .that the 1956 fire truck will be 50 years old next year. It has been
suggested that this fire truck be entirely refurbished. The question is how to fund
this. Council Member Douglas explained that there is a need to get an estimate
. of costs before further action can be taken. Council Member Wilenchik asks that
this be a future agenda item.
· Commented on the Investment Report and the lower rate of return on the
Economic Development Fund. The City Manager will check with the Finance
Director on this.

· Stated he will attend the TSAC meeting on Thursday.
· Thank the City Manager and Assistant City Manager for taking time to show and
explain the Schertz area.
· Inquired about the City Charter being a future agenda item for a workshop.

in the Bob Andrews Conference Room across the hall from the Council Chambers.

Judge and Assistant City Manager

An Executive Session was held for 8:10 pm to 9:00 pm.
