04-09-2019 MinutesMINUTES REGULAR MEETING April 9, 2019 A Regular Meeting was held by the Schertz City Council of the City of Schertz, Texas, on April 9, 2019, at 6:00 p.m. in the Hal Baldwin Municipal Complex Council Chambers, 1400 Schertz Parkway, Building #4, Schertz, Texas. The following members present to -wit: Mayor Pro -Tem Allison Heyward Councilmember Mark Davis Councilmember Scott Larson Councilmember David Scagliola Staff Present: Assistant City Manager Brian James City Secretary Brenda Dennis Call to Order — City Council Regular Session Councilmember Ralph Gutierrez Councilmember Cedric Edwards Councilmember Tim Brown City Manager Dr. Mark Browne City Attorney Daniel Santee Deputy City Secretary Gayle Wilkinson Mayor Pro-Tern Heyward called the regular meeting to order at 6:00 p.m. Opening Prayer and Pled: es of Allegiance to the Fla -,s of the United States and State of Texas. ( Councilmember Larson) Councilmember Larson provided the opening prayer followed by the Pledges of Allegiance to the Flags of the United States and State of Texas. Presentation • 2018 Achievement of Library Excellence Award Presentation Library Director M. Uhlhom gave a Power Point overview explaining the criteria for the award. • Proclamation recognizing National Library Week Library Director M. Uhlhom accepted the award along with several of her staff from the Library. • Proclamation recognizing National Telecommunications Week Communications Manager Kim Harris and a few of her dispatchers accepted the Proclamation. Mayor Pro-Tern Heyward read and presented the above proclamations. Individuals from the various organizations thanked the city for their continued support. Minutes — Consideration and/or action regarding the approval of the minutes of the regular meeting of April 2, 2019. (B. Dennis /G. Wilkinson) The following was read into record: RESOLUTION NO. 19 -R -41 A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, AUTHORIZING A CONTRACT WITH UBEO BUSINESS SERVICES TO PROVIDE MANAGED PRINT EQUIPMENT AND SERVICES. The following was read into record: RESOLUTION NO. 19 -R -42 A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, AUTHORIZING A CONTRACT WITH D. GUERRA CONSTRUCTION, LLC RELATING TO THE CONSTRUCTION OF THE F.M. 1103 TXDOT UTILITY ADJUSTMENTS PROJECT. The following was read into record: RESOLUTION NO. 19 -R -47 A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS SUPPORTING THE UNITED STATES CENSUS BUREAU BY CREATING A CENSUS 2020 "COMPLETE COUNT COMMITTEE" Mayor Pro-Tern Heyward recognized Councilmember Edwards who moved seconded by Councilmember Gutierrez to approve the consent agenda items 1 through 4. The vote was unanimous with Mayor Pro -Tem Heyward, Councilmembers Davis, Gutierrez, Larson, Edwards, Scagliola and Brown voting yes and no one voting no. Motion passed. Discussion and Action Items 5. Ordinance No. 19 -S -14 — Conduct a Public hearing and/consideration and/or action PH approving an Ordinance on a request for a Specific Use Permit to allow for operation of a Convenience Store with Gas Pumps on approximately 2 acres of land, more specifically described as the southeast corner of FM 3009 and Ripps - Kreusler. First Reading (B. James/L. Wood/N. Koplyay) The following was read into record: ORDINANCE NO. 19 -S -14 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS TO APPROVE A SPECIFIC USE PERMIT TO ALLOW FOR OPERATION OF A CONVENIENCE STORE WITH GAS PUMPS AT THE SOUTHEAST CORNER OF FM 3009 AND RIPPS- KREUSLER, CITY OF SCHERTZ, GUADALUPE COUNTY, TEXAS. Mayor Pro -Tem Heyward recognized Planner 1 N. Koplyay who provided a Power Point outlining the SUP proposed area. Mayor Pro -Tem Heyward opened the public hearing; As no one spoke, closed the public hearing for Council comments. Staff addressed questions from Council. Mayor Pro -Tem Heyward recognized J.D. Dudley, a real estate project manager for QuikTrip, to show a Power Point and make comments about QuikTrip as a product line and customer service entity. Mayor Pro -Tem Heyward recognized Councilmember Scagliola who moved seconded by Councilmember Edwards to approve Ordinance No. 19 -S -14. The vote was unanimous with Mayor Pro -Tem Heyward, Councilmembers Davis, Gutierrez, Larson, Edwards, Scagliola and Brown voting yes and no one voting no. Motion passed. 6. Resolution No. 19 -R -43 — Conduct a Public hearing and/consideration and/or action approving a Resolution authorizing the power of eminent domain for the acquisition of PH permeant pipeline easements and certain property rights necessary for the woman Hollering Creek Wastewater Line Improvement project for the construction, enlargement and maintenance of pipelines and appurtenances designed to carry wastewater; acquisition of temporary workspace easements; directing the City Manager or the City Manager's Designee to execute all documents to institute eminent Domain proceedings; and directing the City Attorney to initiate Condemnation proceedings. (B. James/K. Woodlee) The following was read into record: RESOLUTION NO. 19 -R -43 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, AUTHORIZING THE POWER OF EMINENT DOMAIN FOR THE ACQUISTION OF PERMANENT PIPELINE EASEMENTS AND CERTAIN PROPERTY RIGHTS NECESSARY FOR THE WOMAN HOLLERING CREEK WASTEWATER LINE IMPROVEMENT PROJECT FOR THE CONSTRUCTION, ENLARGEMENT AND MAINTENANCE OF PIPELINES AND APPURTENANCES DESIGNED TO CARRY WASTWATER; ACQUISITION OF TEMPORARY WORKSPACE EASEMENTS; AUTHORIZING THE CITY MANAGER OR THE CITY MANAGER'S DESIGNEE TO EXECUTE ALL DOCUMENTS TO INSTITUTE EMINENT DOMAIN PROCEEDINGS; AND AUTHORIZING THE CITY ATTORNEY TO INITIATE CONDEMNATION PROCEEDINGS. Mayor Pro -Tern Heyward recognized City Engineer K. Woodlee who gave an overview and status for the Woman Hollering Creek wastewater line improvement project. K. Woodlee corrected an error made in her CCM for this project. The amount available for negotiations is $300,000.00 not $150,000.00. Mayor Pro -Tem Heyward opened the public hearing; As no one spoke, closed the public hearing for Council comments. Council provided their opinions and concerns regarding this item. Staff addressed questions from Council. Councilmember Edwards states for the record we have already committed financially to the wastewater plant. We need the waste water line to transport the waste. "It's not popular, but it's important work." Mayor Pro -Tem Heyward recognized Councilmember Gutierrez who moved seconded by Councilmember Edwards to approve Ordinance No. 19 -R -43. The vote was 6 -1 with Mayor Pro - Tem Heyward, Councilmembers Davis, Gutierrez, Larson, Edwards, and Brown voting yes and Councilmember Scagliola voting no. Motion passed. Roll Call Vote Confirmation Mayor Carpenter recognized Deputy City Secretary Gayle Wilkinson who provided the roll call votes for items 1 -6. James and his team for the Movin' on Main event. He also thanked Director of Parks, Recreation & Community Services L. Shrum, the Police Department, EMS and Fire for their work at the event. Dr. Browne also thanked Public Affairs Director L. Klepper and her team for their hard work putting together the memorial for Linda Babineau. 7.
