GENERAL INFORMATION Section 395.058 (c) (4) of the Texas Local Government Code requires the Capital Improvements Advisory Committee (CIAO) to File semi - annual reports with respect to the progress of the capital improvements plan and report to City Council any perceived inequities in implementing the plan or imposing impact fees. Section 90 -158 of the City's Code of Ordinance includes this same requirement. The two expenses to the Capital Impact Fee Funds for this period were investment management fees for the Sewer Impact Fees and auditor costs. There the only expense for the Water Impact Fees was for auditor costs. Project Expenses for Water Impact Fee projects were $9,843.00 in engineering costs, $26,670.31 to extend CPS utilities to the site, and $13,800.32 to purchase right of way for the Corbett Elevated Tank. Project Expenses for the Sewer Impact Fee projects were $116,400.00 in lease costs for the Crossvine's Batch Plant Expansion and $56,860.59 in engineering and right of way costs for the Woman Hollering Trunk Line project. There were no Project Expenses for any Roadway Impact Fee projects. Project Status: Corbett Elevated Water Storage Tank: The Notice to Proceed was issued on February 11 th and work onsite began in late - March. Landmark Structures and City Staff are working through the submittal process. Landmark Structures is also working to finalize the tank foundation design. The project is expected to be completed July of 2020. 2. Woman Hollering Creek Wastewater Interceptor Main and Lift Station: CobbFendley continues to work on making the final plan revisions and the bid documents. City Staff and CobbFendley continue to negotiate with property owners to acquire necessary easements for the project. Revised offer letters have been sent out to property owners and negotiations continue with property owners. CobbFendley is working to complete the City's platting and site plan process for the lift station site. The bidding of the project is dependent on easement acquisition, but the project is planned to be bid in the late Spring or early Summer of 2019. The attached report is the semi - annual report from October 1, 2018 through March 31, 2019. STAFF NOTE: Roadway Impact Fees will now be included in this report. A new page at the end of the report has been added to show revenues, expenditures, and balances for the period. Once projects are identified, a new report showing projects and funding allocation will be added. STAFF ANALYSIS AND RECOMMENDATION Staff recommends the CIAC accept this report and file the semi - annual report with City Council. A public hearing notice was published in the "San Antonio Express" on April 3, 2019. At the time of this staff report, one (1) response in favor, four (4) responses opposed to, and zero (0) responses neutral to have been received. 1 11010 V3110V ru Ell 11141VA On February 26, 2019 Pape- Dawson Engineers, Inc. requested to have a driveway onto Schertz Parkway approximately 180 feet north of the intersection of Woodland Oaks Drive and Schertz Parkway. On February 28, 2019 the City of Schertz Engineering Department made a determination that access onto Schertz Parkway would not be allowed. The property owner, pursuant to UDC Section 21.14.5.C, wishes to appeal that Staff determination. BACKGROUND The City of Schertz has multiple standards that dictate how access should be provided to public streets. Some of these standards are explicit, while others rely on Traffic Impact Analysis and professional judgement to determine the most appropriate access for a given property or site. One key factor in determining appropriate access is the classification of the street. Different street classifications have different goals. For example, a local street's goal is to provide access to individual lots or parcels. Therefore, there are often multiple accesses spaced fairly close together on local streets to maximize access. The more access points there are on a street, the less efficient the street moves traffic through an area. Conversely, the goal of an arterial street is to move traffic from one point to another. Since the goal is to move traffic through an area, access points are restricted on these roads to maximize traffic flow. This concept is explained in the City's Master Thoroughfare Plan (MTP). The MTP also provides classifications for the roadways in the City. Per the MTP, Schertz Parkway is classified as a Principal. Arterial. The MTP states, "Principal arterials carry traffic across major segments of the community, with a primary function of throughput, rather than access. Driveway access is often limited and parking is prohibited." In line with this philosophy, the Schertz Design Guide has more stringent access requirements for arterial roadways than other street types. This is done to limit the number of access points, implementing the philosophy of the MTP and maintaining traffic flow on the arterial streets. Section 21.14.1.N of the Unified Development Code (UDC) was created to implement this philosophy. This section of the UDC states, "Access to principal and secondary arterials should be limited to protect the flow of traffic from the lots. A one -foot non access easement shall be provided along principal and secondary arterial streets when the lots have access to another public right -of- way." This property does have access to a public right -of -way other than Schertz Parkway. The property has sufficient street frontage on Woodland Oaks Drive to provide for an access point to serve the property. Therefore, based on UDC Section 21.14. IN, the property is not allowed to take access from Schertz Parkway. The Fire Marshall also reviewed this request and determined that having only one entrance to the site provided by a driveway from Schertz Parkway would not allow the site to be adequately serviced by the Fire Department during emergency situations; the proposed driveway on Schertz Parkway does not provide space for adequate turning movements of fire apparatus, and therefore the driveway on Woodland Oaks Drive is required for emergency services. The Fire Department recommends the driveway from Woodland Oaks remain in place, and shows deference to the City of Schertz Engineering Department's recommendation to not allow an additional driveway onto the site from Schertz Parkway. Staff's determination that the site should not a driveway on Schertz Parkway should be upheld. The Fire Department does not have the ability to access the site from a single driveway on Schertz Parkway, therefore requiring the site to have access on Woodland Oaks Drive. The driveway on Woodland Oaks Drive should be the only access point granted for the site, because a driveway on Schertz Parkway would be in direct conflict with UDC Section 21.14.1.N and the MTP philosophy. Upholding Staff s recommendation would meet the requirements of UDC Section 21.14. I N, and enforcement of this section does not impose an undue hardship on the property as access can be provided to the property from Woodland Oaks Drive. *While the Commission can impose conditions; conditions should only be imposed to meet requirements of the UDC. COMMISSIONERS CRITERIA FOR CONSIDERATION: The Planning and Zoning Commission is the final approval authority of the proposed appeal to a driveway waiver determination. In considering final action on an appeal, the Commission should consider the criteria within UDC, Section 21.14.5 Driveways and UDC, Section 21.4.14 Appeals.
