11-20-2018 Minutes-Special MeetingMINUTES SPECIAL MEETING November 20, 2018 A Special Meeting was held by the Schertz City Council of the City of Schertz, Texas, on November 20, 2018, at 6:00 .p.m. in the Hal Baldwin Municipal Complex Council Chambers, 1400 Schertz Parkway, Building #4, Schertz, Texas. The following members present to -wit: Mayor Michael Carpenter Councilmember Mark Davis Councilmember Scott Larson Councilmember Bert Crawford Councilmember Elect Allison Heyward Staff Present: Executive Director Dudley Wait City Secretary Brenda Dennis Call to Order — City Council Regular Session Mayor Pro -Tem David Scagliola Councilmember Ralph Gutierrez Councilmember Cedric Edwards Councilmember Angelina Kiser Councilmember Elect Tim Brown Acting City Manager Brian James City Attorney Charlie Zech Assistant to the City Manager Sarah Gonzalez Mayor Carpenter called the regular meeting to order at 6:02 p.m. Opening Prayer and Pledges of Allegiance to the Flags of the United States and State of Texas. (Mayor Carpenter) Mayor Carpenter provided the opening prayer followed by the pledges of Allegiance to the Flags of the United States and State of Texas. Hearing of Residents • Ms. Maggie Titterington, The Chamber President who provided information on the recent Chamber updates and provided information on the winners of the recent awards ceremony today. Ms. Titterington provided information on the newly elected Board Members. • Mr. Dana Eldridge, 2628 Gallant Fox Drive, who thanked Councilmembers Kiser and Crawford for their service on City Council, he also congratulated the newly elected officials Councilmembers Heyward and Brown on their recent election. • Mr. Brent Bolter, 2633 Cover Brook Lane, who also thanked Councilmembers Kiser and Crawford for their service on City Council and congratulated Councilmembers Heyward and Brown on their recent election Closed Session Mayor Carpenter recognized Councilmember Gutierrez who stated he seriously question the approaching of having an executive session minutes before sitting new Council, he therefore made a motion to amend the agenda and remove item number one. Mayor Carpenter in reply stated that 11 -20 -2018 Minutes Page - 1 - unfortunately with the agenda having been posted, a motion to remove an agenda item at this time would be out of order and not contained within our rules of procedure. Mayor Carpenter stated that he wouldn't be able to entertain that motion. Mayor Carpenter convened into closed session at 6:07p.m. 1. City Council will meet in closed session under Section 551.074 of the Texas Government Code, Personnel Matters to deliberate the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of the City Manager. Reconvene into Regular Session Mayor Carpenter reconvened into regular session at 6:35 p.m, 1 a. Take any action based on discussions held in closed session under Agenda Item 1. No Action taken. Mayor Carpenter stated that as is custom he would like to afford the outgoing Councilmembers the opportunity to make comments. Mayor Carpenter recognized Councilmembers Kiser and Crawford who provided their outgoing comments regarding their recent service on City Council. Discussion and Action Items 2. Resolution No. 18 -R -146 — Consideration and/or action approving a Resolution canvassing the returns and declaring the results of the November 6, 2018 General Election; and other matters in connection therewith. (Mayor/B. Dennis) The following was read into record: RESOLUTION NO. 18 -R -146 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, APPROVING THE CANVASS OF THE NOVEMBER 6, 2018 GENERAL ELECTION AND DECLARING THE RESULTS OF SUCH ELECTION Mayor Carpenter recognized City Secretary Brenda Dennis who provided the following information regarding the results of the November 6, 2018 General Election: 11 -20 -2018 Minutes Page - 2 - Ms. Dennis stated that with the results Allison Heyward is hereby elected to the Office of Councilmember Place 6 and Tim Brown is hereby elected to the Office of Councilmember Place 7. Mayor Carpenter recognized Councilmember Edwards who moved seconded by Councilmember Gutierrez to approve Resolution No. 18 -R -146. The vote was unanimous with Mayor Pro -Tem Scagliola, Councilmembers Davis, Gutierrez, Larson, Edwards, Crawford and Kiser voting for and no one voting no. Motion Passed. 3. Oath of Office — (B. Dennis) a. Newly Elected Officers — Oath of Office. (B. Dennis) Ms. Dennis provided the oaths of office to newly elected Councilmembers Heyward and Brown. b. Certificates of Election — Presentation of Certificates of Election. (Mayor Carpenter) Mayor Carpenter presented the Certificates of Election to newly elected Councilmembers Heyward and Brown. Roll Call Vote Confirmation City Secretary Brenda Dennis provided the Roll Call Vote Confirmation for agenda item 2. Mayor Carpenter stated that as is custom he would like to afford the incoming Councilmembers the opportunity to make comments as well as take comments from other fellow Councilmembers. Mayor Carpenter recognized newly elected Councilmembers Heyward and Brown who provided their comments and thanks for all those who participated in their campaigns and citizens who voted for them. They look forward to serving the citizens of Schertz. Members, of City Council thanked Councilmembers Kiser and Crawford for their service on City Council and for the work they have done. Members of Council congratulated new elected Councilmembers Heyward and Brown and look forward to working with them. Mayor Carpenter also complimented previous Council on the work done and commented particularly on the uniqueness of the hiring of a City Manager or the work being done toward hiring of a City Manager while straddling an election. It's never happened during his time on City Council, and talking to our City Attorney 18 years, hundreds of municipalities, he's never seen it before. Carpenter took a little privilege as the chair and stated so to the previous council that met at the beginning of the evening, well done and to this Council here at the end of the evening, well done. Let it be shown to all they may look at this in the future, if you have something like that going on and you need to know how to do it, take a look at the City of Schertz.
