Consent Agenda: A. Minutes for the January 23, 2019 regular meetings. Mr. Outlaw motioned to approved minutes for the January 23, 2019 regular meeting. Mr. Greenwald seconded the motion. ZC2019 -001 Hold a public hearing, consider and make a recommendation on a request to rezone approximately 2.5 acres of land from Pre - Development District (PRE) and General Business District (GB) to General Business District (GB), located at 6485 I11-35, City of Schertz, Comal County, Texas. Chairman Dahle opened the public hearing at 6:26 P.M. Caroline McDonald with Brown & Ortiz located at 112 East Pecan, San Antonio, TX. - spoke on behalf of the applicant. Chris Van Herdee with HMT Engineering & Surveying located at 410 North Seguin, New Bruanfels, TX. - spoke on behalf of the applicant. Chairman Dahle closed the public hearing at 6:28 P.M. There was a brief discussion. Mr. Outlaw motioned for a recommendation of approval to item ZC2019 -001. Mr. Rae seconded the motion. The vote was 5 -0, motion carried. B. SUP2019 -001 Hold a public hearing, consider and make a recommendation on a request for a Specific Use Permit to allow an Automobile Repair, Major land use on approximately 2.5 acres of land, more specifically described as Shefman- Schuetz Lot 2, located at 6485 IH -35, City of Schertz, Comal County, Texas. Chairman Dahle opened the public hearing at 6:36 P.M. Caroline McDonald with Brown & Ortiz located at 112 East Pecan, San Antonio, TX. - spoke on behalf of the applicant. Chairman Dahle closed the public hearing at 6:37 P.M. There was a brief discussion. Mr. Rae motioned for a recommendation of approval to item SUP2019 -001. Mr. Greenwald seconded the motion. The vote was 5 -0, motion carried. C. ZC2018 -001 Hold a public hearing, consider and act upon a request to rezone approximately 64 acres of land to Planned Development District (PDD) located approximately 1000 feet west of the intersection of Engel Road and the private street, Big John Lane. Applicant: KFW Engineers spoke and gave a presentation on behalf of the owner Bob Shaw - Resident (address not clear) spoke not in favor of agenda item ZC2018 -001. Andres Gonzales- 360 Big John Ln. - spoke not in favor of agenda item ZC2018 -001. Breezy Webb- 360 Big John Ln. -spoke not in favor of agenda item ZC2018 -001. John Sullivan — 513 Triple Crown- had question and concerns on agenda item ZC2018- 001. Chairman Dahle closed the public hearing at 7:31 P.M. There was a lengthy discussion. Mr. Braud motioned to approve item ZC2018 -001. Mr. Greenwald seconded the motion. The vote was 1 -4, motion fails. Forwarded a recommendation of disapproval to Council on item ZC2018 -001. 5. Items for Individual Consideration: A. PC2018 -051 Consider and act upon a request for approval of a preliminary plat for the Woodland Oaks Business Park North Subdivision an approximate 1.5 acre tract of land generally located at the intersection of Schertz Parkway and Woodland Oaks Drive, Guadalupe County, Texas. Mr. Braud recused himself for his property abuts the property for discussion. There was a lengthy discussion. Mr. Outlaw motioned to approve item PC2018 -051. Mr. Greenwald seconded the motion. The vote was 3 -1, motion fails. Mr. Rae nay motion was made because of no access onto Schertz Pkwy for the subject property. B. PC2018 -052 Consider and act upon a request for approval of a preliminary plat for the Woodland Oaks Business Park South Subdivision an approximate 6 acre tract of land generally located at the intersection of Schertz Parkway and Woodland Oaks Drive, Guadalupe County, Texas. The vote was 4 -0, motion carried. 6. Requests and Announcements: A. Requests by Commissioners to place items on a future Planning and Zoning Agenda. There were no requests by Commissioner. B. Announcements by Commissioners. Windy Meadows Lot 22, Block 2 (132 Windy Meadows) Site Plan- proposed 8,050 sqft office /warehouse 2. Windy Meadows Lot 23, Block 2 (128 Windy Meadows) Site Plan- proposed 8,085 sqft office /warehouse There were announcements by city staff. City Attorney, Dan Santee recommended item PC2018 -051 be reconsidered by the Commission. There was a lengthy discussion from Mr. Santee to reconsider the previous motion due to state law indicating a Commission must/shall approve a plat if meets City requirements. Mr. Outlaw motioned to approve item PC2018 -051. Mr. Greenwald seconded the motion. The vote was 4 -0, motion carried 7.
