WORKSHOP SESSION
JANUARY 9, 2007
The City of Schertz Council convened in Regular Workshop Session on Tuesday January
9, 2007 in the Municipal Complex Council Chambers at 7:00 p.m., 1400 Schertz
Parkway Building # 4 Schertz, Texas. The Following Members were present: Mayor Hal
Baldwin presiding, Mayor Pro Tern Jim Fowler, David L. Scagliolia, Reginna Agee,
Tony Wilenchik and Mayor Pro Tern Michael Carpenter. Also present were City
Manager Don Taylor, Assistant City Managers John Bierschwale and David Harris, City
Secretary Judy Tokar and City Attorney Michael Spain.
#1 CALL TO ORDER.
Mayor Baldwin called the meeting to order at 7:00 p.m.
#2 HEARING OF RESIDENTS:
Sharon Penninl!:ton, Chamber President, updated the Council on ribbon cuttings and
grand openings to be held for Chase Bank, UBuildit and announced the general monthly
membership meeting. She introduced the new Chamber President, Frances Rushing.
Robert Brockman. 1001 Elbel Road. asked if the City owns the property for the library,
should the public be using it for riding dirt bikes?
Henrv Gutierrez with Bexar Waste updated the Council on negotiations with the City of
San Antonio regarding hauling fees.
Jim Simon. 354 Frank Baum. represented the Jonas Woods Homeowners and said the
association was protesting the construction of the proposed gas station on Schertz
Parkway and Woodland Oaks Drive. What is the reason for another gas station when
there are 3 other stations so close?
#3 Update and discussion on drainage. Presenter - Larry Dublin, Ford Engineering
Larry Dublin, Ford Engineering, briefed the Council on the overall plan review and status
of all drainage problems in the City.
#4 ORDINANCE: Discussion on final reading of an ordinance amending the
Unified Development Code (UDC) Ordinance 96-S-28 by rezoning 88.833+
acres out of the J. Leal Survey No. 79, Abstract No. 424, in Bexar County,
Schertz, Texas from Residential/Agricultural District (R-A) to Single-Family
Dwelling District (R-6); providing an effective date and providing a repealing

clause. The property is generally located at the intersection of FM 1518 and
Schaefer Road.
Mr. Taylor said there is no change. It is ready for action at the regular meeting of
January 16th.
#5 ORDINANCE: Discussion on final reading of an ordinance amending the
Unified Development Code (DOC) Ordinance 96-S-28 by rezoning 2.270+
acres out of the Torribio Herrera Survey No. 68, Abstract No. 205, in
Guadalupe County, Schertz, Texas from Planned Unit Development District
(PUD) to General Business District (GB); providing an effective date; and
providing a repealing clause. The property is generally located on the north
side of Schertz Parkway at Woodland Oaks Drive.
Mr. Taylor said there is no change. It is ready for action at the regular meeting of
January 16th.
Mayor Pro Tern Fowler arrived at 8:05 p.rn.
#6 ORDINANCE: Discussion on final reading ofan ordinance amending the Unified
Development Code (UDC) Ordinance 96-S-28 by rezoning 4.618+ acres out of
the Genobera Malpaz Survey, Abstract No. 221, in Guadalupe County, Schertz,
Texas from Single-Family Residential District-l (R-l) Neighborhood Services
District (NS); providing an effective date; and providing a repealing clause. The
property is generally located at the northwest intersection of FM 3009 and Elbel
Road.
Mr. Taylor said there is no change. It is ready for action at the regular meeting of
January 16th.
#7 ORDINANCE: Discussion on final reading of an ordinance amending the
Unified Development Code (UDC) Ordinance 96-S-28 by rezoning 19.579+
acres out of the out of the Genobera Malpaz Survey, Abstract No. 221, in
Guadalupe County, Schertz, Texas from General Business District (GB) and
Neighborhood Service (NS) Districts to Multi-Family Residential District-4
(R-4) and General Business (GB) Districts; providing an effective date; and
providing a repealing clause. The property is generally located at the
southwest intersection of FM 3009 and Elbel Road.
Mr. Taylor said there is no change. It is ready for action at the regular meeting of
January 16th.
#8 Discussion on contract with Guadalupe County and Schertz Cibolo Universal
City ISO for Joint Election Services for May 2007 election.

Ms. Tokar explained this is the first year ofa joint election with the school district, it is
now required by law that the school district holds an election with a municipality that are
within their boundaries. The County contract is the standard agreement.
#9 Discussion on appointments to the Transportation Safety Advisory
Commission.
Mr. Bores, Chairman ofTSAC, said there are 4 reappointments and 1 new appointment
for consideration on the commission. There was no discussion from the Council.
#10 Discussion and consider requesting the United States Postal Service to
realign certain areas within the City of Schertz currently serviced by the
Cibolo, Tx. post office to the Schertz, Tx. post office including zip code
change.
Mr. Harris said there are several neighborhoods in north Schertz that utilize other than the
Schertz zip code 78154. There are also postal routes that use the Cibolo 78108 and New
Braunfels 78132 that are within the city boundaries. This is causing confusion and the
disadvantage of the lower ISO rating for fire insurance. Mr. Harris asked the Council if
they wanted to pursue initialing the process with the Postal Service to realign certain
areas including zip code changes.
Council gave consensus to go forward on this with the United States Postal Service.
#11 RESOLUTION: Discussion and action on a resolution by the City Council of the
City of Schertz, Texas authorizing a drainage modification agreement and release;
and other matters in connection therewith.
Councilmember Carpenter made a motion, seconded by Mayor Pro Tern Fowler, to
approve a resolution by the City Council of the City of Schertz, Texas authorizing a
drainage modification agreement and release; and other matters in connection therewith.
The vote was as follows:
A YES: Fowler, Scagliola, Agee, Wilenchik and Carpenter
NAY: None
Mayor Baldwin called for a five-minutes break before going into Executive Session at
8:31 p.rn.
The meeting reconvened at 9:10 p.m.
#12 EXECUTIVE SESSION: Called under Chapter 551 of the Texas Government
Code, Sub-Section 551.071 (1 A), Consultations with Attorney regarding pending
or contemplated litigation.
#13 No action was needed on the Executive Session.

Ms. Tokar said Mayor Pro Tern Fowler and Assistant City Manger David Harris are
going to attend the luncheon and graduation ceremony at the Election Law Seminar when
she receives her re-certification certificate next week

Mayor Baldwin congratulated Ms. Rushing on accepting the position of Chamber
President.
