COUNCIL - WORKSHOP SESSION WEDNESDAY, DECEMBER 29, 2004 The Schertz City Council convened in workshop session on Wednesday, December 29, 2004 at 7:00 pm in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Schertz, Texas. The following members were present: Mayor Hal Baldwin presiding, Councilmembers Carl Douglas, Steve Simonson, Tony Wilenchik and Ken Greenwald. Councilmember Agee absent. Staff members present Dudley Wait, EMS Director sitting in for Interim City Manager Johnny Bierschwale and Deputy City Secretary Mary Ybarra. Mayor Baldwin opened the meeting at 7:00 p.m., and welcomed everyone. #1 HEARING OF RESIDENTS Robert Brockman, 4505 Grand Forest made the following comments: . Commented having found handbill (ad) on windshield and inquired if this type of advertising was legal. He was advised handbills were not illegal. . Reported sign at Live Oak is up. . #2 Discuss Public Hearing scheduled January 4, 2005 on the proposed imposition of a moratorium on property development in a platted residential subdivision. Mr. Wait informed Council that the matter before them regarding moratorium is just a reminder of upcoming Public Hearing scheduled for the first meeting next year. No discussion was necessary; Council would be ready to hold Public Hearing at next Council meeting. #3 ORDINANCE: Consider and take action on final reading of Ordinance on annexation of approximately 37.4 acres adjacent to existing city limits adjacent and between Northcliffe and Scenic Hills Subdivisions, Project 1 (Northcliffe Area). Mayor Baldwin introduced an Ordinance and read caption as follows: Ordinance No. 04-A-42 An Ordinance providing for the extension of the boundary lines of the City of Schertz, Texas by the Annexation of approximately 37.4 acres located adjacent to existing city limits adjacent and between Northcliffe and Scenic Hills Subdivisions. . 95 . Without further discussion, Councilmember Wilenchik moved to approve final reading of Ordinance on annexation of approximately 37.4 acres adjacent to existing city limits adjacent and between Northcliffe and Scenic Hills Subdivisions. Councilmember Greenwald seconded the motion, which carried with the following votes: AYES: Councilmembers Douglas, Simonson, Wilenchik and Greenwald. NAY: None. #4 ORDINANCE: Consider and take action on f'mal reading of Ordinance on annexation of 14.30 acres located adjacent to existing city limits known as Old Wiederstein Road, Project 2 (Old Wiederstein Road). Mayor Baldwin introduced an Ordinance and read caption as follows: ORDINANCE NO. 04-A-43 An Ordinance providing for the extension of the boundary lines of the City of Schertz, Texas by the annexation of approximately 14.30 acres located adjacent to existing city limits known as Old Wiederstein Road. . Without further discussion, Councilmember Douglas moved to approve final reading of Ordinance on annexation of 14.30 acres located adjacent to existing city limits known as Old Wiederstein Road, Project 2 (Old Wiederstein Road). Councilmember Simonson seconded the motion, which carried with the following votes: AYES: Councilmembers Douglas, Simonson, Wilenchik and Greenwald. NAY: None. #5 ORDINANCE: Consider and take action on final reading of Ordinance on annexation of 119.44 acres located adjacent to existing city limits line parallel to Maske Road at Fm 1518, Project 3 (Maske Road). Mayor Baldwin introduced an Ordinance and read caption as follows: ORDINANCE NO. 04-A-44 An Ordinance providing for the extension of the boundary lines of the City of Schertz, Texas by the annexation of 119.44 acres located adjacent to existing city limits line parallel to Maske Road at FM 1518. . Mayor Baldwin introduced an Ordinance and read the caption as follows: ORDINANCE NO. 04-A-45 An Ordinance providing for the extension of the boundary lines of the City of Schertz, Texas by the annexation of approximately 216.77 acres located adjacent to existing city limits between FM 2252, FM 482 and Union Pacific Railroad. NAY: None. #7 ORDINANCE: Consider and take action on f'mal reading of Ordinance on annexation of approximately 224.40 acres located adjacent to existing city limits line between FM 482 and Instate 35 near Hubertus Road, Project 5 (Hubertus Road Area); Mayor Baldwin introduced an Ordinance and read caption as follows: ORDINANCE NO. 04-A-46 An Ordinance providing for the extension of the boundary lines of the City of Schertz, Texas by the annexation of approximately 224.40 acres located adjacent to existing city limits line between FM 482 and Interstate 35 near Hubertus Road. Mayor Baldwin introduced an Ordinance and read caption as follows: ORDINANCE NO. 04-A-47 An Ordinance providing for the annexation of the boundary lines of the City of Schertz, Texas by the annexation of approximately 163.38 acres located adjacent to existing city limits line between Interstate 35 and Union Pacific Railroad near Friesenhahn Road. Without further discussion, Councilmember Simonson moved to approve final reading of Ordinance on annexation of approximately 163.38 acres locate adjacent to existing city limits line between Interstate 35 and Union Pacific Railroad near Friesenhalm Road. Councilmember Greenwald seconded the motion, which carried with the following votes: AYES: Councilmembers Douglas, Simonson, Wilenchik and Greenwald. NAY: None. . #9 CONSIDER AND TAKE POSSIBLE ACTION ON CHAIRS FOR NEW COUNCIL CHAMBERS. After a brief discussion, Council consensus was to select leather (Via Dyce) chair for Council Chambers. A total of 13 chairs would be ordered. Without further discussion, Councilmember Douglas moved to approve selection of leather chair (Via Dyce) for Council Chamber; total of 13 chairs would be ordered. Councilmember Simonson seconded the motion, which carried with the following votes: AYES: Councilmembers Douglas, Simonson, Wilenchik and Greenwald. NAY: None. #10 Items by Interim City Manager (Dudley Wait) General Announcement . Gave an update on Ed Ford, City Engineer, who has been hospitalized. In all probability he will be home by the weekend. . Wished everyone a Happy and Safe New Year. #11 Items by Council General Announcements . 98 . Councilmember Douglas Liaison EDC Liaison-Schertz Library Board . Inquired on recently appointed Judge Padgett and contract for a term of2 years. Is there a conflict with City charter and what was established with Judge Padgett as Municipal Court of Record Judge? Mayor Baldwin noted that he believes its State law that a Court of Record Judge serves a two-year term, and if that were the case it would prevail the City Charter. He was advised City Attorney would check into the matter. . Inqnired on construction out along FM15l8 and Wiederstein Road and was advised it's construction of water storage facility for Selma, their portion of SSLGC project. . Mayor Pro-tem Simonson 4-B Board Liaison BVY A . Wants to warn staff, now that FM482 has been annexed and if the same people that lived out there in the 80's still live out there, be prepared. Councilmember Greenwald 4- B Board Ex-officio P & Z Commission Ex-officio SSLG Corp. . Gave a report on Planning and Zoning meeting: . First two portions ofTanglewood Park Subdivision out on Eckerd Road is platted out. 99 . . O'Reily Auto Parts is coming next to Tiger Tote; site plan was approved with the exception of sign. The sign issue will have to come back to Planning and Zoning for consideration. . Public Works Building was approved. #12 Items by Mayor General Announcements . Mentioned that at next Tuesday nights meeting, he has asked that discussion regarding setting timetable for review of City Manager applications be placed on agenda. . Reported he would be signing ACCOG ballot to have Mayor Raymond Ramirez continue as representative. Mayor Ramirez is City of Floresville Mayor and would continue to represent counties of Comal, Guadalupe, Karnes and Wilson. The matter should have been placed on agenda for Council consideration, however it did not make it. Because the ballot is due by January 3, 2005 he will submit ballot, unless Council has objections.
